Quy định mới về cán bộ, công chức cấp xã từ ngày 01/8/2023

Ngày 10/6/2023, Chính phủ ban hành Nghị định 33/2023/NĐ-CP quy định về cán bộ, công chức cấp xã và người hoạt động không chuyên trách ở cấp xã, ở thôn, tổ dân phố với nhiều nội dung đáng chú ý, đơn cử như sau:

Quy định về số lượng cán bộ, công chức cấp xã

Số lượng cán bộ, công chức cấp xã được tính theo loại đơn vị hành chính cấp xã, cụ thể như sau:

- Đối với phường:

+ Loại I là 23 người;

+ Loại II là 21 người;

+ Loại III là 19 người;

- Đối với xã, thị trấn:

+ Loại I là 22 người;

+ Loại II là 20 người;

+ Loại III là 18 người.

(Hiện hành quy định số lượng cán bộ, công chức cấp xã được bố trí theo Quyết định phân loại đơn vị hành chính xã, phường, thị trấn, cụ thể như sau: Loại 1: tối đa 23 người; Loại 2: tối đa 21 người; Loại 3: tối đa 19 người).

Chức vụ, chức danh của cán bộ, công chức cấp xã

(1) Cán bộ cấp xã có các chức vụ sau đây:

- Bí thư, Phó Bí thư Đảng ủy;

- Chủ tịch, Phó Chủ tịch Hội đồng nhân dân;

- Chủ tịch, Phó Chủ tịch Ủy ban nhân dân;

- Chủ tịch Ủy ban Mặt trận Tổ quốc Việt Nam;

- Bí thư Đoàn Thanh niên Cộng sản Hồ Chí Minh;

- Chủ tịch Hội Liên hiệp Phụ nữ Việt Nam;

- Chủ tịch Hội Nông dân Việt Nam (áp dụng đối với xã, phường, thị trấn có hoạt động nông, lâm, ngư, diêm nghiệp và có tổ chức Hội Nông dân Việt Nam);

- Chủ tịch Hội Cựu chiến binh Việt Nam.

(2) Công chức cấp xã có các chức danh sau đây:

- Chỉ huy trưởng Ban Chỉ huy Quân sự;

- Văn phòng - thống kê;

- Địa chính - xây dựng - đô thị và môi trường (đối với phường, thị trấn) hoặc địa chính - nông nghiệp - xây dựng và môi trường (đối với xã);

- Tài chính - kế toán;

- Tư pháp - hộ tịch;

- Văn hóa - xã hội.

Như vậy, so với quy định hiện hành tại Nghị định 92/2009/NĐ-CP thì công chức cấp xã sẽ không còn chức danh "Trưởng Công an".

NGHỊ ĐỊNH

QUY ĐỊNH VỀ CÁN BỘ, CÔNG CHỨC CẤP XÃ VÀ NGƯỜI HOẠT ĐỘNG KHÔNG CHUYÊN TRÁCH Ở CẤP XÃ, Ở THÔN, TỔ DÂN PHỐ

Căn cứ Luật Tổ chức Chính phủ ngày 19 tháng 6 năm 2015;

Căn cứ Luật Tổ chức chính quyền địa phương ngày 19 tháng 6 năm 2015;

Căn cứ Luật sửa đổi, bổ sung một số điều của Luật Tổ chức Chính phủ và Luật Tổ chức chính quyền địa phương ngày 22 tháng 11 năm 2019;

Căn cứ Luật Cán bộ, công chức ngày 13 tháng 11 năm 2008;

Căn cứ Luật sửa đổi, bổ sung một số điều của Luật Cán bộ, công chức và Luật Viên chức ngày 25 tháng 11 năm 2019;

Căn cứ Luật Dân quân tự vệ ngày 22 tháng 11 năm 2019;

Căn cứ Luật Bảo hiểm xã hội ngày 20 tháng 11 năm 2014;

Căn cứ Luật Bảo hiểm y tế ngày 14 tháng 11 năm 2008;

Căn cứ Luật sửa đổi, bổ sung một số điều của Luật Bảo hiểm y tế ngày 13 tháng 6 năm 2014;

Căn cứ Luật Hộ tịch ngày 20 tháng 11 năm 2014;

Căn cứ Luật Kế toán ngày 20 tháng 11 năm 2015;

Theo đề nghị của Bộ trưởng Bộ Nội vụ;

Chính phủ ban hành Nghị định quy định về cán bộ, công chức cấp xã và người hoạt động không chuyên trách ở cấp xã, ở thôn, tổ dân phố.

Chương I

QUY ĐỊNH CHUNG

Điều 1. Phạm vi điều chỉnh

Nghị định này quy định về chức vụ, chức danh, số lượng, tiêu chuẩn, nhiệm vụ, chế độ, chính sách; bầu cử, tuyển dụng, sử dụng và quản lý đối với cán bộ, công chức ở xã, phường, thị trấn (sau đây gọi chung là cấp xã) và người hoạt động không chuyên trách ở cấp xã, ở thôn, tổ dân phố.

Điều 2. Đối tượng áp dụng

1. Cán bộ, công chức cấp xã quy định tại khoản 3 Điều 4 và Điều 61 Luật Cán bộ, công chức năm 2008 (sửa đổi, bổ sung năm 2019).

2. Người hoạt động không chuyên trách ở cấp xã, ở thôn, tổ dân phố.

Điều 3. Nguyên tắc quản lý cán bộ, công chức cấp xã và người hoạt động không chuyên trách ở cấp xã, ở thôn, tổ dân phố

1. Bảo đảm sự lãnh đạo thống nhất của cấp ủy đảng.

2. Bảo đảm nguyên tắc tập trung dân chủ và phát huy vai trò, trách nhiệm của người đứng đầu cơ quan, tổ chức, đơn vị.

3. Kết hợp giữa tiêu chuẩn chức vụ, chức danh, số lượng và vị trí việc làm của cán bộ, công chức cấp xã; số lượng và chức danh người hoạt động không chuyên trách ở cấp xã, ở thôn, tổ dân phố.

Điều 4. Trách nhiệm của cán bộ, công chức cấp xã và người hoạt động không chuyên trách ở cấp xã, ở thôn, tổ dân phố

Cán bộ, công chức cấp xã và người hoạt động không chuyên trách ở cấp xã, ở thôn, tổ dân phố có trách nhiệm thực hiện các quy định tại Nghị định này, điều lệ tổ chức và quy định của pháp luật có liên quan.

Chương II

CÁN BỘ, CÔNG CHỨC CẤP XÃ

Mục 1. CHỨC VỤ, CHỨC DANH, SỐ LƯỢNG CÁN BỘ, CÔNG CHỨC CẤP XÃ

Điều 5. Chức vụ, chức danh

1. Cán bộ cấp xã quy định tại khoản 1 Điều 2 Nghị định này có các chức vụ sau đây:

a) Bí thư, Phó Bí thư Đảng ủy;

b) Chủ tịch, Phó Chủ tịch Hội đồng nhân dân;

c) Chủ tịch, Phó Chủ tịch Ủy ban nhân dân;

d) Chủ tịch Ủy ban Mặt trận Tổ quốc Việt Nam;

đ) Bí thư Đoàn Thanh niên Cộng sản Hồ Chí Minh;

e) Chủ tịch Hội Liên hiệp Phụ nữ Việt Nam;

g) Chủ tịch Hội Nông dân Việt Nam (áp dụng đối với xã, phường, thị trấn có hoạt động nông, lâm, ngư, diêm nghiệp và có tổ chức Hội Nông dân Việt Nam);

h) Chủ tịch Hội Cựu chiến binh Việt Nam.

2. Công chức cấp xã quy định tại khoản 1 Điều 2 Nghị định này có các chức danh sau đây:

a) Chỉ huy trưởng Ban Chỉ huy Quân sự;

b) Văn phòng - thống kê;

c) Địa chính - xây dựng - đô thị và môi trường (đối với phường, thị trấn) hoặc địa chính - nông nghiệp - xây dựng và môi trường (đối với xã);

d) Tài chính - kế toán;

đ) Tư pháp - hộ tịch;

e) Văn hóa - xã hội.

Điều 6. Số lượng cán bộ, công chức cấp xã

1. Số lượng cán bộ, công chức cấp xã được tính theo loại đơn vị hành chính cấp xã, cụ thể như sau:

a) Đối với phường: Loại I là 23 người; loại II là 21 người; loại III là 19 người;

b) Đối với xã, thị trấn: Loại I là 22 người; loại II là 20 người; loại III là 18 người.

2. Ủy ban nhân dân cấp tỉnh căn cứ số lượng đơn vị hành chính cấp xã có quy mô dân số, diện tích tự nhiên lớn hơn so với tiêu chuẩn quy định tại Nghị quyết của Ủy ban Thường vụ Quốc hội về tiêu chuẩn của đơn vị hành chính và phân loại đơn vị hành chính để tính số lượng công chức ở cấp xã tăng thêm như sau:

a) Phường thuộc quận cứ tăng thêm đủ 1/3 (một phần ba) mức quy định về quy mô dân số thì được tăng thêm 01 công chức. Các đơn vị hành chính cấp xã còn lại cứ tăng thêm đủ 1/2 (một phần hai) mức quy định về quy mô dân số thì được tăng thêm 01 công chức;

b) Ngoài việc tăng thêm công chức theo quy mô dân số quy định tại điểm a khoản này thì đơn vị hành chính cấp xã cứ tăng thêm đủ 100% mức quy định về diện tích tự nhiên được tăng thêm 01 công chức.

3. Quy mô dân số (bao gồm dân số thường trú và dân số tạm trú quy đổi) và diện tích tự nhiên tính đến ngày 31 tháng 12 hàng năm để xác định số lượng cán bộ, công chức cấp xã quy định tại khoản 2 Điều này thực hiện theo Nghị quyết của Ủy ban Thường vụ Quốc hội về tiêu chuẩn của đơn vị hành chính và phân loại đơn vị hành chính.

Trường hợp ở đơn vị hành chính cấp xã tính đến ngày 31 tháng 12 hàng năm có thay đổi về quy mô dân số, diện tích tự nhiên quy định tại khoản 2 Điều này hoặc có thay đổi về loại đơn vị hành chính thì Ủy ban nhân dân cấp tỉnh trình Hội đồng nhân dân cùng cấp xem xét, điều chỉnh tổng số lượng cán bộ, công chức cấp xã (tính cho cả đơn vị hành chính cấp tỉnh) bảo đảm theo đúng quy định.

4. Hàng năm, Ủy ban nhân dân cấp tỉnh trình Hội đồng nhân dân cùng cấp quyết định số lượng cán bộ, công chức cấp xã đối với từng đơn vị hành chính cấp huyện thuộc phạm vi quản lý cho phù hợp với yêu cầu của thực tiễn, nhưng phải bảo đảm tổng số lượng cán bộ, công chức cấp xã thuộc các đơn vị hành chính cấp huyện không vượt quá tổng số lượng cán bộ, công chức cấp xã tính cho cả đơn vị hành chính cấp tỉnh theo quy định tại các khoản 1, 2 Điều này.

