PROMULGATING LIST OF ARDUOUS, HAZARDOUS AND DANGEROUS OCCUPATIONS AND WORKS, AND EXTREMELY ARDUOUS, HAZARDOUS AND DANGEROUS OCCUPATIONS AND WORKS

Pursuant to the Law on occupational safety and hygiene dated June 25, 2015;

Pursuant to the Government’s Decree No. 14/2017/ND-CP dated February 17, 2017 defining the Functions, Tasks, Powers and Organizational Structure of the Ministry of Labour, War Invalids and Social Affairs;

At the request of Director of the Department of Work Safety;

The Minister of Labour, War Invalids and Social Affairs promulgates a Circular promulgating the list of arduous, hazardous and dangerous occupations and works, and extremely arduous, hazardous and dangerous occupations and works.

The list of arduous, hazardous and dangerous occupations and works, and extremely arduous, hazardous and dangerous occupations and works is enclosed with this Circular.

Article 2. Implementation

Supervisory ministries and employers shall annually review and assess the List of arduous, hazardous and dangerous occupations and works, and extremely arduous, hazardous and dangerous occupations and works, according to the methods announced by the Minister of Labor, War Invalids and Social Affairs, and propose necessary amendments thereof in conformity with social, economic, scientific and technological development, and management policies in each period.

1. This Circular comes into force from March 01, 2021.

2. The following Decisions and Circulars will cease to have effect from the effective date of this Circular:

a) Decision No. 1453/LDTBXH-QD dated October 13, 1995 of the Minister of Labor, War Invalids and Social Affairs;

b) Decision No. 915/LDTBXH-QD dated July 30, 1996 of the Minister of Labor, War Invalids and Social Affairs;

3. The period during which an employee has performed the occupation or work on the lists enclosed with the abrogated decisions or circulars in Clause 2 of this Article shall be also considered as the period for performing arduous, hazardous and dangerous occupations or works or extremely arduous, hazardous and dangerous occupations or works by the effective date of this Circular.

4. Difficulties that arise during the implementation of this Circular should be reported to the Ministry of Labour, War Invalids and Social Affairs for consideration./.
