Căn cứ Luật Tổ chức Chính phủ
ngày 25 tháng 12 năm 2001;
Căn cứ Bộ luật Hàng hải Việt Nam ngày 30 tháng 6 năm 1990;
Căn cứ Nghị quyết số 02/2003/NQ-CP ngày 17 tháng 01 năm 2003 của Chính phủ về
một số chủ trương, giải pháp chủ yếu cần tập trung chỉ đạo thực hiện nhiệm vụ
phát triển kinh tế - xã hội năm 2003;
Căn cứ ý kiến của các Bộ, ngành tại cuộc họp ngày 24 tháng 02 năm 2003;
Xét đề nghị của Bộ Giao thông vận tải tại tờ trình số 1754/TTr-BGTVT ngày 29
tháng 4 năm 2003 và ý kiến thẩm định của Bộ Tư pháp tại Công văn số 360/TP-HTQT
ngày 30 tháng 5 năm 2003,
QUYẾT ĐỊNH:
Điều 1. Phạm vi và đối tượng áp dụng
Quyết định này quy định một số chính sách, cơ chế khuyến khích phát triển đội tàu biển quốc gia Việt Nam; đồng thời thúc đẩy việc vận chuyển hàng hóa xuất, nhập khẩu do các doanh nghiệp vận tải biển Việt Nam thực hiện.
Trong Quyết định này, các từ ngữ dưới đây được hiểu như sau:
1. "Doanh nghiệp vận tải biển Việt Nam" là doanh nghiệp được thành lập theo Luật Doanh nghiệp Nhà nước hoặc Luật Doanh nghiệp, có tàu biển được đăng ký treo cờ Việt Nam.
2. "Hàng có nguồn gốc từ ngân sách nhà nước" bao gồm các lô hàng được mua sắm bằng nguồn tài chính từ ngân sách nhà nước, từ tiền vay của Chính phủ, tiền viện trợ của nước ngoài cho Chính phủ hoặc hàng của Chính phủ trả nợ cho nước ngoài.
3. "Hàng tài nguyên quốc gia" là các lô hàng thuộc nguồn tài nguyên khai thác tại Việt Nam bao gồm: dầu thô, than đá, clinke và các loại khoáng sản khác mà các tổ chức, cá nhân được phép kinh doanh xuất khẩu.
4. "Vận chuyển nội địa" là việc vận chuyển hành khách, hàng hoá, vật tư, thiết bị, nguyên, nhiên vật liệu được vận chuyển bằng tàu biển giữa các cảng biển trong phạm vi lãnh thổ Việt Nam.
Điều 3. Một số cơ chế hỗ trợ doanh nghiệp vận tải biển Việt Nam
1. Về vận tải hàng hoá:
a) Đối với hàng hoá xuất, nhập khẩu bằng nguồn tài chính có nguồn gốc từ ngân sách nhà nước, doanh nghiệp vận tải biển Việt Nam được dành quyền vận tải, trừ trường hợp Điều ước quốc tế mà Việt Nam ký kết có quy định khác. Trong trường hợp doanh nghiệp vận tải biển Việt Nam không có khả năng vận chuyển các loại hàng hoá trên thì được sử dụng tàu biển nước ngoài để vận chuyển theo quy định tại Điều 5 của Quyết định này.
b) Đối với hàng hóa vận chuyển nội địa, doanh nghiệp vận tải biển Việt Nam được ưu tiên vận tải, trừ trường hợp Điều ước quốc tế mà Việt Nam ký kết có quy định khác. Trường hợp doanh nghiệp vận tải biển Việt Nam không có khả năng vận chuyển thì được sử dụng tàu biển nước ngoài để vận chuyển theo quy định tại Điều 5 của Quyết định này.
c) Ưu tiên vận tải đối với hàng hóa tài nguyên quốc gia cho doanh nghiệp vận tải biển Việt Nam, trừ trường hợp Điều ước quốc tế mà Việt Nam ký kết có quy định khác.