5. Hàng năm, Ủy ban nhân dân cấp huyện quyết định số lượng cụ thể cán bộ, công chức ở từng đơn vị hành chính cấp xã và bố trí số lượng công chức của từng chức danh công chức cấp xã thuộc phạm vi quản lý cho phù hợp với yêu cầu, nhiệm vụ của từng đơn vị hành chính cấp xã. Số lượng cán bộ, công chức ở từng đơn vị hành chính cấp xã có thể thấp hơn mức của cấp xã loại III hoặc có thể cao hơn mức của cấp xã loại I tại khoản 1 Điều này, nhưng phải bảo đảm không vượt quá tổng số lượng cán bộ, công chức cấp xã của cả đơn vị hành chính cấp huyện được Hội đồng nhân dân cấp tỉnh giao.

6. Số lượng cán bộ, công chức cấp xã quy định tại Điều này bao gồm cả người đang hưởng chế độ hưu trí hoặc trợ cấp mất sức lao động được bầu giữ chức vụ cán bộ cấp xã và cán bộ, công chức được luân chuyển, điều động, biệt phái về cấp xã.

Trường hợp luân chuyển về đảm nhiệm chức vụ Phó Chủ tịch Ủy ban nhân dân cấp xã thì thực hiện theo quy định của Chính phủ về số lượng Phó Chủ tịch Ủy ban nhân dân và quy trình, thủ tục bầu, từ chức, miễn nhiệm, bãi nhiệm, điều động, cách chức thành viên Ủy ban nhân dân.

Mục 2. TIÊU CHUẨN, NHIỆM VỤ CỦA CÁN BỘ, CÔNG CHỨC CẤP XÃ

Điều 7. Tiêu chuẩn chung của cán bộ, công chức cấp xã

1. Tiêu chuẩn chung đối với cán bộ, công chức cấp xã thực hiện theo quy định hiện hành của pháp luật về cán bộ, công chức, điều lệ tổ chức và quy định của Đảng, của tổ chức chính trị - xã hội ở trung ương.

2. Đối với công chức là Chỉ huy trưởng Ban Chỉ huy Quân sự cấp xã, ngoài các tiêu chuẩn quy định tại khoản 1 Điều này còn phải có khả năng phối hợp với các đơn vị quân đội nhân dân, công an nhân dân và lực lượng khác trên địa bàn tham gia xây dựng nền quốc phòng toàn dân, thực hiện nhiệm vụ phòng thủ dân sự; giữ gìn an ninh, chính trị, trật tự an toàn xã hội, bảo vệ Đảng, chính quyền, tài sản của Nhà nước và bảo vệ tính mạng, tài sản của Nhân dân.

Điều 8. Tiêu chuẩn của từng chức vụ cán bộ cấp xã

1. Bí thư, Phó Bí thư Đảng ủy:

a) Độ tuổi: Khi tham gia giữ chức vụ lần đầu phải đủ tuổi công tác ít nhất trọn 01 nhiệm kỳ (60 tháng), trường hợp đặc biệt theo quyết định của cơ quan có thẩm quyền quản lý cán bộ;

b) Trình độ giáo dục phổ thông: Tốt nghiệp trung học phổ thông;

c) Trình độ chuyên môn, nghiệp vụ: Tốt nghiệp đại học trở lên. Trường hợp Điều lệ Đảng có quy định khác với quy định tại Nghị định này thì thực hiện theo quy định của Điều lệ Đảng;

d) Trình độ lý luận chính trị: Tốt nghiệp trung cấp hoặc tương đương trở lên. Trường hợp Điều lệ Đảng có quy định khác với quy định tại Nghị định này thì thực hiện theo quy định của Điều lệ Đảng;

đ) Các tiêu chuẩn khác theo quy định của Đảng và cơ quan có thẩm quyền quản lý cán bộ.

2. Chủ tịch Ủy ban Mặt trận Tổ quốc Việt Nam, Bí thư Đoàn Thanh niên Cộng sản Hồ Chí Minh, Chủ tịch Hội Liên hiệp Phụ nữ Việt Nam, Chủ tịch Hội Nông dân Việt Nam, Chủ tịch Hội Cựu chiến binh Việt Nam cấp xã:

a) Độ tuổi: Theo quy định của luật, điều lệ tổ chức và quy định của tổ chức chính trị - xã hội ở trung ương.

b) Trình độ giáo dục phổ thông: Tốt nghiệp trung học phổ thông;

c) Trình độ chuyên môn, nghiệp vụ: Tốt nghiệp đại học trở lên. Trường hợp luật, điều lệ tổ chức có quy định khác với quy định tại Nghị định này thì thực hiện theo quy định của luật, điều lệ đó;

d) Trình độ lý luận chính trị: Tốt nghiệp trung cấp hoặc tương đương trở lên. Trường hợp luật, điều lệ tổ chức có quy định khác với quy định tại Nghị định này thì thực hiện theo quy định của luật, điều lệ đó;

đ) Các tiêu chuẩn khác theo quy định của Đảng, của tổ chức chính trị - xã hội ở trung ương và cơ quan có thẩm quyền quản lý cán bộ.

3. Chủ tịch, Phó Chủ tịch Hội đồng nhân dân; Chủ tịch, Phó Chủ tịch Ủy ban nhân dân:

a) Độ tuổi: Khi tham gia giữ chức vụ lần đầu phải đủ tuổi công tác ít nhất trọn 01 nhiệm kỳ (60 tháng), trường hợp đặc biệt theo quyết định của cơ quan có thẩm quyền quản lý cán bộ;

b) Trình độ giáo dục phổ thông: Tốt nghiệp trung học phổ thông;

c) Trình độ chuyên môn, nghiệp vụ: Tốt nghiệp đại học trở lên. Trường hợp luật có quy định khác với quy định tại Nghị định này thì thực hiện theo quy định của luật đó;

d) Trình độ lý luận chính trị: Tốt nghiệp trung cấp hoặc tương đương trở lên;

đ) Các tiêu chuẩn khác theo quy định của Luật Tổ chức chính quyền địa phương, của pháp luật có liên quan, quy định của Đảng và cơ quan có thẩm quyền quản lý cán bộ.

4. Ủy ban nhân dân cấp tỉnh quy định cụ thể tiêu chuẩn trình độ chuyên môn, nghiệp vụ từ trung cấp trở lên đối với cán bộ cấp xã làm việc tại các xã, phường, thị trấn thuộc địa bàn miền núi, vùng cao, biên giới, hải đảo, xã đảo, vùng sâu, vùng xa, vùng đồng bào dân tộc thiểu số và vùng có điều kiện kinh tế - xã hội đặc biệt khó khăn.

5. Căn cứ tiêu chuẩn của từng chức vụ cán bộ cấp xã quy định tại Điều này, Ủy ban nhân dân cấp tỉnh quy định tiêu chuẩn cụ thể của từng chức vụ cán bộ cấp xã cho phù hợp với đặc điểm và yêu cầu thực hiện nhiệm vụ của từng cấp xã nhưng phải bảo đảm không thấp hơn tiêu chuẩn quy định tại Nghị định này.

Điều 9. Nhiệm vụ của từng chức vụ cán bộ cấp xã

1. Bí thư Đảng ủy cấp xã

Lãnh đạo, chỉ đạo việc thực hiện chức năng, nhiệm vụ của Đảng bộ; cùng tập thể Đảng ủy, Ban Thường vụ Đảng ủy lãnh đạo toàn diện đối với hệ thống chính trị ở cơ sở trong việc thực hiện đường lối, chủ trương, chính sách của Đảng, quy định của pháp luật trên địa bàn cấp xã và thực hiện các nhiệm vụ sau:

a) Chủ trì chỉ đạo việc xây dựng quy chế làm việc, nội dung, kế hoạch công tác năm, quý, tháng của Ban Chấp hành, Ban Thường vụ;

b) Phân công công việc các ủy viên Ban Chấp hành, Ban Thường vụ;

c) Chỉ đạo việc xây dựng và phê duyệt kế hoạch công tác năm, quý, tháng và các nhiệm vụ thường xuyên của các ủy viên Ban Chấp hành, Ban Thường vụ;

d) Kiểm tra, đôn đốc, điều phối hoạt động của các ủy viên Ban Chấp hành, Ban Thường vụ trong việc thực hiện chương trình, kế hoạch công tác;

đ) Theo dõi, đánh giá việc thực hiện kế hoạch công tác của từng ủy viên Ban Chấp hành, Ban Thường vụ;

e) Trực tiếp chỉ đạo thực hiện các nghị quyết, kết luận của Ban Chấp hành, Ban Thường vụ và các chỉ thị, nghị quyết của Đảng, của cấp trên;

g) Ký các văn bản theo quy chế làm việc của Ban Chấp hành, Ban Thường vụ;

h) Định kỳ hoặc đột xuất báo cáo tình hình hoạt động của Ban Chấp hành, Ban Thường vụ với cơ quan Đảng cấp trên;

i) Chỉ đạo việc sơ kết, tổng kết công tác hàng năm, 6 tháng, quý, tháng, tuần theo quy định;

k) Là đại diện của Ban Chấp hành, Ban Thường vụ Đảng ủy trong mối quan hệ công tác với các cơ quan ở cấp xã và cấp trên; ủy quyền công việc cho Phó Bí thư thực hiện các nhiệm vụ khi vắng mặt tại cơ quan theo quy chế làm việc;

l) Chịu trách nhiệm về việc sử dụng tài chính, tài sản được cấp có thẩm quyền giao cho Đảng ủy cấp xã theo quy định;

m) Triệu tập và chủ tọa các Hội nghị, cuộc họp định kỳ, đột xuất;

n) Các nhiệm vụ khác theo quy định của Đảng, của pháp luật có liên quan và cơ quan có thẩm quyền quản lý cán bộ.

2. Phó Bí thư Đảng ủy cấp xã

a) Thực hiện các nhiệm vụ theo phân công của Ban Chấp hành, Ban Thường vụ và của Bí thư Đảng ủy cấp xã;

b) Giúp Bí thư Đảng ủy cấp xã chỉ đạo hoạt động của Đảng ủy cấp xã trong phạm vi được phân công; ký các văn bản khi được phân công; giải quyết các công việc của Đảng ủy cấp xã khi được Bí thư Đảng ủy cấp xã ủy nhiệm;

c) Chủ trì hoặc tham gia các hội nghị, cuộc họp khi được Bí thư Đảng ủy phân công; triệu tập và chủ tọa các cuộc họp định kỳ, đột xuất theo phân công của Bí thư Đảng ủy cấp xã hoặc theo quy định tại quy chế làm việc của Ban Chấp hành, Ban Thường vụ;

d) Trực tiếp thực hiện các ý kiến chỉ đạo khác của Bí thư Đảng ủy hoặc theo quy định tại quy chế làm việc của Ban Chấp hành, Ban Thường vụ;

đ) Các nhiệm vụ khác theo quy định của Đảng, của pháp luật có liên quan và cơ quan có thẩm quyền quản lý cán bộ.

