QUYẾT ĐỊNH

VỀ VIỆC BAN HÀNH KẾ HOẠCH HÀNH ĐỘNG CỦA NGÀNH CÔNG THƯƠNG TRIỂN KHAI THỰC HIỆN NGHỊ QUYẾT SỐ 33/2016/QH14 VỀ CHẤT VẤN VÀ TRẢ LỜI CHẤT VẤN TẠI KỲ HỌP THỨ 2, QUỐC HỘI KHÓA XIV TRONG LĨNH VỰC THỦY ĐIỆN

Căn cứ Nghị định số 95/2012/NĐ-CP ngày 12 tháng 11 năm 2012 của Chính phủ quy định chức năng, nhiệm vụ, quyền hạn, cơ cấu tổ chức của Bộ Công Thương;

Căn cứ Nghị quyết số 62/2013/QH13 ngày 27 tháng 11 năm 2013 của Quốc hội Khóa XIII về tăng cường công tác quản lý quy hoạch, đầu tư xây dựng, vận hành khai thác công trình thủy điện (Nghị quyết số 62/2013/QH13);

Căn cứ Nghị quyết số 33/2016/QH14 ngày 23 tháng 11 năm 2016 của Quốc hội Khóa XIV về chất vấn và trả lời chất vấn tại Kỳ họp thứ 2 (Nghị quyết số 33/2016/QH14);

Căn cứ Nghị quyết số 11/NQ-CP ngày 18 tháng 02 năm 2014 của Chính phủ ban hành Chương trình hành động thực hiện Nghị quyết số 62/2013/QH13 ngày 27 tháng 11 năm 2013 của Quốc hội khóa XIII về tăng cường công tác quản lý quy hoạch, đầu tư xây dựng và vận hành khai thác công trình thủy điện (Nghị quyết số 11/NQ-CP);

Xét đề nghị của Tổng cục trưởng Tổng cục Năng lượng,

QUYẾT ĐỊNH:

Điều 1. Ban hành Kế hoạch hành động của ngành Công Thương triển khai thực hiện Nghị quyết số 33/2016/QH14 trong lĩnh vực thủy điện với những nội dung chủ yếu sau:

1. Mục tiêu

- Tiếp tục triển khai, thực hiện thắng lợi Nghị quyết số 62/2013/QH13, Nghị quyết số 33/2016/QH14 và Nghị quyết số 11/NQ-CP.

- Tạo sự chuyển biến tích cực trong công tác quản lý nhà nước và thực thi các quy định pháp luật của các cơ quan, đơn vị liên quan về quy hoạch, đầu tư xây dựng, vận hành, khai thác các dự án/công trình thủy điện, bảo đảm việc phát triển thủy điện an toàn, bảo vệ môi trường - xã hội và đạt hiệu quả khai thác tổng hợp.

2. Yêu cầu

- Thực hiện đồng bộ các giải pháp nhằm phát hiện, khắc phục những vấn đề tồn tại, hạn chế, yếu kém, giải quyết các khó khăn, vướng mắc trong công tác quản lý quy hoạch, đầu tư xây dựng, vận hành, khai thác các dự án/công trình thủy điện.

- Các đơn vị thuộc Bộ và các cơ quan, đơn vị liên quan chủ động, tích cực, phối hợp chặt chẽ để thực hiện, hoàn thành các nhiệm vụ được giao hoặc các nhiệm vụ có liên quan.

3. Nội dung, nhiệm vụ của Kế hoạch

- Tiếp tục thực hiện các nội dung, nhiệm vụ được Chính phủ giao cho Bộ Công Thương chủ trì thực hiện tại Nghị quyết số 11/NQ-CP.

- Rà soát, đánh giá tổng thể các văn bản quy phạm pháp luật, Quy chuẩn kỹ thuật, Tiêu chuẩn kỹ thuật liên quan đến công tác quản lý về quy hoạch, đầu tư xây dựng, chất lượng công trình, vận hành, khai thác, an toàn đập thủy điện. Từ đó, kịp thời đề xuất cấp có thẩm quyền xem xét sửa đổi, bổ sung kịp thời, đảm bảo tuân thủ pháp luật hiện hành và đáp ứng yêu cầu thực tiễn.