2. Một số hỗ trợ về tài chính:
a) Đối với tàu thuê theo phương thức thuê tàu trần và thuê tàu định hạn, doanh nghiệp vận tải biển được miễn thuế thu nhập trong thời hạn của hợp đồng.
c) Doanh nghiệp vận tải biển Việt Nam được vay vốn tín dụng ưu đãi từ Quỹ hỗ trợ phát triển để phát triển đội tàu theo quy định hiện hành.
d) Đối với Tổng công ty Hàng hải Việt Nam, ngoài việc được áp dụng các quy định tại các điểm a, b, c trên đây, hàng năm (giai đoạn từ năm 2003 đến hết năm 2005) còn được hưởng một số ưu đãi sau:
Được Quỹ hỗ trợ phát triển bố trí đủ vốn và được giữ lại toàn bộ thuế thu nhập doanh nghiệp hàng năm của các đơn vị thành viên, bao gồm cả phần thuế thu nhập của Tổng công ty Hàng hải Việt Nam trong các công ty liên doanh và công ty cổ phần thuộc Tổng công ty, coi đây là khoản ngân sách cấp bổ sung làm vốn đối ứng để vay vốn Quỹ hỗ trợ phát triển, nhằm thực hiện các hợp đồng với Tổng công ty Công nghiệp tàu thuỷ Việt Nam đóng mới 32 tàu theo kế hoạch đã được Thủ tướng Chính phủ phê duyệt.
3. Trường hợp khả năng của các cơ sở đóng tàu biển trong nước không đáp ứng được nhu cầu hoặc khi Quỹ hỗ trợ phát triển không có khả năng cho vay để thực hiện dự án đóng tàu trong nước thì doanh nghiệp vận tải biển Việt Nam được mua tàu biển của nước ngoài theo quy định hiện hành,
4. Không cấp Giấy phép đầu tư nước ngoài thành lập công ty liên doanh hoặc hợp đồng hợp tác kinh doanh để thực hiện vận tải biển, khi phần góp vốn pháp định của phía Việt Nam dưới 51%, trừ trường hợp Điều ước quốc tế mà Việt Nam ký kết có quy định khác.
5. Doanh nghiệp vận tải biển Việt Nam có trách nhiệm:
a) Sử dụng có hiệu quả các nguồn tài chính tự huy động và nguồn tài chính được vay ưu đãi để thực hiện mục tiêu phát triển đội tàu biển Việt Nam nhằm từng bước tăng thị phần vận tải hàng hoá xuất, nhập khẩu của đội tàu biển Việt Nam.
b) Phải có biện pháp và cam kết thực hiện đầy đủ trách nhiệm của mình theo đúng Hợp đồng đã ký với chủ hàng, theo đúng quy định của pháp luật và thông lệ quốc tế và phải thực hiện mức giá cước mang tính cạnh tranh so với mức bình quân trong khu vực.
1. Chủ hàng của lô hàng hoá xuất, nhập khẩu theo hợp đồng mua FOB hoặc bán CIF (không phân biệt nguồn gốc tài chính), nếu có hợp đồng vận tải với đội tàu biển Việt Nam thì được xem xét giảm thuế xuất khẩu hoặc thuế nhập khẩu. Bộ Tài chính quy định cụ thể vấn đề này.
2. Chủ hàng của lô hàng hoá xuất khẩu có thuế suất hiện hành bằng 0%, nếu có hợp đồng vận tải với đội tàu biển Việt Nam, thì chủ hàng xuất khẩu được xem xét hỗ trợ cước vận chuyển từ Quỹ hỗ trợ xuất khẩu.