3. Chủ tịch Hội đồng nhân dân cấp xã

Lãnh đạo, chỉ đạo hoạt động của Thường trực Hội đồng nhân dân, các Ban của Hội đồng nhân dân cấp xã. Thay mặt Thường trực Hội đồng nhân dân cấp xã giữ mối liên hệ với Ủy ban nhân dân, các cơ quan nhà nước, Ban Thường trực Ủy ban Mặt trận Tổ quốc Việt Nam, các tổ chức thành viên của Mặt trận Tổ Quốc Việt Nam cùng cấp, các tổ chức xã hội khác và công dân. Thực hiện các nhiệm vụ, quyền hạn theo quy định của pháp luật, quy chế làm việc của Hội đồng nhân dân và các nhiệm vụ sau:

a) Chủ trì xây dựng quy chế làm việc, nội dung, kế hoạch công tác hàng năm, quý, tháng của Hội đồng nhân dân cấp xã;

b) Phân công công việc trong Thường trực Hội đồng nhân dân cấp xã;

c) Chỉ đạo xây dựng và phê duyệt kế hoạch công tác năm, quý, tháng của Thường trực Hội đồng nhân dân và các Ban của Hội đồng nhân dân cấp xã;

d) Kiểm tra, đôn đốc, điều phối hoạt động của các thành viên Thường trực Hội đồng nhân dân cấp xã trong việc thực hiện chương trình, kế hoạch công tác;

đ) Theo dõi, đánh giá việc thực hiện chương trình, kế hoạch công tác của từng thành viên Thường trực Hội đồng nhân dân cấp xã;

e) Trực tiếp chỉ đạo việc thực hiện các nghị quyết, kết luận của Thường trực Hội đồng nhân dân cấp xã và các cơ quan nhà nước cấp trên;

g) Ký các văn bản theo quy định và theo quy chế làm việc của Hội đồng nhân dân cấp xã;

h) Định kỳ báo cáo tình hình hoạt động của Hội đồng nhân dân, Thường trực Hội đồng nhân dân cấp xã với cấp trên;

i) Chỉ đạo sơ kết, tổng kết công tác hàng năm, 6 tháng, quý, tháng theo quy định;

k) Là đại diện của Hội đồng nhân dân, Thường trực Hội đồng nhân dân cấp xã trong mối quan hệ công tác với các cơ quan ở cấp xã và cấp trên; ủy nhiệm Phó Chủ tịch Hội đồng nhân dân cấp xã thực hiện các nhiệm vụ khi vắng mặt tại cơ quan theo quy chế làm việc của Hội đồng nhân dân cấp xã;

l) Chịu trách nhiệm về việc sử dụng tài chính, tài sản được cấp có thẩm quyền giao cho Hội đồng nhân dân cấp xã theo quy định;

m) Triệu tập và chủ tọa các kỳ họp, hội nghị, cuộc họp định kỳ, đột xuất;

n) Các nhiệm vụ khác theo quy định của Đảng, của pháp luật có liên quan và cơ quan có thẩm quyền quản lý cán bộ.

4. Phó Chủ tịch Hội đồng nhân dân cấp xã

a) Thực hiện các nhiệm vụ theo phân công của Thường trực Hội đồng nhân dân và của Chủ tịch Hội đồng nhân dân cấp xã;

b) Giúp Chủ tịch Hội đồng nhân dân cấp xã chỉ đạo hoạt động của Thường trực Hội đồng nhân dân và các Ban của Hội đồng nhân dân cấp xã trong phạm vi được phân công; ký các văn bản và giải quyết công việc của Thường trực Hội đồng nhân dân khi được Chủ tịch Hội đồng nhân dân ủy nhiệm;

c) Chủ trì hoặc tham gia các hội nghị, cuộc họp khi được Chủ tịch Hội đồng nhân dân phân công; triệu tập và chủ tọa các cuộc họp định kỳ, đột xuất theo phân công của Thường trực Hội đồng nhân dân cấp xã hoặc theo quy định tại quy chế làm việc của Hội đồng nhân dân cấp xã;

d) Các nhiệm vụ khác theo quy định của Đảng, của pháp luật có liên quan và cơ quan có thẩm quyền quản lý cán bộ.

5. Chủ tịch Ủy ban nhân dân cấp xã

a) Lãnh đạo và điều hành công việc của Ủy ban nhân dân, các thành viên Ủy ban nhân dân cấp xã;

b) Lãnh đạo, chỉ đạo thực hiện các nhiệm vụ về tổ chức và bảo đảm việc thi hành Hiến pháp, pháp luật, các văn bản của cơ quan nhà nước cấp trên, của Hội đồng nhân dân và Ủy ban nhân dân cấp xã; thực hiện các nhiệm vụ về quốc phòng, an ninh, bảo đảm trật tự, an toàn xã hội, đấu tranh, phòng, chống tội phạm và các hành vi vi phạm pháp luật khác; phòng, chống quan liêu, tham nhũng; tổ chức thực hiện các biện pháp bảo vệ tài sản của cơ quan, tổ chức, bảo hộ tính mạng, tự do, danh dự, nhân phẩm, tài sản, các quyền và lợi ích hợp pháp khác của công dân; thực hiện các biện pháp quản lý dân cư trên địa bàn cấp xã theo quy định của pháp luật;

c) Quản lý và tổ chức sử dụng có hiệu quả công sở, tài sản, phương tiện làm việc và ngân sách nhà nước được giao theo quy định của pháp luật;

d) Giải quyết khiếu nại, tố cáo, xử lý vi phạm pháp luật, tiếp công dân theo quy định của pháp luật;

đ) Ủy quyền cho Phó Chủ tịch Ủy ban nhân dân cấp xã thực hiện nhiệm vụ, quyền hạn trong phạm vi thẩm quyền của Chủ tịch Ủy ban nhân dân cấp xã;

e) Chỉ đạo thực hiện các biện pháp bảo vệ môi trường, phòng, chống cháy, nổ; áp dụng các biện pháp để giải quyết các công việc đột xuất, khẩn cấp trong phòng, chống thiên tai, dịch bệnh, an ninh, trật tự, an toàn xã hội trên địa bàn cấp xã theo quy định của pháp luật;

g) Thực hiện nhiệm vụ, quyền hạn do cơ quan nhà nước cấp trên phân cấp, ủy quyền;

h) Các nhiệm vụ khác theo quy định của Đảng, Luật Tổ chức chính quyền địa phương, của pháp luật có liên quan và cơ quan có thẩm quyền quản lý cán bộ.

6. Phó Chủ tịch Ủy ban nhân dân cấp xã

a) Trực tiếp chỉ đạo các lĩnh vực và địa bàn công tác do Chủ tịch Ủy ban nhân dân cấp xã phân công; chủ động xây dựng chương trình, kế hoạch triển khai công việc theo lĩnh vực, địa bàn; được sử dụng quyền hạn của Chủ tịch Ủy ban nhân dân cấp xã khi giải quyết các công việc và ký các văn bản khi được Chủ tịch Ủy ban nhân dân cấp xã ủy quyền;

b) Chịu trách nhiệm cá nhân trước Chủ tịch Ủy ban nhân dân cấp xã về lĩnh vực công tác được giao và về những quyết định chỉ đạo, điều hành của mình; cùng Chủ tịch Ủy ban nhân dân cấp xã và các Ủy viên Ủy ban nhân dân cấp xã chịu trách nhiệm tập thể về toàn bộ hoạt động của Ủy ban nhân dân cấp xã trước Đảng ủy, Hội đồng nhân dân cấp xã và Ủy ban nhân dân, Chủ tịch Ủy ban nhân dân cấp trên. Đối với những vấn đề vượt quá phạm vi thẩm quyền thì Phó Chủ tịch Ủy ban nhân dân cấp xã phải báo cáo Chủ tịch Ủy ban nhân dân cấp xã xem xét, quyết định;

c) Khi giải quyết công việc, nếu có vấn đề liên quan đến phạm vi và trách nhiệm giải quyết công việc của Phó Chủ tịch Ủy ban nhân dân khác thì chủ động trao đổi, phối hợp để thống nhất cách giải quyết; nếu vẫn còn ý kiến khác nhau thì báo cáo Chủ tịch Ủy ban nhân dân cấp xã xem xét, quyết định;

d) Các nhiệm vụ khác theo quy định của Đảng, của pháp luật có liên quan, của cơ quan có thẩm quyền quản lý cán bộ và theo phân công của Chủ tịch Ủy ban nhân dân cấp xã.

7. Chủ tịch Ủy ban Mặt trận Tổ quốc Việt Nam cấp xã

Chủ tịch Ủy ban Mặt trận Tổ quốc Việt Nam cấp xã chỉ đạo và cùng với các thành viên của Ban Thường trực Ủy ban Mặt trận Tổ quốc Việt Nam cấp xã thực hiện các nhiệm vụ sau:

a) Triệu tập và chủ trì các hội nghị, cuộc họp của Ủy ban Mặt trận Tổ quốc Việt Nam cấp xã;

b) Tổ chức thực hiện nghị quyết, chương trình phối hợp và thống nhất hành động hàng năm, sáu tháng của Ủy ban Mặt trận Tổ quốc Việt Nam cấp mình và của Ủy ban Mặt trận Tổ quốc Việt Nam cấp trên; chủ trương, chính sách của Đảng, quy định của pháp luật, nghị quyết của Hội đồng nhân dân, quyết định của Ủy ban nhân dân có liên quan đến nhiệm vụ, quyền hạn của Ủy ban Mặt trận Tổ quốc Việt Nam cấp xã;

c) Thường xuyên tập hợp ý kiến, kiến nghị của cử tri và Nhân dân để phản ánh, kiến nghị với cấp ủy Đảng, chính quyền, Ban Thường trực Ủy ban Mặt trận Tổ quốc Việt Nam cấp trên;

d) Góp ý, kiến nghị với cấp ủy Đảng, chính quyền cùng cấp trong việc thực hiện chính sách, pháp luật tại địa phương; thực hiện các quy định của pháp luật về dân chủ ở cơ sở, đấu tranh chống quan liêu, tham nhũng, lãng phí, tệ nạn xã hội; giám sát hoạt động của cơ quan nhà nước, của cán bộ, công chức theo quy định của Đảng và của pháp luật;

đ) Tổ chức thực hiện các cuộc vận động, các phong trào thi đua yêu nước trong Nhân dân; các nhiệm vụ Mặt trận tham gia xây dựng và củng cố chính quyền; bảo vệ quyền và lợi ích chính đáng của Nhân dân; giám sát hoạt động của cơ quan nhà nước, đại biểu Quốc hội, đại biểu Hội đồng nhân dân các cấp và cán bộ, công chức, viên chức; thực hiện pháp luật về thực hiện dân chủ ở cơ sở; tham gia giải quyết khiếu nại, tố cáo ở địa phương;

e) Chỉ đạo, hướng dẫn hoạt động của Ban Công tác Mặt trận, Ban Thanh tra nhân dân, Ban Giám sát đầu tư của cộng đồng;

g) Giữ mối quan hệ phối hợp công tác với chính quyền và các tổ chức thành viên cùng cấp;

h) Hướng dẫn hoạt động của các tổ chức tư vấn, cộng tác viên của Ủy ban Mặt trận Tổ quốc Việt Nam cấp xã;

i) Chỉ đạo xây dựng, ban hành quyết định, quy chế phối hợp công tác của tổ chức mình và tổ chức thực hiện các văn bản đó;

k) Triệu tập và chủ trì các Hội nghị, cuộc họp của Ủy ban Mặt trận Tổ quốc Việt Nam cấp xã; chỉ đạo việc lập kế hoạch kinh phí, chấp hành, quyết toán kinh phí hoạt động và quyết định việc phân bổ kinh phí hoạt động do Nhà nước cấp đối với tổ chức mình;

l) Xem xét, quyết định khen thưởng, kỷ luật theo thẩm quyền;

m) Các nhiệm vụ khác theo quy định của Đảng, của pháp luật có liên quan, quy định của tổ chức chính trị - xã hội ở trung ương và cơ quan có thẩm quyền quản lý cán bộ.

