VỀ VIỆC BAN HÀNH “QUY ĐỊNH VỀ HÀM LƯỢNG 3-MCPD TRONG NƯỚC TƯƠNG, XÌ DẦU, DẦU HÀO”

Căn cứ Nghị định số 49/2003/NĐ-CP ngày
15/5/2003 về việc quy định chức năng, nhiệm vụ, quyền hạn và cơ cấu tổ chức Bộ
Y tế;
Căn cứ Nghị định số 163/NĐ-CP ngày 07/9/2004 của Chính phủ về Quy định chi tiết
một số điều của Pháp lệnh vệ sinh an toàn thực phẩm;
Theo đề nghị của Vụ trưởng Vụ Khoa học và Đào tạo, Vụ trưởng Vụ Pháp chế - Bộ Y
tế và Cục trưởng Cục An toàn vệ sinh thực phẩm,
QUYẾT ĐỊNH
Điều 2. Quyết định này có hiệu lực sau 15 ngày, kể từ ngày đăng công báo.

VỀ HÀM LƯỢNG 3-MCPD (3-MONOCLO PROPAN-1,2- DIOL) TRONG NƯỚC
TƯƠNG, XÌ DẦU, DẦU HÀO.
(Ban hành kèm theo Quyết định số 11/2005/QĐ-BYT ngày 25 tháng03 năm 2005 của
Bộ trưởng Bộ Y tế)
Quy định này điều chỉnh về hàm lượng 3-MCPD (3-monoclo propan-1,2- diol) trong nước tương, xì dầu, dầu hào.
Quy định này áp dụng đối với các tổ chức, cá nhân sản xuất, chế biến, kinh doanh, nhập khẩu nước tương, xì dầu, dầu hào tại Việt Nam.
Điều 3. Giới hạn tối đa hàm lượng 3-MCPD trong nước tương, xì dầu, dầu hào và phương pháp thử
1.Giới hạn tối đa của Hàm lượng 3-MCPD không vượt quá 1 mg/kg.
2. Phương pháp thử: Xác định 3-MCPD theo 52 TCN – TQTP 0010: 2004 – Thường quy kỹ thuật xác định 3-Monoclo Propan 1,2-Diol (3-MCPD) trong nước chấm có nguồn gốc thực vật.
1.Các tổ chức, cá nhân sản xuất, chế biến, kinh doanh loại sản phẩm nước tương, xì dầu, dầu hào phải tuân theo các tiêu chuẩn, quy định của pháp luật về việc bảo đảm chất lượng, vệ sinh an toàn thực phẩm; và phải bảo đảm hàm lượng 3-MCPD trong sản phẩm theo đúng Quy định này.
2.Các tổ chức, cá nhân nhập khẩu loại sản phẩm này, ngoài việc tuân theo các quy địnhcủa pháo luật Việt Nam còn phải xuất trình các bằng chứng (của nước xuất khẩu) để chứng minh là sản phẩm đó không chứa 3-MCPD vượt quá giới hạn tối đa cho phép theo Quy định này. Trong trường hợp, không có bằng chứng để chứng minh thì các cơ quan chức năng tiến hành lấy mẫu phân tích xác định 3-MCPD, nếu hàm lượng 3- MCPD vượt quá giới hạn cho phép thìkhông cho nhập khẩu lô hàng đó.

DECISION
PROMULGATING “REGULATION ON 3-MCPD CONTENTS IN SOYBEAN SAUCE AND OYSTER SAUCE”
MINISTER OF HEALTH
Pursuant to the Government’s Decree No. 49/2003/ND-CP dated May 15, 2003 defining Functions, Tasks, Powers and Organizational Structure of Ministry of Health;
Pursuant to the Government’s Decree No.163/ND-CP dated September 07, 2004 elaborating certain articles of the Ordinance on Food Safety and Hygiene;
At the request of Directors of the Science and Education Department, and the Legal Department affiliated to Ministry of Health, and Director of Vietnam Food Administration,
HEREBY DECIDES:
Article 1. “Regulation on 3-MCPD contents in soybean sauce and oyster sauce” is enclosed with this Decision.

Article 3. Chief of the Ministry’s Office, Chief Inspector, Directors of the Legal Department, the Science and Education Department, and Vietnam Food Administration affiliated to Ministry of Health, Directors of Departments of Health of provinces or centrally-controlled cities, heads of affiliates of the Ministry of Health, and heads of health agencies affiliated to relevant ministries shall be responsible for implementation of this Decision.

Article 1. Scope
This Regulation stipulates the content of 3-MCPD (3-monoclo propan-1,2- diol) in soybean sauce and oyster sauce.

This Regulation applies to organizations and individuals that produce, process, trade and/or import soybean sauce and oyster sauce in Vietnam.
Article 3. Maximum allowable content of 3-MCPD in soybean sauce and oyster sauce, and test method
1. Maximum allowable content of 3-MCPD is 1 mg/kg.
2. Test method: Determine 3-MCPD content according to 52 TCN – TQTP 0010: 2004 – Common technical regulation for determination of 3-Monoclo Propan 1,2-Diol (3-MCPD) in sauces of plant origin.
Article 4. Requirements to be satisfied by organizations and individuals that produce, process, trade and/or import soybean sauce and oyster sauce
1. Organizations and individuals that produce, process, trade and/or import soybean sauce and oyster sauce must comply with technical standards and regulations on food safety and hygiene, and regulation on 3-MCPD content levels herein.
2. In addition to the compliance with applicable regulations of Vietnam Law, importers of soybean sauce and oyster sauce must also present evidence (originated from export countries) that 3-MCPD content in imported products does not exceed the maximum allowable content prescribed in this Regulation. In case of unavailability of such evidence, regulatory authorities shall take samples to analyze and determine 3-MCPD content in imported products. If analytical result shows that the 3-MCPD content in imported products exceeds the prescribed maximum level, regulatory authorities shall refuse to give approval for such shipment.