Điều 5. Vận chuyển hàng hoá nội địa, hàng có nguồn gốc ngân sách nhà nước bằng tàu biển nước ngoài
Đối với vận chuyển hàng hóa nội địa, hàng có nguồn gốc từ ngân sách nhà nước, khi tàu biển Việt Nam không có khả năng để vận chuyển, Bộ Giao thông vận tải cho phép sử dụng tàu biển nước ngoài theo quy trình sau:
a) Chủ hàng hoặc doanh nghiệp vận tải biển Việt Nam có văn bản đề nghị Bộ Giao thông vận tải, trong đó nêu rõ lý do phải sử dụng tàu biển nước ngoài;
b) Trong thời hạn tối đa 15 ngày kể từ ngày nhận được văn bản đề nghị của chủ hàng hoặc doanh nghiệp vận tải biển Việt Nam, Bộ Giao thông vận tải có văn bản cho phép hoặc không cho phép (phải nêu rõ lý do) việc sử dụng tàu biển nước ngoài thực hiện vận chuyển sau khi tham khảo ý kiến Hiệp hội chủ tàu Việt Nam.
Điều 6. Trách nhiệm của các Bộ, ngành
1. Bộ Giao thông vận tải:
a) Chủ trì, phối hợp với các Bộ, ngành liên quan rà soát và có biện pháp khắc phục, chấn chỉnh các trường hợp vi phạm quy định của Bộ Luật Hàng hải Việt Nam và các quy định hiện hành về vận chuyển hàng hoá bằng đường biển tuyến nội địa.
b) Chủ trì, phối hợp với các Bộ, ngành liên quan rà soát, đề xuất sửa đổi, bổ sung các văn bản quy phạm pháp luật bảo đảm sự đồng bộ và có hiệu lực trong việc khuyến khích phát triển đội tàu Việt Nam nhanh chóng vươn lên chiếm lĩnh thị trường vận chuyển hàng hoá nội địa, hàng hoá xuất khẩu, nhập khẩu trong điều kiện hội nhập kinh tế quốc tế; đồng thời chủ trì, phối hợp với các Bộ, ngành liên quan nghiên cứu các chính sách khuyến khích các doanh nghiệp xuất, nhập khẩu sử dụng dịch vụ vận tải của các doanh nghiệp vận tải biển Việt Nam.
c) Xây dựng và ban hành hoặc trình cơ quan có thẩm quyền ban hành các quy định liên quan tới việc quản lý cước vận tải; giá, phí dịch vụ hàng hải.
d) Chỉ đạo Cục Hàng hải Việt Nam tiến hành thống kê, theo dõi, phát hiện để xử lý kịp thời theo thẩm quyền hoặc báo cáo cấp có thẩm quyền xử lý đối với các trường hợp làm trái các quy định tại Quyết định này.
đ) Chỉ đạo Cục Hàng hải Việt Nam kiểm tra, giám sát các doanh nghiệp vận tải và dịch vụ hàng hải trong việc thực hiện quy định tại các Nghị định của Chính phủ số 57/2001/NĐ-CP ngày 24 tháng 8 năm 2001 về kinh doanh dịch vụ vận tải biển và số 10/2001/NĐ-CP ngày 19 tháng 3 năm 2001 về kinh doanh dịch vụ hàng hải và tại quyết định này nhằm tạo lập trật tự và môi trường kinh doanh lành mạnh, đảm bảo quyền lợi cho các doanh nghiệp vận tải biển Việt Nam và quyền lợi quốc gia trong các lĩnh vực nói trên.
2. Bộ Tài chính:
a) Hướng dẫn và chỉ đạo các cơ quan trực thuộc và hướng dẫn các doanh nghiệp thực hiện quy định tại khoản 1, Điều 4 của Quyết định này.
b) Phối hợp với Bộ Thương mại thực hiện quy định tại khoản 2 Điều 4 của Quyết định này.
c) Phối hợp với Bộ Kế hoạch và Đầu tư, Bộ Giao thông vận tải trong việc thực hiện quy định tại các điểm a, b, c khoản 2 Điều 3 của Quyết định này.
d) Hướng dẫn và chỉ đạo Tổng công ty Hàng hải Việt Nam trong việc quản lý, sử dụng khoản tài chính nêu tại điểm d khoản 2 Điều 3 của Quyết định này đúng mục đích và đảm bảo hiệu quả.