8. Bí thư Đoàn Thanh niên Cộng sản Hồ Chí Minh cấp xã

Bí thư Đoàn Thanh niên Cộng sản Hồ Chí Minh cấp xã chỉ đạo và cùng với các ủy viên Ban Chấp hành, Ban Thường vụ Đoàn Thanh niên Cộng sản Hồ Chí Minh cấp xã thực hiện các nhiệm vụ sau:

a) Chỉ đạo xây dựng Quy chế hoạt động của Ban Chấp hành, Ban Thường vụ tổ chức mình; chương trình kế hoạch công tác, hướng dẫn hoạt động đối với các tổ chức cơ sở đoàn trực thuộc Đoàn cấp xã;

b) Phối hợp với chính quyền địa phương cấp xã, các tổ chức chính trị - xã hội cùng cấp vận động, hướng dẫn cán bộ, đoàn viên tổ chức mình tham gia thực hiện các chương trình kinh tế - xã hội, quốc phòng - an ninh và các phong trào thi đua của tổ chức mình theo chương trình, nghị quyết của tổ chức chính trị - xã hội cấp trên đề ra;

c) Góp ý, kiến nghị với cấp ủy Đảng, chính quyền cùng cấp trong việc thực hiện chính sách, pháp luật tại địa phương; thực hiện các quy định của pháp luật về dân chủ ở cơ sở, đấu tranh chống quan liêu, tham nhũng, lãng phí, tệ nạn xã hội; giám sát hoạt động của cơ quan nhà nước, của cán bộ, công chức theo quy định của pháp luật;

d) Tổ chức thực hiện các nghị quyết, kết luận của Đảng, quy định của pháp luật; các nghị quyết đối với đoàn viên của tổ chức mình;

đ) Chuẩn bị nội dung, triệu tập và chủ trì các Hội nghị, cuộc họp của Ban Chấp hành, Ban Thường vụ;

e) Chỉ đạo việc lập kế hoạch kinh phí, chấp hành, quyết toán kinh phí hoạt động và quyết định việc phân bổ kinh phí hoạt động do Nhà nước cấp đối với tổ chức mình;

g) Bám sát hoạt động các phong trào, định kỳ tổ chức kiểm tra, đánh giá và báo cáo với cấp ủy Đảng cùng cấp và Đoàn cấp trên về hoạt động của tổ chức mình;

h) Chỉ đạo hoạt động của Ban Chấp hành, Ban Thường vụ theo đúng quy chế hoạt động đã được ban hành;

i) Các nhiệm vụ khác theo quy định của Đảng, của pháp luật có liên quan, quy định của tổ chức chính trị - xã hội ở trung ương và cơ quan có thẩm quyền quản lý cán bộ.

9. Chủ tịch Hội Liên hiệp Phụ nữ Việt Nam cấp xã

Chủ tịch Hội Liên hiệp Phụ nữ Việt Nam cấp xã chỉ đạo và cùng với các ủy viên Ban Chấp hành, Ban Thường vụ Hội Liên hiệp Phụ nữ Việt Nam cấp xã thực hiện các nhiệm vụ sau:

a) Chỉ đạo xây dựng và tổ chức thực hiện quy chế hoạt động của Ban Chấp hành, Ban Thường vụ tổ chức mình; chương trình, kế hoạch công tác, hướng dẫn hoạt động đối với các chi hội ở thôn, tổ dân phố;

b) Phối hợp với chính quyền địa phương cấp xã, các tổ chức chính trị - xã hội cùng cấp vận động, hướng dẫn cán bộ, hội viên tổ chức mình tham gia thực hiện các chương trình kinh tế - xã hội, quốc phòng - an ninh và các phong trào thi đua của tổ chức mình theo chương trình, nghị quyết của tổ chức chính trị - xã hội cấp trên đề ra;

c) Góp ý, kiến nghị với cấp ủy Đảng, chính quyền cùng cấp trong việc thực hiện chính sách, pháp luật tại địa phương; thực hiện các quy định của pháp luật về dân chủ ở cơ sở, đấu tranh chống quan liêu, tham nhũng, lãng phí, tệ nạn xã hội; giám sát hoạt động của cơ quan nhà nước, của cán bộ, công chức theo quy định của pháp luật;

d) Tổ chức thực hiện các nghị quyết, kết luận của Đảng, quy định của pháp luật; các nghị quyết đối với hội viên của tổ chức mình;

đ) Chuẩn bị nội dung, triệu tập và chủ trì các Hội nghị, cuộc họp của Ban Chấp hành, Ban Thường vụ;

e) Chỉ đạo việc lập kế hoạch kinh phí, chấp hành, quyết toán kinh phí hoạt động và quyết định việc phân bổ kinh phí hoạt động do Nhà nước cấp đối với tổ chức mình;

g) Bám sát hoạt động các phong trào, định kỳ tổ chức kiểm tra, đánh giá và báo cáo với cấp ủy Đảng cùng cấp và Hội Liên hiệp Phụ nữ Việt Nam cấp trên về hoạt động của tổ chức mình;

h) Chỉ đạo hoạt động của Ban Chấp hành, Ban Thường vụ theo đúng quy chế hoạt động đã được ban hành;

i) Các nhiệm vụ khác theo quy định của Đảng, của pháp luật có liên quan, quy định của tổ chức chính trị - xã hội ở trung ương và cơ quan có thẩm quyền quản lý cán bộ.

10. Chủ tịch Hội Nông dân Việt Nam cấp xã

Chủ tịch Hội Nông dân Việt Nam cấp xã chỉ đạo và cùng với các ủy viên Ban Chấp hành, Ban Thường vụ Hội Nông dân Việt Nam cấp xã thực hiện các nhiệm vụ sau:

a) Chỉ đạo xây dựng quy chế hoạt động của Ban Chấp hành, Ban Thường vụ tổ chức mình; chương trình, kế hoạch công tác, hướng dẫn hoạt động đối với các chi hội ở thôn, tổ dân phố;

b) Phối hợp với chính quyền địa phương cấp xã, các tổ chức chính trị - xã hội cùng cấp vận động, hướng dẫn hội viên tổ chức mình tham gia thực hiện các chương trình kinh tế - xã hội, quốc phòng - an ninh và các phong trào thi đua của tổ chức mình theo chương trình, nghị quyết của tổ chức chính trị - xã hội cấp trên đề ra;

c) Góp ý, kiến nghị với cấp ủy Đảng, chính quyền cùng cấp trong việc thực hiện chính sách, pháp luật tại địa phương; thực hiện các quy định của pháp luật về dân chủ ở cơ sở, đấu tranh chống quan liêu, tham nhũng, lãng phí, tệ nạn xã hội; giám sát hoạt động của cơ quan nhà nước, của cán bộ, công chức theo quy định của pháp luật;

d) Tổ chức thực hiện các nghị quyết, kết luận của Đảng, quy định của pháp luật; các nghị quyết đối với hội viên của tổ chức mình;

đ) Triệu tập và chủ trì các Hội nghị, cuộc họp của Ban Chấp hành, Ban Thường vụ;

e) Chỉ đạo việc lập kế hoạch kinh phí, chấp hành, quyết toán kinh phí hoạt động và quyết định việc phân bổ kinh phí hoạt động do Nhà nước cấp đối với tổ chức mình;

g) Bám sát hoạt động các phong trào, định kỳ tổ chức kiểm tra, đánh giá và báo cáo với cấp ủy Đảng cùng cấp và Hội Nông dân Việt Nam cấp trên về hoạt động của tổ chức mình;

h) Chỉ đạo hoạt động của Ban Chấp hành, Ban Thường vụ theo đúng quy chế hoạt động đã được ban hành;

i) Các nhiệm vụ khác theo quy định của Đảng, của pháp luật có liên quan, quy định của tổ chức chính trị - xã hội ở trung ương và cơ quan có thẩm quyền quản lý cán bộ.

11. Chủ tịch Hội Cựu chiến binh Việt Nam cấp xã

Chủ tịch Hội Cựu chiến binh Việt Nam cấp xã chỉ đạo và cùng với các ủy viên Ban Chấp hành, Ban Thường vụ Hội Cựu chiến binh Việt Nam cấp xã thực hiện các nhiệm vụ sau:

a) Chỉ đạo xây dựng quy chế hoạt động của Ban Chấp hành, Ban Thường vụ tổ chức mình; chương trình, kế hoạch công tác, hướng dẫn hoạt động đối với các chi hội ở thôn, tổ dân phố;

b) Tham gia xây dựng và bảo vệ Đảng, chính quyền, chế độ xã hội chủ nghĩa; bảo vệ tính mạng, tài sản của Nhân dân, tài sản của Nhà nước; đấu tranh chống mọi âm mưu, hoạt động phá hoại của các thế lực thù địch; chống các quan điểm sai trái với đường lối, chính sách của Đảng, pháp luật của Nhà nước; thực hiện các quy định của pháp luật về dân chủ ở cơ sở, đấu tranh chống quan liêu, tham nhũng, lãng phí, tệ nạn xã hội; giám sát hoạt động của cơ quan nhà nước, của cán bộ, công chức theo quy định của pháp luật;

c) Tham gia phát triển kinh tế - xã hội, củng cố quốc phòng, an ninh; kiến nghị với cơ quan nhà nước, chính quyền địa phương về xây dựng và tổ chức thực hiện chính sách, pháp luật có liên quan đến Cựu chiến binh, Hội Cựu chiến binh;

d) Tập hợp, đoàn kết, động viên Cựu chiến binh rèn luyện, giữ gìn phẩm chất, đạo đức cách mạng, nâng cao bản lĩnh chính trị, trình độ hiểu biết đường lối, chính sách của Đảng, pháp luật của Nhà nước, kiến thức về kinh tế, văn hóa, khoa học - kỹ thuật, thực hiện tốt nghĩa vụ công dân; tập hợp quân nhân đã hoàn thành nghĩa vụ quân sự tiếp tục phát huy truyền thống “Bộ đội Cụ Hồ”, tham gia tổ chức câu lạc bộ, Ban liên lạc Cựu quân nhân, các phong trào khác ở cơ sở;

đ) Tổ chức chăm lo, giúp đỡ Cựu chiến binh ở địa phương nâng cao đời sống vật chất, tinh thần, phát triển kinh tế gia đình, xóa đói, giảm nghèo, làm giàu hợp pháp; tổ chức các hoạt động tình nghĩa để Cựu chiến binh tương trợ, giúp đỡ lẫn nhau trong cuộc sống;

e) Bảo vệ quyền và lợi ích hợp pháp của Cựu chiến binh; tuyên truyền, phổ biến, giáo dục pháp luật, tư vấn, trợ giúp pháp lý cho Cựu chiến binh;

g) Phối hợp với Đoàn thanh niên Cộng sản Hồ Chí Minh, các tổ chức thành viên khác của Mặt trận Tổ quốc Việt Nam, cơ quan quân sự giáo dục truyền thống yêu nước, chủ nghĩa anh hùng cách mạng, ý chí tự lực, tự cường cho thế hệ trẻ;

h) Tổ chức thực hiện các nghị quyết, kết luận của Đảng, quy định của pháp luật; các nghị quyết đối với hội viên của tổ chức mình; chuẩn bị nội dung, triệu tập và chủ trì các Hội nghị, cuộc họp của Ban Chấp hành, Ban Thường vụ; chỉ đạo việc lập kế hoạch kinh phí, chấp hành, quyết toán kinh phí hoạt động và quyết định việc phân bổ kinh phí hoạt động do Nhà nước cấp đối với tổ chức mình;

i) Chỉ đạo hoạt động của Ban Chấp hành, Ban Thường vụ theo đúng quy chế hoạt động đã được ban hành;

k) Các nhiệm vụ khác theo quy định của Đảng, của pháp luật có liên quan, quy định của tổ chức chính trị - xã hội ở trung ương và cơ quan có thẩm quyền quản lý cán bộ.