- Đánh giá tình hình thực hiện công tác quản lý chất lượng các dự án/công trình thủy điện từ giai đoạn quy hoạch đến khi nghiệm thu đưa vào vận hành khai thác của các cơ quan, đơn vị liên quan (cơ quan quản lý nhà nước, chủ đầu tư dự án, các nhà thầu tham gia thực hiện dự án...). Trong đó, cần đánh giá tình hình bố trí nhân lực thực hiện nhiệm vụ này của Sở Công Thương các tỉnh liên quan; việc chấp hành các quy định liên quan của Chủ đầu tư các dự án thủy điện; đánh giá các tồn tại, khó khăn, vướng mắc và đề xuất các giải pháp nhằm đảm bảo quản lý chặt chẽ chất lượng công trình thủy điện.

- Rà soát kỹ nội dung các Quy trình vận hành (QTVH) hồ chứa thủy điện để đảm bảo tuân thủ các quy định pháp luật hiện hành; đánh giá tình hình thực hiện các quy định tại QTVH liên hồ chứa trên lưu vực sông, QTVH hồ chứa của Chủ đập thủy điện và các cơ quan, đơn vị liên quan; tổng hợp thông tin về các hồ chứa chưa tuân thủ quy định về việc lập, trình phê duyệt QTVH; đánh giá các khó khăn, vướng mắc trong thực hiện và đề xuất, kiến nghị điều chỉnh, bổ sung các quy định liên quan tại QTVH hồ chứa thủy điện đã được cấp thẩm quyền phê duyệt. Từ đó, chủ động giải quyết hoặc kiến nghị cấp có thẩm quyền giải quyết nhằm đảm bảo vận hành khai thác các công trình thủy điện an toàn, bảo vệ môi trường - xã hội, đạt hiệu quả khai thác tổng hợp, phù hợp với điều kiện khí tượng, thủy văn, địa hình, hiện trạng hành lang thoát lũ, bố trí dân cư, hạ tầng kỹ thuật ...vùng hạ du đập.

- Tổ chức thực hiện, tổng hợp tình hình thực hiện và đánh giá kỹ nội dung các Phương án: phòng, chống lụt bão đảm bảo an toàn đập, phòng, chống lũ lụt vùng hạ du do xả lũ và vỡ đập và bảo vệ đập tại các công trình thủy điện; rà soát, đánh giá khó khăn, vướng mắc tại các đập thủy điện chưa lập, trình duyệt các Phương án nêu trên. Trong đó, cần đánh giá việc quan trắc khí tượng, thủy văn tại công trình và trên lưu vực của Chủ đập; việc bảo vệ, tình hình xâm phạm hành lang thoát lũ ở hạ du các đập thủy điện; việc lập bản đồ ngập lụt vùng hạ du đập; công tác diễn tập Phương án phòng, chống lũ lụt vùng hạ du đập... Từ đó, kịp thời điều chỉnh, bổ sung nội dung các Phương án nêu trên; thực hiện các biện pháp khả thi đảm bảo tuân thủ các quy định pháp luật về an toàn đập, đặc biệt là tại các công trình thủy điện khu vực miền Trung và Tây Nguyên.

- Rà soát, đánh giá việc chấp hành quy định pháp luật về điều kiện cấp và duy trì Giấy phép hoạt động điện lực (Giấy phép HĐĐL) của các nhà máy thủy điện. Trong đó, cần đánh giá việc thực hiện xả dòng chảy tối thiểu, cung cấp nước cho hạ du; thực hiện các quy định về bảo vệ môi trường, trồng rừng thay thế, chi trả dịch vụ môi trường rừng, phòng chống cháy nổ, quản lý chất lượng công trình, an toàn đập, vận hành hồ chứa; việc đáp ứng yêu cầu điều kiện của cán bộ vận hành...Từ đó, thực hiện các giải pháp nhằm đảm bảo các nhà máy thủy điện chấp hành đầy đủ quy định pháp luật liên quan.