3. Hiệp hội Chủ tàu Việt Nam:
a) Phối hợp với Bộ Giao thông vận tải, Bộ Thương mại và các cơ quan liên quan trong việc cung cấp thông tin thị trường vận tải hàng hóa xuất nhập khẩu cho các doanh nghiệp vận tải biển Việt Nam.
b) Phối hợp với các cơ quan liên quan trợ giúp các doanh nghiệp vận tải biển Việt Nam từng bước nâng cao thị phần vận tải hàng hóa xuất nhập khẩu.
c) Tư vấn cho Bộ Giao thông vận tải trong việc nghiên cứu các chính sách khuyến khích các doanh nghiệp xuất nhập khẩu sử dụng dịch vụ vận tải của các doanh nghiệp vận tải biển Việt Nam.
d) Phối hợp chặt chẽ với Cục Hàng hải Việt Nam và các cơ quan có liên quan trong việc phát hiện các trường hợp làm trái các quy định tại quyết định này và các quy phạm khác có liên quan, báo cáo Cục Hàng hải Việt Nam hoặc cấp có thẩm quyền để có biện pháp xử lý kịp thời theo quy định của pháp luật.
1. Quyết định này có hiệu lực sau 15 ngày, kể từ ngày đăng Công báo.
2. Bộ trưởng các Bộ, Thủ trưởng các cơ quan ngang Bộ, Thủ trưởng cơ quan thuộc Chính phủ, Chủ tịch ủy ban nhân dân các tỉnh, thành phố trực thuộc Trung ương, Cục trưởng Cục Hàng hải Việt Nam, Chủ tịch Hội đồng quản trị và Tổng giám đốc Tổng công ty Hàng hải Việt Nam, các Tổng công ty có liên quan khác và Chủ tịch Hiệp hội chủ tàu Việt Nam chịu trách nhiệm thi hành Quyết định này.

DECISION
ON A NUMBER OF POLICIES AND
MECHANISMS TO ENCOURAGE THE DEVELOPMENT OF VIETNAM’S SEA-GOING FLEET
THE PRIME MINISTER
Pursuant to the
December 25, 2001 Law on Organization of the Government;
Pursuant to the Vietnam Maritime Code of June 30, 1990;
Pursuant to the Government's Resolution No. 02/2003/NQ-CP of January 17, 2003
on a number of major undertakings and solutions for the performance of the 2003
socio-economic development tasks, which require concentrated direction;
Proceeding from the comments of the ministries and branches at the February 24,
2003 meeting;
At the proposal of the Ministry of Communications and Transport in Report No.
1754/TTr-BGTVT of April 29, 2003 and the Justice Ministry's evaluation comments
in Official Dispatch No. 360/TP-HTQT of May 30, 2003,
DECIDES:
Article 1.- Scope and objects
of application
This Decision
prescribes a number of policies and mechanisms to encourage the development of
Vietnam's sea-going fleet, and at the same time promote the transportation of
import and export goods by Vietnamese shipping enterprises.
Article 2.-
Interpretation of terms

1. "Vietnamese
shipping enterprises" mean enterprises set up under the State Enterprise
Law or the Enterprise Law, which have sea-going ships registered to fly the
Vietnamese flag.
2. "Goods
originating from the State budget" mean the goods lots procured by
financial sources originating from the State budget, the Government's loans,
foreign aid provided to the Government, or the Government's goods as debt
repayment to foreign countries.
3. "Goods being
national natural resources" mean the goods lots belonging to the natural
resources exploited in Vietnam, including crude oil, pit-coal, clinker and
other minerals which organizations and individuals are permitted to export.