12. Căn cứ nhiệm vụ của từng chức vụ cán bộ cấp xã quy định tại Điều này, Ủy ban nhân dân cấp huyện quy định nhiệm vụ cụ thể của từng chức vụ cán bộ cấp xã cho phù hợp với đặc điểm và yêu cầu thực hiện nhiệm vụ của từng cấp xã, bảo đảm tất cả các lĩnh vực công tác đều có cán bộ phụ trách và thực hiện.

Điều 10. Tiêu chuẩn của từng chức danh công chức cấp xã

1. Tiêu chuẩn của công chức Chỉ huy trưởng Ban Chỉ huy Quân sự cấp xã thực hiện theo quy định của pháp luật chuyên ngành về quân sự.

2. Tiêu chuẩn của công chức Văn phòng - thống kê; Địa chính - xây dựng - đô thị và môi trường (đối với phường, thị trấn) hoặc Địa chính - nông nghiệp - xây dựng và môi trường (đối với xã); Tài chính - kế toán; Tư pháp - hộ tịch; Văn hóa - xã hội như sau:

a) Độ tuổi: Đủ 18 tuổi trở lên;

b) Trình độ giáo dục phổ thông: Tốt nghiệp trung học phổ thông;

c) Trình độ chuyên môn nghiệp vụ: Tốt nghiệp đại học trở lên của ngành đào tạo phù hợp với yêu cầu nhiệm vụ của từng chức danh công chức cấp xã. Trường hợp luật có quy định khác với quy định tại Nghị định này thì thực hiện theo quy định của luật đó.

3. Ủy ban nhân dân cấp tỉnh quy định cụ thể tiêu chuẩn trình độ chuyên môn, nghiệp vụ từ trung cấp trở lên đối với công chức cấp xã làm việc tại các xã, phường, thị trấn thuộc địa bàn miền núi, vùng cao, biên giới, hải đảo, xã đảo, vùng sâu, vùng xa, vùng đồng bào dân tộc thiểu số và vùng có điều kiện kinh tế - xã hội đặc biệt khó khăn.

4. Căn cứ tiêu chuẩn của từng chức danh công chức cấp xã quy định tại khoản 2 Điều này và điều kiện thực tế của địa phương, Ủy ban nhân dân cấp tỉnh quy định:

a) Tiêu chuẩn cụ thể của từng chức danh công chức cấp xã cho phù hợp với đặc điểm và yêu cầu thực hiện nhiệm vụ của từng cấp xã nhưng phải bảo đảm không thấp hơn tiêu chuẩn quy định tại Nghị định này;

b) Ngành đào tạo phù hợp với yêu cầu nhiệm vụ của từng chức danh công chức cấp xã trong từng kỳ tuyển dụng;

c) Xây dựng kế hoạch tạo nguồn, đào tạo, bồi dưỡng đối với từng chức danh công chức cấp xã về quản lý nhà nước, lý luận chính trị; ngoại ngữ, tin học, tiếng dân tộc thiểu số (đối với địa bàn công tác phải sử dụng tiếng dân tộc thiểu số trong hoạt động công vụ), thực hiện các chế độ, chính sách và tinh giản biên chế.

Điều 11. Nhiệm vụ của từng chức danh công chức cấp xã

1. Công chức Chỉ huy trưởng Ban Chỉ huy Quân sự cấp xã

a) Tham mưu, đề xuất với Đảng ủy, Hội đồng nhân dân, Ủy ban nhân dân cấp xã về chủ trương, biện pháp, giải pháp lãnh đạo, chỉ đạo thực hiện nhiệm vụ quốc phòng, quân sự; xây dựng lực lượng dân quân, lực lượng dự bị động viên; phối hợp với các tổ chức chính trị - xã hội triển khai thực hiện nhiệm vụ công tác quốc phòng - quân sự trên địa bàn;

b) Phối hợp với các đơn vị quân đội nhân dân, công an nhân dân và lực lượng khác trên địa bàn tham gia xây dựng nền quốc phòng toàn dân, khu vực phòng thủ dân sự; giữ gìn an ninh chính trị, trật tự, an toàn xã hội;

c) Phối hợp với các đơn vị bộ đội biên phòng, hải quân, cảnh sát biển và các lực lượng khác bảo vệ chủ quyền, an ninh biên giới quốc gia và chủ quyền, quyền chủ quyền trên các vùng biển Việt Nam;

d) Thực hiện nhiệm vụ phòng, chống, khắc phục hậu quả thiên tai, dịch bệnh, tìm kiếm, cứu nạn, bảo vệ và phòng, chống cháy rừng, bảo vệ môi trường và các nhiệm vụ phòng thủ dân sự khác;

đ) Giúp Chủ tịch Ủy ban nhân dân cấp xã thực hiện công tác đăng ký, quản lý công dân trong độ tuổi làm nghĩa vụ quân sự, quân nhân dự bị và dân quân tự vệ theo quy định của pháp luật, thực hiện công tác động viên gọi thanh niên nhập ngũ;

e) Tham mưu, giúp Hội đồng nghĩa vụ quân sự cấp xã xử lý các vi phạm theo quy định của Luật Nghĩa vụ quân sự;

g) Giúp Chủ tịch Ủy ban nhân dân cấp xã xây dựng và chỉ đạo lực lượng dân quân phối hợp với công an và các lực lượng khác thường xuyên hoạt động bảo vệ an ninh trật tự, sẵn sàng chiến đấu, tổ chức khắc phục thiên tai, sơ tán, cứu hộ, cứu nạn;

h) Chủ trì việc phối hợp với các tổ chức chính trị - xã hội về thực hiện công tác giáo dục quốc phòng trên địa bàn;

i) Giúp Ủy ban nhân dân cấp xã thực hiện chính sách hậu phương quân đội và thực hiện các chế độ, chính sách đối với dân quân, quân nhân dự bị theo quy định của pháp luật;

k) Thực hiện các nhiệm vụ khác theo phân công của Chủ tịch Ủy ban nhân dân cấp xã, của Ban Chỉ huy Quân sự cấp huyện và quy định của pháp luật về quốc phòng.

2. Công chức Văn phòng - thống kê

a) Tham mưu xây dựng và theo dõi việc thực hiện chương trình, kế hoạch công tác, lịch làm việc định kỳ, đột xuất của Hội đồng nhân dân, Thường trực Hội đồng nhân dân, Ủy ban nhân dân và Chủ tịch Ủy ban nhân dân cấp xã;

b) Phối hợp với công chức khác trong việc chuẩn bị các điều kiện vật chất, kỹ thuật để tổ chức các kỳ họp của Hội đồng nhân dân, phiên họp của Ủy ban nhân dân và các hoạt động khác của Hội đồng nhân dân, Thường trực Hội đồng nhân dân, Ủy ban nhân dân cấp xã; công tác bầu cử đại biểu Quốc hội, bầu cử đại biểu Hội đồng nhân dân các cấp và bầu cử thành viên Ủy ban nhân dân cấp xã;

c) Tổng hợp, theo dõi, báo cáo việc thực hiện quy chế làm việc của Ủy ban nhân dân cấp xã; giúp Chủ tịch Ủy ban nhân dân cấp xã tổ chức tiếp công dân và thực hiện quy chế dân chủ ở cơ sở theo quy định của pháp luật; tiếp nhận các kiến nghị, đơn thư khiếu nại, tố cáo chuyển đến Thường trực Hội đồng nhân dân, Ủy ban nhân dân, Chủ tịch Ủy ban nhân dân cấp xã xem xét, giải quyết theo thẩm quyền;

d) Tham mưu Ủy ban nhân dân cấp xã thực hiện cơ chế một cửa, một cửa liên thông; tổ chức bộ phận tiếp nhận, giải quyết và trả kết quả giải quyết các thủ tục hành chính của Ủy ban nhân dân cấp xã; xây dựng chính quyền điện tử, công nghệ thông tin, chuyển đổi số; công tác kiểm soát thủ tục hành chính;

đ) Giúp Ủy ban nhân dân cấp xã trong việc lập các biểu mẫu thống kê, tổ chức thực hiện điều tra thống kê theo quy định của pháp luật về thống kê; tổng hợp, thống kê và quản lý cơ sở dữ liệu theo các lĩnh vực trên địa bàn (trong đó có cơ sở dữ liệu về cán bộ, công chức cấp xã và người hoạt động không chuyên trách ở cấp xã, ở thôn, tổ dân phố); thực hiện công tác văn thư, lưu trữ, thi đua, khen thưởng;

e) Chủ trì, phối hợp với công chức khác theo dõi việc thực hiện kế hoạch phát triển kinh tế - xã hội; tổng hợp, thống kê kết quả thực hiện các chỉ tiêu phát triển kinh tế - xã hội ở cấp xã theo quy định của pháp luật;

g) Thực hiện các nhiệm vụ khác theo phân công của Chủ tịch Ủy ban nhân dân cấp xã và quy định của pháp luật có liên quan.

3. Công chức Địa chính - xây dựng - đô thị và môi trường (đối với phường, thị trấn) hoặc công chức Địa chính - nông nghiệp - xây dựng và môi trường (đối với xã)

a) Tham mưu, giúp Ủy ban nhân dân cấp xã tổ chức thực hiện các nhiệm vụ, quyền hạn của Ủy ban nhân dân, Chủ tịch Ủy ban nhân dân cấp xã trong các lĩnh vực về quản lý đất đai, địa giới đơn vị hành chính, tài nguyên, môi trường, xây dựng, đô thị, giao thông, nông nghiệp, nông thôn trên địa bàn cấp xã theo quy định của pháp luật;

b) Tham mưu, giúp Ủy ban nhân dân cấp xã xây dựng, triển khai thực hiện các quy hoạch, kế hoạch phát triển kinh tế - xã hội, ngành, lĩnh vực thuộc thẩm quyền của Ủy ban nhân dân cấp xã hoặc của cấp trên đã phê duyệt triển khai trên địa bàn cấp xã;

c) Thu thập thông tin, tổng hợp số liệu, bảo quản hồ sơ và xây dựng các báo cáo liên quan đến thẩm quyền quản lý của Ủy ban nhân dân cấp xã về đất đai, địa giới đơn vị hành chính, tài nguyên, môi trường, xây dựng, đô thị, giao thông, nông nghiệp, nông thôn trên địa bàn cấp xã;

d) Tham mưu, giúp Ủy ban nhân dân cấp xã trình Ủy ban nhân dân cấp huyện quyết định giao đất, thu hồi đất, cấp giấy chứng nhận quyền sử dụng đất đối với hộ gia đình, cá nhân; lập sổ địa chính đối với chủ sử dụng đất hợp pháp; hướng dẫn thủ tục thẩm tra để xác nhận tổ chức, hộ gia đình, cá nhân đăng ký đất đai, thực hiện các quyền công dân liên quan tới đất đai trên địa bàn cấp xã; phối hợp với công chức khác thực hiện các thủ tục hành chính trong việc tiếp nhận hồ sơ và thẩm tra để xác minh nguồn gốc, hiện trạng đăng ký và sử dụng đất đai, tình trạng tranh chấp đất đai và biến động về đất đai trên địa bàn;

đ) Tham mưu, giúp Ủy ban nhân dân cấp xã xây dựng các hồ sơ về việc cấp phép cải tạo, xây dựng các công trình, nhà ở trên địa bàn để Chủ tịch Ủy ban nhân dân cấp xã quyết định hoặc trình Ủy ban nhân dân cấp huyện xem xét, quyết định; công tác xây dựng, giám sát về kỹ thuật trong việc xây dựng các công trình phúc lợi ở địa phương;

e) Phụ trách các công việc thuộc lĩnh vực đất đai, địa giới đơn vị hành chính, tài nguyên, môi trường, xây dựng, đô thị, giao thông, nông nghiệp, nông thôn tại trung tâm giao dịch hành chính một cửa, một cửa liên thông theo phân công của Chủ tịch Ủy ban nhân dân cấp xã;

g) Thực hiện những nhiệm vụ khác theo phân công của Chủ tịch Ủy ban nhân dân cấp xã và quy định của pháp luật có liên quan.

