Căn cứ Nghị định số 55/2003/NĐ-CP ngày 28
tháng 5 năm 2003 của Chính phủ quy định chức năng, nhiệm vụ, quyền hạn và cơ cấu
tổ chức của Bộ Công nghiệp;
Căn cứ Nghị định số 12/2006/NĐ-CP ngày 23 tháng 01 năm 2006 của Chính phủ
quy định chi tiết thi hành Luật Thương mại về hoạt động mua bán hàng hoá quốc tế
và các hoạt động đại lý mua, bán, gia công và quá cảnh hàng hóa với nước ngoài;
Căn cứ Nghị định số 100/2005/NĐ-CP ngày 03 tháng 8 năm 2005 của Chính phủ về
thực hiện Công ước cấm phát triển sản xuất, tàng trữ, sử dụng và phá huỷ vũ khí
hoá học;
Theo đề nghị của Vụ trưởng Cơ khí, Luyện kim và Hoá chất,
QUYẾT ĐỊNH:
Điều 1. Công bố Danh mục hoá chất cấm xuất khẩu, cấm nhập khẩu theo quy định tại Nghị định số 12/2006/NĐ-CP ngày 23 tháng 01 năm 2006 của Chính phủ quy định chi tiết thi hành Luật Thương mại về hoạt động mua bán hàng hoá quốc tế và các hoạt động đại lý mua, bán, gia công và quá cảnh hàng hóa với nước ngoài (có Danh mục kèm theo).
Việc xuất khẩu, nhập khẩu hoá chất thuộc Danh mục hoá chất cấm xuất khẩu, cấm nhập khẩu trong những trường hợp đặc biệt cho mục đích nghiên cứu, y tế, dược phẩm hoặc bảo vệ thực hiện theo quy định tại Điều 5 Nghị định số 100/2005/NĐ-CP ngày 03 tháng 8 năm 2005 của Chính phủ về thực hiện Công ước cấm phát triển sản xuất, tàng trữ, sử dụng và phá huỷ vũ khí hoá học.
Điều 2. Quyết định này có hiệu lực từ ngày 01 tháng 5 năm 2006.
Điều 3. Các Bộ, cơ quan ngang Bộ, cơ quan thuộc Chính phủ, Uỷ ban nhân dân tỉnh, thành phố trực thuộc Trung ương và các tổ chức, cá nhân có liên quan chịu trách nhiệm thi hành Quyết định này.

DECISION
PROMULGATING A LIST OF CHEMICALS BANNED FROM IMPORT AND EXPORT UNDER THE GOVERNMENT'S DECREE No. 12/2006/ ND-CP OF JANUARY 23, 2006
THE MINISTER OF INDUSTRY
Pursuant to the Government's Decree No.
55/2003/ ND-CP of May 28, 2003, defining the functions, tasks, powers and
organizational structure of the Ministry of Industry;
Pursuant to the Government's Decree No. 12/2006/ ND-CP of January 23, 2006,
detailing the implementation of the Commercial Law regarding activities of
international goods sale and purchase and goods sale and purchase agency,
processing and transit with foreign parties;
Pursuant to the Government's Decree No. 100/ 2005/ND-CPofAugust3,2005, on
the implementation of the Convention on the Prohibition of the Production,
Stockpiling and Use of Chemical Weapons and on their Destruction;
At the proposal of the director of the Engineering, Metallurgy and Chemicals
Department,
DECIDES:
Article 1.- To promulgate a list of chemicals banned from import and export under the provisions of the Government's Decree No. 12/2006/ND-CP of January 23, 2006, detailing the implementation of the Commercial Law regarding activities of international goods sale and purchase and goods sale and purchase agency, processing and transit with foreign arties (see the list enclosed herewith).
The import and export of chemicals on the list of chemicals banned from import, export in special cases for research, medical, pharmaceutical or protection purposes shall comply with the provisions of Article 5 of the Government's Decree No. 10072005/ND-CP of August 3, 2005, on the implementation of the Convention on the Prohibition of the Production, Stockpiling and Use of Chemical Weapons and on their Destruction.
Article 2.- This Decision takes effect as from May 1,2006.