4. "Domestic
transportation" means the transportation of passengers, cargo, supplies,
equipment, raw materials, fuel and materials by sea-going ships between
seaports within the Vietnamese territory.
Article 3.- A
number of mechanisms to support Vietnamese shipping enterprises
1. Regarding cargo
transportation:
a/ For export and
import goods with financial sources originating from the State budget,
Vietnamese shipping enterprises shall gain the right to transport them, except
otherwise provided for by the international treaties which Vietnam has signed.
In cases where Vietnamese shipping enterprises are incapable of transporting
the above-said goods, they may use foreign sea-going ships to transport them
according to the provisions in Article 5 of this Decision.
b/ For domestically
transported goods, Vietnamese shipping enterprises shall be given priority to
transport them, except otherwise provided for by the international treaties
which Vietnam has signed. In cases where Vietnamese shipping enterprises are
incapable of transporting such goods, they may use foreign sea-going ships to
transport them according to the provisions in Article 5 of this Decision.
c/ Vietnamese shipping
enterprises shall be prioritized to transport goods being national natural
resources, except otherwise provided for by the international treaties which
Vietnam has signed.

a/ For ships hired by
mode of bareboat charter and time charter, shipping enterprises shall be exempt
from income tax within the contracts' terms.
b/ For ships
loan-purchased or hire-purchased, shipping enterprises shall be exempt from
income tax for the first 02 years after taxable incomes are generated and
entitled to 50% reduction of the payable tax amount for the 02 subsequent
years.
c/ Vietnamese shipping
enterprises shall be entitled to borrow preferential credits from the
Development Assistance Fund in order to develop their flotilas fleet according
to the current regulations.
d/ For Vietnam
National Shipping Lines (VINALINES), apart from the application of the
provisions at Points a, b and c above, annually (in the period from 2003 till
the end of 2005), it shall also be entitled to the following preferences:
It shall be
apportioned with adequate capital by the Development Assistance Fund and may
retain the whole amount of annual enterprise income tax of its member units,
including VINALINES' income tax amounts in joint-venture companies and
joint-stock companies attached to it, which shall be considered the additional
budget allocation for use as reciprocal capital for borrowing capital from the
Development Assistance Fund in order to perform contracts signed with Vietnam
Shipbuilding Corporation for the building of 32 new ships according to the plan
already approved by the Prime Minister.
3. In cases where
domestic shipyards are incapable of meeting the demands, or when the
Development Assistance Fund is incapable of providing loans for the
implementation of domestic shipbuilding projects, Vietnamese shipping
enterprises may purchase foreign sea-going ships according to the current
regulations.
4. Foreign investment
licenses shall not be granted for the establishment of joint-venture companies
or business cooperation contracts for sea transportation when the Vietnamese
side contributes less than 51% of the legal capital, except otherwise provided
for by the international treaties which Vietnam has signed.
5. Vietnamese shipping
enterprises shall have the responsibilities:
a/ To efficiently use
self-mobilized financial sources and financial sources provided as preferential
loans in order to attain the objectives of developing Vietnam's sea-going fleet
with a view to step by step increasing the Vietnamese sea-going fleet's market
share for transportation of import and export goods.

Article 4.- A number of
financial supports for goods owners using sea-going ships of Vietnamese
shipping enterprises
1. Owners of the goods
lots imported and exported under FOB purchase or CIF sale contracts (regardless
of their financial origins), that sign transportation contracts with Vietnam's
sea-going fleet, shall be considered for the reduction of export tax or import
tax. The Ministry of Finance shall specify this matter.
2. Owners of the
export goods lots currently eligible for 0% tax rate, that sign transportation
contracts with Vietnam's sea-going fleet, shall be considered for freight
support from the Export Support Fund.