4. Công chức Tài chính - kế toán

a) Tham mưu, giúp Ủy ban nhân dân cấp xã tổ chức thực hiện nhiệm vụ, quyền hạn của Ủy ban nhân dân cấp xã trong lĩnh vực tài chính, ngân sách trên địa bàn theo quy định của pháp luật;

b) Tham mưu, giúp Ủy ban nhân dân cấp xã xây dựng dự toán thu, chi ngân sách cấp xã trình Hội đồng nhân dân cấp xã phê duyệt; tổ chức thực hiện dự toán thu, chi ngân sách và các biện pháp khai thác nguồn thu trên địa bàn;

c) Tổ chức thực hiện các hoạt động tài chính, ngân sách theo hướng dẫn của cơ quan tài chính cấp trên; quyết toán ngân sách cấp xã và thực hiện báo cáo tài chính, ngân sách theo quy định của pháp luật;

d) Giúp Ủy ban nhân dân cấp xã thực hiện quản lý nguồn vốn các dự án đầu tư xây dựng cơ bản, tài sản công tại cấp xã; kiểm tra, quyết toán các dự án đầu tư xây dựng thuộc thẩm quyền quản lý của Ủy ban nhân dân cấp xã;

đ) Tham mưu, giúp Chủ tịch Ủy ban nhân dân cấp xã giải quyết chế độ, chính sách đối với cán bộ, công chức cấp xã và người hoạt động không chuyên trách;

e) Thực hiện các nhiệm vụ khác theo phân công của Chủ tịch Ủy ban nhân dân cấp xã và quy định của pháp luật có liên quan.

5. Công chức Tư pháp - hộ tịch

a) Tham mưu, giúp Ủy ban nhân dân cấp xã tổ chức thực hiện nhiệm vụ, quyền hạn của Ủy ban nhân dân cấp xã, Chủ tịch Ủy ban nhân dân cấp xã trong lĩnh vực tư pháp và hộ tịch trên địa bàn theo quy định của pháp luật;

b) Giúp Ủy ban nhân dân cấp xã thẩm định việc soạn thảo, ban hành các văn bản theo quy định của pháp luật; giúp Ủy ban nhân dân cấp xã tổ chức lấy ý kiến Nhân dân đối với các văn bản quy phạm pháp luật theo kế hoạch của Ủy ban nhân dân cấp xã và hướng dẫn của cơ quan cấp trên;

c) Giúp Ủy ban nhân dân cấp xã thực hiện công tác phổ biến, giáo dục pháp luật, trợ giúp pháp lý; công tác thi hành án; theo dõi việc thi hành pháp luật và tổ chức lấy ý kiến Nhân dân trên địa bàn cấp xã trong việc tham gia xây dựng pháp luật; xây dựng cấp xã đạt chuẩn tiếp cận pháp luật; hướng dẫn hoạt động đối với tổ chức hòa giải cơ sở; phối hợp với trưởng thôn, tổ trưởng tổ dân phố trong việc sơ kết, tổng kết công tác hòa giải ở cơ sở, báo cáo Ủy ban nhân dân cấp xã; quản lý tủ sách pháp luật tại Ủy ban nhân dân cấp xã; phối hợp với công chức Văn hóa - xã hội hướng dẫn cộng đồng dân cư thôn, tổ dân phố xây dựng và tổ chức thực hiện hương ước, quy ước;

d) Giúp Ủy ban nhân dân cấp xã thực hiện việc đăng ký, quản lý hộ tịch theo quy định của pháp luật;

đ) Phụ trách lĩnh vực hộ tịch, công chứng, chứng thực tại bộ phận tiếp nhận và trả kết quả của Ủy ban nhân dân cấp xã;

e) Giúp Ủy ban nhân dân cấp xã trong công tác phòng chống tham nhũng và các nhiệm vụ liên quan đến lĩnh vực thanh tra;

g) Thực hiện các nhiệm vụ khác theo phân công của Chủ tịch Ủy ban nhân dân cấp xã và quy định của pháp luật có liên quan.

6. Công chức Văn hóa - xã hội

a) Tham mưu, giúp Ủy ban nhân dân cấp xã tổ chức thực hiện nhiệm vụ, quyền hạn của Ủy ban nhân dân cấp xã, Chủ tịch Ủy ban nhân dân cấp xã trong các lĩnh vực văn hóa, thông tin, truyền thông, thể dục, thể thao, du lịch, lao động, thương binh, xã hội, y tế, giáo dục, tín ngưỡng, tôn giáo, dân tộc, gia đình, trẻ em và thanh niên theo quy định của pháp luật; tham mưu giúp Ủy ban nhân dân cấp xã trong công tác bảo hiểm xã hội, bảo hiểm y tế, an toàn vệ sinh, lao động; xây dựng tiêu chí phát triển đối tượng tham gia bảo hiểm xã hội, bảo hiểm y tế trong kế hoạch phát triển kinh tế - xã hội hàng năm để trình Hội đồng nhân dân cùng cấp quyết định;

b) Giúp Ủy ban nhân dân cấp xã trong việc tổ chức các hoạt động văn hóa, thông tin, truyền thông, thể dục, thể thao; quản lý du lịch, bảo vệ các di tích lịch sử văn hóa trên địa bàn cấp xã, xây dựng đời sống văn hóa ở cộng đồng dân cư và xây dựng gia đình văn hóa trên địa bàn;

c) Thống kê dân số, lao động, việc làm, ngành nghề trên địa bàn; theo dõi, tổng hợp, báo cáo về số lượng và tình hình biến động các đối tượng chính sách lao động, người có công; tín ngưỡng, tôn giáo, dân tộc, gia đình, trẻ em và thanh niên; thực hiện việc chi trả các chế độ đối với người hưởng chính sách xã hội, người có công; quản lý nghĩa trang liệt sĩ và các công trình ghi công liệt sĩ; thực hiện các hoạt động bảo trợ xã hội, chương trình xóa đói, giảm nghèo và công tác an toàn thực phẩm trên địa bàn; báo cáo số liệu thông tin, truyền thông;

d) Chủ trì, phối hợp với công chức tư pháp và Trưởng thôn, Tổ trưởng tổ dân phố trong việc hướng dẫn cộng đồng dân cư thôn, tổ dân phố xây dựng và tổ chức thực hiện hương ước, quy ước; phối hợp với công chức Văn phòng - thống kê trong việc xây dựng cơ sở dữ liệu về dân số, lao động, việc làm và các đối tượng chính sách;

đ) Thực hiện các nhiệm vụ khác theo phân công của Chủ tịch Ủy ban nhân dân cấp xã và quy định của pháp luật có liên quan.

7. Căn cứ nhiệm vụ của từng chức danh công chức cấp xã quy định tại Điều này, Ủy ban nhân dân cấp huyện quy định nhiệm vụ cụ thể của từng chức danh công chức cấp xã cho phù hợp với đặc điểm và yêu cầu thực hiện nhiệm vụ của từng cấp xã, bảo đảm tất cả các lĩnh vực công tác đều có công chức phụ trách và thực hiện.

Mục 3. BẦU CỬ CÁN BỘ CẤP XÃ VÀ TUYỂN DỤNG CÔNG CHỨC CẤP XÃ

Điều 12. Bầu cử cán bộ cấp xã

1. Bầu cử cán bộ cấp xã đảm nhiệm chức vụ trong Hội đồng nhân dân, Ủy ban nhân dân thực hiện theo quy định của Luật Bầu cử đại biểu Quốc hội và đại biểu Hội đồng nhân dân; Luật Tổ chức chính quyền địa phương và các văn bản quy phạm pháp luật có liên quan.

2. Bầu cử cán bộ cấp xã đảm nhiệm chức vụ trong tổ chức Đảng, tổ chức chính trị - xã hội cấp xã thực hiện theo quy định tại Điều lệ Đảng, điều lệ tổ chức chính trị - xã hội và quy định của Đảng, của tổ chức chính trị - xã hội ở trung ương.

Điều 13. Tuyển dụng công chức cấp xã

Việc tuyển dụng công chức cấp xã được áp dụng quy định tại Nghị định của Chính phủ về tuyển dụng, sử dụng và quản lý công chức, gồm:

1. Căn cứ tuyển dụng công chức cấp xã.

2. Điều kiện đăng ký dự tuyển công chức cấp xã.

Riêng chức danh công chức Chỉ huy trưởng Ban Chỉ huy Quân sự cấp xã ngoài các điều kiện đăng ký dự tuyển công chức cấp xã theo quy định tại khoản này còn phải đáp ứng đủ tiêu chuẩn quy định tại Điều 7khoản 1 Điều 10 Nghị định này.

3. Đối tượng và điểm ưu tiên trong thi tuyển hoặc xét tuyển công chức cấp xã.

Riêng Đội viên trí thức trẻ tình nguyện tham gia phát triển nông thôn, miền núi và người hoạt động không chuyên trách ở cấp xã từ đủ 24 tháng trở lên đã được đánh giá xếp loại hoàn thành nhiệm vụ trở lên được cộng 2,5 điểm vào kết quả điểm vòng 2.

4. Hội đồng tuyển dụng công chức cấp xã.

5. Hình thức, nội dung và thời gian thi tuyển công chức cấp xã.

Riêng người đạt kết quả kiểm định chất lượng đầu vào theo quy định của Chính phủ về kiểm định chất lượng đầu vào công chức mà tham gia thi tuyển công chức cấp xã thì không phải thực hiện thi vòng 1 theo quy định của Chính phủ về tuyển dụng, sử dụng và quản lý công chức.

6. Xác định người trúng tuyển trong kỳ thi tuyển dụng công chức cấp xã.

7. Đối tượng xét tuyển công chức cấp xã.

Riêng chức danh công chức Chỉ huy trưởng Ban Chỉ huy Quân sự cấp xã thực hiện việc xét tuyển đối với người có đủ tiêu chuẩn theo quy định tại Điều 7khoản 1 Điều 10 Nghị định này và thực hiện việc bổ nhiệm chức danh theo quy định của pháp luật về dân quân tự vệ.