- Tổ chức phổ biến đầy đủ kiến thức, quy định pháp luật liên quan đến việc chỉ huy, thực hiện lệnh vận hành hồ chứa thủy điện (đặc biệt trong mùa mưa, lũ) cho các tỉnh, các nhà máy thủy điện còn những vấn đề tồn tại, hạn chế liên quan.

- Tăng cường công tác thông tin, tuyên truyền về vai trò, chức năng của các công trình thủy điện; nội dung QTVH hồ chứa thủy điện; các quy định về an toàn đập và công tác phòng, chống lụt bão của công trình thủy điện.

4. Phân công trách nhiệm

a) Tổng cục Năng lượng, các Cục, Vụ thuộc Bộ Công Thương, Ủy ban nhân dân (UBND) và Sở Công Thương các tỉnh, thành phố trực thuộc Trung ương, các Chủ đập thủy điện và các cơ quan, đơn vị liên quan kịp thời tổ chức thực hiện, hoàn thành các nhiệm vụ được giao; báo cáo kết quả thực hiện về Bộ Công Thương, đồng thời gửi các đơn vị liên quan khác theo yêu cầu cụ thể tại Phụ lục kèm theo Quyết định này.

b) Giao Tổng cục Năng lượng làm đầu mối theo dõi, đôn đốc các cơ quan, đơn vị có liên quan thực hiện, tổng hợp, lập báo cáo trình Bộ trưởng Bộ Công Thương để báo cáo các cơ quan có thẩm quyền liên quan về kết quả thực hiện Kế hoạch này.

Điều 2. Quyết định này có hiệu lực thi hành từ ngày ký.

Điều 3. Chánh Văn phòng Bộ, Tổng cục trưởng Tổng cục Năng lượng, Cục trưởng Cục Kỹ thuật an toàn và Môi trường công nghiệp, Cục trưởng Cục Điều tiết điện lực, Vụ trưởng Vụ Khoa học và Công nghệ, Vụ trưởng Vụ Kế hoạch, Vụ trưởng Vụ Pháp chế; Chủ tịch UBND và Giám đốc Sở Công Thương các tỉnh, thành phố trực thuộc Trung ương có dự án thủy điện; Tổng giám đốc Tập đoàn Điện lực Việt Nam và Thủ trưởng các cơ quan, đơn vị liên quan chịu trách nhiệm thi hành Quyết định này./.

ON INTRODUCTION OF ACTION PLAN FOR IMPLEMENTING THE RESOLUTION No.33/2016/QH14 ON INTERPELLATION AND ANSWER ABOUT HYDROPOWER AT SECOND MEETING SESSION HELD BY XIV NATIONAL ASSEMBLY

THE MINISTER OF INDUSTRY AND TRADE

Pursuant to the Government’s Decree No.95/2012/ND-CP dated November 12, 2012 defining rights, responsibilities , power and organizational structure of the Ministry of Industry and Trade;

Pursuant to the Resolution No.62/2013/QH13 dated November 27, 2013 by the 13^rd National Assembly on strengthening management, planning, construction and operation of hydropower construction works (hereinafter referred to as “Resolution No.62/2013/QH13”);

Pursuant to the Resolution No.33/2016/QH14 dated November 23, 2016 by 14^th on interpellation and answer at 2^ndsession (Resolution No.33/2016/QH14);

Pursuant to the Government’s Resolution No.11/NQ-CP dated February 18, 2014 on implementing the Resolution No.62/2013/QH13 dated November 27, 2013 by the 13rd National Assembly on strengthening management, planning, construction and operation of hydropower works (hereinafter referred to as “Resolution No.11/NQ-CP”);

Article 1. To release the action plan for implementing the Resolution No.33/2016/QH14 in hydropower industry. To be specific:

1. Objectives

- Successfully implement the Resolution No.62/2013/QH13, Resolution No.33/2016/QH14 and Resolution No.11/NQ-CP.