Article 5.-
Transportation of domestic goods and goods originating from the State budget by
foreign sea-going ships
For the transportation
of domestic goods and goods originating from the State budget, when Vietnamese
sea-going ships are incapable of transporting them, the Ministry of
Communications and Transport shall permit the use of foreign sea-going ships according
to the following process:
a/ Goods owners or
Vietnamese shipping enterprises shall send their written requests to the
Ministry of Communications and Transport, clearly stating the reasons for the
use of foreign sea-going ships;
b/ Within 15 days after
receiving the written requests from the goods owners or Vietnamese shipping
enterprises, the Ministry of Communications and Transport shall issue
documents, permitting or not permitting (clearly stating reasons therefor) the
use of foreign sea-going ships for the transportation after consulting with
Vietnam Ship Owners' Association.
Article 6.-
Responsibilities of the ministries and branches
1. The Ministry of
Communications and Transport:

b/ To assume the prime
responsibility and coordinate with the concerned ministries and branches in
reviewing and proposing the amendment and/or supplementation of legal
documents, ensuring the synchronism and effectiveness in encouraging Vietnam's
fleet to develop and quickly occupy market for transportation of domestic,
import and export goods under the conditions of international economic
integration; and at the same time assume the prime responsibility and
coordinate with the concerned ministries and branches in studying policies to
encourage the importing and exporting enterprises to use transportation
services provided by Vietnamese shipping enterprises.
c/ To elaborate and
promulgate or submit to competent agencies for promulgation the regulations
related to the management of freights as well as maritime service prices and
charges.
d/ To direct Vietnam
National Maritime Bureau to make statistics, monitor and detect for timely
handling according its competence or report to competent authorities for
handling the cases of contravening the provisions in this Decision.
e/ To direct Vietnam
National Maritime Bureau to examine and supervise maritime transportation and
service enterprises in the implementation of the provisions in the Government's
Decrees No. 57/2001/ND-CP of August 24, 2001 on sea shipping service business
and No. 10/2001/ND-CP of March 19, 2001 on maritime service business, and those
in this Decision, in order to establish order and a healthy business
environment, ensuring the interests of Vietnamese shipping enterprises and the
national interests in the above-said domains.
2. The Ministry of
Finance:
a/ To guide and direct
its attached agencies and guide enterprises in implementing the regulations in
Clause 1, Article 4 of this Decision.
b/ To coordinate with
the Ministry of Trade in implementing the regulations in Clause 2, Article 4 of
this Decision.
c/ To coordinate with
the Ministry of Planning and Investment and the Ministry of Communications and
Transport in implementing the regulations at Points a, b and c, Clause 2,
Article 3 of this Decision.
d/ To guide and direct
Vietnam National Shipping Lines in managing and using efficiently the financial
amounts mentioned at Point d, Clause 2, Article 3 of this Decision for the
right purposes.

a/ To coordinate with
the Ministry of Communications and Transport, the Ministry of Trade and
relevant agencies in providing information on import/export goods
transportation market for Vietnamese shipping enterprises.
b/ To coordinate with the
concerned agencies in assisting Vietnamese shipping enterprises to step by step
increase the market share for import/export goods transportation.
c/ To advise the
Ministry of Communications and Transport on studying policies to encourage the
importing and exporting enterprises to use the transportation services provided
by Vietnamese shipping enterprises.
d/ To closely
coordinate with Vietnam National Maritime Bureau and relevant agencies in
detecting cases of contravening the regulations in this Decision and other
relevant regulations, report such to Vietnam National Maritime Bureau or
competent authorities for timely handling measures according to law provisions.
Article 7.-
Implementation provisions
1. This Decision takes
effect 15 days after its publication in the Official Gazette.
2. The ministers, the
heads of the ministerial-level agencies, the heads of the agencies attached to
the Government, the presidents of the People's Committees of the provinces and
centrally-run cities, the Director of Vietnam National Maritime Bureau, the
Chairman of the Managing Board and the General Director of Vietnam National
Shipping Lines, other relevant corporations and the Chairman of Vietnam Ship
Owners' Association shall have to implement this Decision.