8. Nội dung, hình thức xét tuyển công chức cấp xã.

9. Xác định người trúng tuyển trong kỳ xét tuyển công chức cấp xã.

10. Thông báo tuyển dụng và tiếp nhận Phiếu đăng ký dự tuyển công chức cấp xã.

11. Trình tự tổ chức tuyển dụng công chức cấp xã.

12. Thông báo kết quả tuyển dụng công chức cấp xã.

13. Hoàn thiện hồ sơ tuyển dụng công chức cấp xã.

14. Quyết định tuyển dụng và nhận việc đối với công chức cấp xã.

15. Tập sự đối với công chức cấp xã.

a) Riêng thời gian tập sự của công chức cấp xã được thực hiện như sau: 12 tháng đối với công chức được tuyển dụng có trình độ đào tạo đại học trở lên; 06 tháng đối với công chức được tuyển dụng có trình độ đào tạo dưới đại học. Không thực hiện chế độ tập sự đối với chức danh công chức Chỉ huy trưởng Ban Chỉ huy Quân sự cấp xã.

b) Người được tuyển dụng giữ chức danh công chức cấp xã hoàn thành chế độ tập sự theo quy định tại khoản này thì Chủ tịch Ủy ban nhân dân cấp xã đề nghị Chủ tịch Ủy ban nhân dân cấp huyện quyết định công nhận hết thời gian tập sự và xếp lương đối với công chức được tuyển dụng.

Điều 14. Tiếp nhận vào làm công chức cấp xã

1. Đối tượng tiếp nhận:

a) Viên chức công tác tại đơn vị sự nghiệp công lập;

b) Người hưởng lương trong lực lượng vũ trang nhân dân, người làm việc trong tổ chức cơ yếu nhưng không phải là công chức;

c) Người thôi giữ chức vụ cán bộ ở cấp xã (trừ hình thức kỷ luật bãi nhiệm);

d) Người đã từng là cán bộ, công chức (bao gồm cả cán bộ, công chức cấp xã) sau đó được cấp có thẩm quyền điều động, luân chuyển giữ các vị trí công tác không phải là cán bộ, công chức tại các cơ quan, tổ chức khác.

2. Tiêu chuẩn, điều kiện tiếp nhận; hồ sơ của người được đề nghị tiếp nhận và Hội đồng kiểm tra, sát hạch khi tiếp nhận vào làm công chức cấp xã được áp dụng quy định của Chính phủ về tuyển dụng, sử dụng và quản lý công chức.

Điều 15. Thẩm quyền tuyển dụng công chức cấp xã và tiếp nhận vào làm công chức cấp xã

Chủ tịch Ủy ban nhân dân cấp huyện có thẩm quyền tuyển dụng công chức cấp xã và tiếp nhận vào làm công chức cấp xã.

Mục 4. CHẾ ĐỘ TIỀN LƯƠNG, PHỤ CẤP VÀ MỘT SỐ CHẾ ĐỘ, CHÍNH SÁCH ĐỐI VỚI CÁN BỘ, CÔNG CHỨC CẤP XÃ

Điều 16. Xếp lương đối với cán bộ, công chức cấp xã

1. Cán bộ, công chức cấp xã tốt nghiệp trình độ đào tạo theo tiêu chuẩn về trình độ chuyên môn, nghiệp vụ quy định tại Nghị định này được thực hiện xếp lương như công chức hành chính có cùng trình độ đào tạo quy định tại bảng lương chuyên môn, nghiệp vụ đối với cán bộ, công chức trong các cơ quan nhà nước ban hành kèm theo Nghị định của Chính phủ về chế độ tiền lương đối với cán bộ, công chức, viên chức và lực lượng vũ trang.

Văn bằng tốt nghiệp trình độ đào tạo thực hiện theo quy định của Bộ Giáo dục và Đào tạo và của cơ quan, tổ chức có thẩm quyền cấp bằng.

2. Trường hợp trong thời gian công tác, cán bộ, công chức cấp xã có thay đổi về trình độ đào tạo phù hợp với chức vụ, chức danh hiện đảm nhiệm thì được đề nghị Chủ tịch Ủy ban nhân dân cấp huyện xếp lương theo trình độ đào tạo mới kể từ ngày được cấp bằng tốt nghiệp.

3. Trường hợp người được bầu làm cán bộ cấp xã, được tuyển dụng, tiếp nhận vào làm công chức cấp xã theo quy định tại Nghị định này mà đã có thời gian công tác có đóng bảo hiểm xã hội bắt buộc, chưa nhận trợ cấp bảo hiểm xã hội một lần thì thời gian công tác có đóng bảo hiểm xã hội bắt buộc được tính để làm căn cứ xếp lương (trừ thời gian tập sự, thử việc), thời gian công tác có đóng bảo hiểm xã hội bắt buộc không liên tục thì được cộng dồn.

Điều 17. Nâng bậc lương đối với cán bộ, công chức cấp xã

Cán bộ, công chức cấp xã quy định tại khoản 1 Điều 16 Nghị định này thực hiện chế độ nâng bậc lương thường xuyên, nâng bậc lương trước thời hạn, kéo dài thời gian nâng bậc lương theo quy định của Chính phủ về chế độ tiền lương đối với cán bộ, công chức, viên chức và lực lượng vũ trang.

Điều 18. Phụ cấp thâm niên vượt khung

Cán bộ, công chức cấp xã quy định tại khoản 1 Điều 16 Nghị định này được thực hiện chế độ phụ cấp thâm niên vượt khung theo quy định của Chính phủ về chế độ tiền lương đối với cán bộ, công chức, viên chức và lực lượng vũ trang.

Điều 19. Phụ cấp chức vụ lãnh đạo cấp xã

Cán bộ cấp xã quy định tại khoản 1 Điều 16 Nghị định này được hưởng phụ cấp chức vụ lãnh đạo so với mức lương cơ sở như sau:

1. Bí thư Đảng ủy: 0,30.

2. Phó Bí thư Đảng ủy, Chủ tịch Hội đồng nhân dân, Chủ tịch Ủy ban nhân dân: 0,25.

3. Chủ tịch Ủy ban Mặt trận Tổ quốc, Phó Chủ tịch Hội đồng nhân dân, Phó Chủ tịch Ủy ban nhân dân: 0,20.

4. Bí thư Đoàn Thanh niên Cộng sản Hồ Chí Minh, Chủ tịch Hội Liên hiệp Phụ nữ, Chủ tịch Hội Nông dân, Chủ tịch Hội Cựu chiến binh: 0,15.

Điều 20. Phụ cấp kiêm nhiệm chức vụ, chức danh

1. Cán bộ, công chức cấp xã kiêm nhiệm chức vụ, chức danh cán bộ, công chức cấp xã khác với chức vụ, chức danh hiện đảm nhiệm mà giảm được 01 người trong số lượng cán bộ, công chức cấp xã được Ủy ban nhân dân cấp huyện giao theo quy định tại khoản 5 Điều 6 Nghị định này thì kể từ ngày cấp có thẩm quyền quyết định việc kiêm nhiệm được hưởng phụ cấp kiêm nhiệm bằng 50% mức lương (bậc 1), cộng phụ cấp chức vụ lãnh đạo (nếu có) của chức vụ, chức danh kiêm nhiệm; phụ cấp kiêm nhiệm chức vụ, chức danh không dùng để tính đóng, hưởng chế độ bảo hiểm xã hội, bảo hiểm y tế.

Trường hợp kiêm nhiệm nhiều chức vụ, chức danh (kể cả trường hợp Bí thư cấp ủy đồng thời là Chủ tịch Ủy ban nhân dân, Bí thư cấp ủy đồng thời là Chủ tịch Hội đồng nhân dân) cũng chỉ được hưởng một mức phụ cấp kiêm nhiệm cao nhất, Ủy ban nhân dân cấp huyện quyết định chức vụ, chức danh được hưởng phụ cấp kiêm nhiệm trong trường hợp số lượng chức danh bố trí kiêm nhiệm lớn hơn số lượng cán bộ, công chức cấp xã giảm được so với quy định.

2. Trường hợp cán bộ, công chức cấp xã kiêm nhiệm thực hiện nhiệm vụ của người hoạt động không chuyên trách ở cấp xã, ở thôn, tổ dân phố thì được hưởng phụ cấp kiêm nhiệm bằng 100% mức phụ cấp quy định của chức danh kiêm nhiệm.

Điều 21. Chế độ bảo hiểm xã hội và bảo hiểm y tế

Chế độ bảo hiểm xã hội, bảo hiểm y tế đối với cán bộ, công chức cấp xã thực hiện theo quy định của pháp luật về bảo hiểm xã hội và bảo hiểm y tế.

Điều 22. Chế độ đào tạo, bồi dưỡng

Chế độ đào tạo, bồi dưỡng cán bộ, công chức cấp xã thực hiện theo quy định của Chính phủ về đào tạo, bồi dưỡng cán bộ, công chức, viên chức và quy định của Đảng, tổ chức chính trị - xã hội ở trung ương.

Mục 5. ĐIỀU ĐỘNG, CHUYỂN CÔNG TÁC VÀ TIẾP NHẬN CÔNG CHỨC CẤP XÃ

Điều 23. Điều động, chuyển công tác và tiếp nhận công chức cấp xã từ xã, phường, thị trấn này đến làm việc ở xã, phường, thị trấn khác

1. Đối với công chức Văn phòng - thống kê, Địa chính - xây dựng - đô thị và môi trường (đối với phường, thị trấn) hoặc Địa chính - nông nghiệp - xây dựng và môi trường (đối với xã), Tài chính - kế toán, Tư pháp - hộ tịch, Văn hóa - xã hội:

a) Chủ tịch Ủy ban nhân dân cấp huyện quyết định việc điều động công chức cấp xã từ xã, phường, thị trấn này chuyển sang làm việc ở xã, phường, thị trấn khác trong cùng một đơn vị hành chính cấp huyện;

b) Chủ tịch Ủy ban nhân dân cấp huyện quyết định việc chuyển công tác, tiếp nhận công chức cấp xã từ xã, phường, thị trấn của cấp huyện này sang làm việc ở xã, phường, thị trấn của cấp huyện khác sau khi có ý kiến thống nhất bằng văn bản của Giám đốc Sở Nội vụ;

c) Chủ tịch Ủy ban nhân dân cấp huyện quyết định việc chuyển công tác đối với công chức cấp xã ra ngoài tỉnh và tiếp nhận công chức cấp xã từ tỉnh khác sau khi có ý kiến thống nhất bằng văn bản của Giám đốc Sở Nội vụ nơi chuyển công tác và nơi tiếp nhận.

2. Đối với công chức Chỉ huy trưởng Ban Chỉ huy Quân sự cấp xã:

Việc điều động, chuyển công tác, tiếp nhận công chức Chỉ huy trưởng Ban Chỉ huy Quân sự cấp xã được thực hiện theo yêu cầu nhiệm vụ cụ thể. Chủ tịch Ủy ban nhân dân cấp huyện quyết định việc điều động, chuyển công tác, tiếp nhận công chức Chỉ huy trưởng Ban Chỉ huy Quân sự cấp xã theo phân cấp quản lý công chức của địa phương.

3. Cán bộ, công chức cấp xã được điều động, chuyển công tác, tiếp nhận đến làm việc ở cấp xã có điều kiện kinh tế - xã hội đặc biệt khó khăn được hưởng các chế độ, chính sách ưu đãi theo quy định của pháp luật.