- Make positive change in state management and enforcement of regulations of laws on planning, construction, investment and operation of hydropower projects/works by relevant authorities; ensure safety development of hydropower industry, social and environmental protection .

2. Requirements

- Harmoniously take measures for detecting and overcoming difficulties and shortcomings in planning, construction investment and operation of hydropower works/projects.

- Affiliates of Ministry and relevant agencies shall actively cooperate in implementation assigned duties or related duties.

3. Contents

- Implement duties governed by The Ministry of Industry and Trade as assigned by the Government in the Resolution No. 11/NQ-CP

- Make assessment of hydropower works quality control from the planning stage to acceptance and operation by relevant authorities ( such as State management authorities, project owners and contractors. Allocation of personnel by the Departments of Industry and Trade of involved provinces, the compliance with relevant regulations of laws by investors of hydropower projects; difficulties and measures for hydropower works quality control shall be assessed.

- Review the process for operating hydroelectric reservoirs to ensure it is conformable to current regulations of laws (hereinafter referred to as “operations process”); assess the application of operations process to inter-reservoirs on river basins, and operations process issued by hydroelectric dams owners and relevant agencies; aggregate information on reservoirs to which the operations process applied is not conformable to regulations on preparation and approval of the operations process; assess difficulties and issues arising in connection to implementation, proposal and request for adjustments and supplementation to relevant provisions in operations process approved by the competent authority. Actively solve or request the competent authority to solve arising difficulties and issues to ensure safe operation of hydropower works, environmental protection, effective operation according to meteorology, hydrography, topography and current flood drainage corridors, etc.

- Apply flood control measures to electric dams and downstream rivers; review and assess difficulties arising at electric dams for which these above mentioned measures have yet to be made and approved. Meteorological and hydrological monitoring at construction sites and in basins by dam owners; preparation of flood maps and flood-defense rehearsals, etc. shall be deemed necessary.
Punctually modify and supplement these above-mentioned plans; take feasible measures in accordance with regulations on dam safety, especially in hydroelectric dams in central coast and high land of Vietnam.

- Review and assess compliance with regulations of laws on issue and retention of electrical operating permits by hydroelectric plants. The minimum outflow discharge, water supply to downstream areas, implementation of regulations on environmental protection, afforestation , payment of forest environmental service charges, fire and explosive prevention, dam and reservoir quality control and operation, qualifications of operators, etc. shall be evaluated. Appropriate measures shall be taken, accordingly, to ensure the duly compliance with relevant regulations of laws.

- Disseminate relevant regulations of laws related to direction and operation of reservoirs and hydropower plants where shortcomings still exist.

- Disseminate information on the roles and functions of hydropower works; operations process and regulations of dam safety and flood prevention.

4. Responsibilities

a) The General Directorate of Energy, affiliates of the Ministry of Industry and Trade, People’s Committees, Departments f provinces, owners of hydroelectric dams and relevant authorities shall punctually perform and complete assigned duties and submit progress reports to the Ministry of Industry and Trade and relevant authorities upon request as stipulated in the Annex attached hereto.

b) Designate the General Directorate of Energy to play the leading role in monitoring and accelerating relevant authorities to prepare, aggregate and submit reports on implementation of this Plan to the Minister of Industry and Trade.

The Chief of Ministerial Office, Director General of General Directorate of Energy, Directors of the Industrial Safety Techniques and Environment Agency, Director of the Department of Science and Technology, Director of the Department of Planning, Director of Department of Legislation; Presidents of the People’s Committees and Directors of the Department of Industry and Trade of provinces having hydropower projects; Director General of Vietnam Electricity and Heads of relevant authorities shall be responsible for implementing this Decision./.