Mục 6. ĐÁNH GIÁ, XẾP LOẠI CHẤT LƯỢNG CÁN BỘ, CÔNG CHỨC CẤP XÃ

Điều 24. Đánh giá, xếp loại chất lượng cán bộ, công chức cấp xã

Cán bộ, công chức cấp xã (trừ chức danh công chức Chỉ huy trưởng Ban Chỉ huy Quân sự cấp xã) thực hiện việc đánh giá, xếp loại theo quy định của Luật Cán bộ, công chức, quy định của Chính phủ về đánh giá, xếp loại chất lượng cán bộ, công chức, viên chức, các quy định của pháp luật có liên quan, điều lệ tổ chức và quy định của Đảng, của tổ chức chính trị - xã hội ở trung ương.

Điều 25. Trình tự, thủ tục đánh giá, xếp loại đối với công chức Chỉ huy trưởng Ban Chỉ huy Quân sự cấp xã

1. Công chức tự đánh giá, nhận mức xếp loại kết quả công tác theo chức trách, nhiệm vụ được giao.

2. Tập thể Ban Chỉ huy Quân sự cấp xã và công chức của Ủy ban nhân dân cấp xã họp tham gia góp ý. Ý kiến góp ý được lập thành biên bản và thông qua tại cuộc họp.

3. Chủ tịch Ủy ban nhân dân cấp xã đánh giá xếp loại công chức Chỉ huy trưởng Ban Chỉ huy Quân sự cấp xã và thông báo đến công chức sau khi tham khảo ý kiến bằng văn bản của Chỉ huy trưởng Ban Chỉ huy Quân sự cấp huyện.

Mục 7. BÃI NHIỆM, MIỄN NHIỆM, THÔI GIỮ CHỨC VỤ ĐỐI VỚI CÁN BỘ CẤP XÃ; THÔI VIỆC ĐỐI VỚI CÔNG CHỨC CẤP XÃ VÀ NGHỈ HƯU ĐỐI VỚI CÁN BỘ, CÔNG CHỨC CẤP XÃ

Điều 26. Bãi nhiệm, miễn nhiệm đối với cán bộ cấp xã

Việc bãi nhiệm, miễn nhiệm đối với cán bộ cấp xã thực hiện theo quy định hiện hành của Luật Cán bộ, công chức, Luật Tổ chức chính quyền địa phương, Luật Bầu cử đại biểu Quốc hội và đại biểu Hội đồng nhân dân và quy định khác của pháp luật có liên quan, điều lệ tổ chức và quy định của Đảng, của tổ chức chính trị - xã hội ở trung ương.

Điều 27. Thôi giữ chức vụ đối với cán bộ cấp xã và thôi việc đối với cán bộ, công chức cấp xã

1. Cán bộ cấp xã thôi giữ chức vụ và công chức cấp xã thôi việc (trừ trường hợp chuyển công tác và trường hợp bị kỷ luật theo quy định của pháp luật về cán bộ, công chức) được hưởng chế độ trợ cấp thôi giữ chức vụ đối với cán bộ cấp xã, trợ cấp thôi việc đối với công chức cấp xã và được tính theo quy định của Chính phủ về trợ cấp thôi việc đối với công chức.

2. Chỉ huy trưởng Ban Chỉ huy Quân sự cấp xã nếu bị xử lý kỷ luật bằng hình thức cách chức mà không sắp xếp, bố trí được chức danh công chức khác ở cấp xã thì được giải quyết chế độ thôi việc trong thời hạn 30 ngày kể từ ngày quyết định kỷ luật có hiệu lực thi hành. Ngoài chế độ thôi việc được hưởng theo quy định tại khoản 1 Điều này, Chỉ huy trưởng Ban Chỉ huy Quân sự cấp xã còn được hưởng các chế độ thôi việc khác theo quy định của pháp luật về dân quân tự vệ.

3. Nguồn kinh phí chi trả trợ cấp thôi giữ chức vụ đối với cán bộ cấp xã và trợ cấp thôi việc đối với công chức cấp xã được bố trí trong dự toán chi hoạt động thường xuyên của Ủy ban nhân dân cấp xã được cấp có thẩm quyền giao hàng năm.

Điều 28. Nghỉ hưu đối với cán bộ, công chức cấp xã

1. Cán bộ, công chức cấp xã được nghỉ hưu theo quy định của pháp luật về lao động và quy định của Đảng, của tổ chức chính trị - xã hội ở trung ương.

2. Trước 06 tháng, tính đến ngày cán bộ, công chức cấp xã nghỉ hưu, cấp có thẩm quyền quản lý cán bộ, công chức cấp xã phải thông báo bằng văn bản về thời điểm nghỉ hưu; trước 03 tháng, tính đến ngày cán bộ, công chức cấp xã nghỉ hưu, cấp có thẩm quyền quản lý cán bộ, công chức cấp xã phải ban hành quyết định nghỉ hưu.

Mục 8. KỶ LUẬT, KHEN THƯỞNG ĐỐI VỚI CÁN BỘ, CÔNG CHỨC CẤP XÃ

Điều 29. Kỷ luật cán bộ, công chức cấp xã

Kỷ luật cán bộ, công chức cấp xã thực hiện theo quy định của Chính phủ về xử lý kỷ luật cán bộ, công chức, viên chức. Trường hợp luật, Điều lệ Đảng, tổ chức chính trị - xã hội có quy định khác thì thực hiện theo quy định của luật, điều lệ đó.

Điều 30. Khen thưởng cán bộ, công chức cấp xã

Việc khen thưởng cán bộ, công chức cấp xã thực hiện theo quy định của pháp luật về thi đua, khen thưởng, điều lệ tổ chức và quy định của Đảng, tổ chức chính trị - xã hội ở trung ương.

Mục 9. QUẢN LÝ CÁN BỘ, CÔNG CHỨC CẤP XÃ

Điều 31. Nội dung quản lý cán bộ, công chức cấp xã

1. Ban hành và tổ chức thực hiện văn bản quy phạm pháp luật, điều lệ, quy chế về cán bộ, công chức cấp xã.

2. Xây dựng kế hoạch, quy hoạch cán bộ, công chức cấp xã.

3. Quy định chức vụ, chức danh, vị trí việc làm, tiêu chuẩn và nhiệm vụ của cán bộ, công chức cấp xã.

4. Quy định số lượng cán bộ, công chức cấp xã; tuyển dụng, sử dụng, quản lý, đào tạo, bồi dưỡng, chế độ tập sự, thôi giữ chức vụ, thôi việc, nghỉ hưu, đánh giá, xếp loại chất lượng cán bộ, công chức cấp xã.

5. Thực hiện khen thưởng, xử lý kỷ luật, chế độ tiền lương và các chế độ, chính sách đãi ngộ đối với cán bộ, công chức cấp xã.

6. Thực hiện chế độ báo cáo thống kê, quản lý hồ sơ về cán bộ, công chức cấp xã.

7. Thanh tra, kiểm tra đối với cơ quan, tổ chức và đối với cán bộ, công chức trong việc thực hiện các quy định của pháp luật về cán bộ, công chức cấp xã.

8. Giải quyết khiếu nại, tố cáo đối với cán bộ, công chức cấp xã.

9. Các công tác khác liên quan đến quản lý cán bộ, công chức cấp xã.

Điều 32. Thẩm quyền quản lý đối với cán bộ, công chức cấp xã

1. Bộ Nội vụ có nhiệm vụ và quyền hạn:

a) Trình Chính phủ, Thủ tướng Chính phủ ban hành các quy định về cán bộ, công chức cấp xã;

b) Hướng dẫn thực hiện các văn bản quy phạm pháp luật của Chính phủ, Thủ tướng Chính phủ về cán bộ, công chức cấp xã;

c) Thanh tra, kiểm tra đối với Ủy ban nhân dân các cấp và đối với cán bộ, công chức trong việc thực hiện các quy định của pháp luật về cán bộ, công chức cấp xã;

d) Thống kê, tổng hợp số lượng, chất lượng đội ngũ cán bộ, công chức cấp xã trên phạm vi toàn quốc.

2. Ủy ban nhân dân cấp tỉnh có nhiệm vụ và quyền hạn:

a) Trình Hội đồng nhân dân cùng cấp quyết định số lượng cán bộ, công chức cấp xã đối với từng đơn vị hành chính cấp huyện theo quy định tại khoản 4 Điều 6 Nghị định này;

b) Ban hành Quy chế tổ chức tuyển dụng công chức cấp xã; hướng dẫn, kiểm tra Ủy ban nhân dân cấp huyện thực hiện đánh giá, xếp loại chất lượng cán bộ, công chức cấp xã hàng năm;

c) Quy định tiêu chuẩn cụ thể của từng chức vụ cán bộ cấp xã và từng chức danh danh công chức cấp xã theo quy định tại Điều 8Điều 10 Nghị định này;

d) Quy định ngành đào tạo theo yêu cầu nhiệm vụ của từng chức danh công chức cấp xã;

đ) Thanh tra, kiểm tra việc tổ chức thực hiện chế độ, chính sách đối với cán bộ, công chức cấp xã;

e) Chỉ đạo, hướng dẫn, kiểm tra việc tuyển dụng, lập kế hoạch, quy hoạch xây dựng đội ngũ cán bộ, công chức cấp xã; từng bước thực hiện tiêu chuẩn hóa để nâng cao chất lượng cán bộ, công chức cấp xã;

g) Hàng năm, chỉ đạo việc xây dựng kế hoạch, chương trình, tài liệu đào tạo, bồi dưỡng cán bộ, công chức cấp xã;

h) Chỉ đạo việc giải quyết khiếu nại, tố cáo đối với cán bộ, công chức cấp xã;

i) Ban hành quy định về phân cấp quản lý đối với cán bộ, công chức cấp xã;

k) Tổng hợp thống kê, báo cáo số lượng, chất lượng cán bộ, công chức cấp xã trên địa bàn cấp tỉnh;

l) Hướng dẫn, kiểm tra việc sử dụng nguồn kinh phí để thực hiện chế độ, chính sách theo quy định của Chính phủ và theo Nghị quyết của Hội đồng nhân dân cùng cấp đối với cán bộ, công chức cấp xã;

m) Hướng dẫn việc lập và quản lý hồ sơ cán bộ, công chức cấp xã.

3. Ủy ban nhân dân cấp huyện có nhiệm vụ và quyền hạn:

a) Lập kế hoạch, quy hoạch xây dựng đội ngũ cán bộ, công chức cấp xã;

b) Quyết định số lượng cụ thể cán bộ, công chức ở từng đơn vị hành chính cấp xã và bố trí số lượng công chức của từng chức danh công chức cấp xã theo quy định tại khoản 5 Điều 6 Nghị định này;

c) Tổ chức tuyển dụng đối với công chức cấp xã theo quy định tại Nghị định này và Quy chế tuyển dụng công chức của Ủy ban nhân dân cấp tỉnh; quyết định tiếp nhận, điều động, chuyển công tác và quản lý công chức cấp xã theo quy định tại Nghị định này và theo phân cấp quản lý công chức của Ủy ban nhân dân cấp tỉnh; thực hiện cho thôi giữ chức vụ đối với cán bộ cấp xã, thôi việc đối với công chức cấp xã và nghỉ hưu đối với cán bộ, công chức cấp xã theo quy định của pháp luật;

d) Quy định nhiệm vụ cụ thể của từng chức vụ cán bộ cấp xã và từng chức danh công chức cấp xã theo quy định tại Điều 9Điều 11 Nghị định này;

đ) Tổ chức thực hiện chế độ tiền lương và các chế độ, chính sách khác đối với cán bộ, công chức cấp xã;

e) Quyết định chức danh được hưởng phụ cấp kiêm nhiệm trong trường hợp số lượng chức danh bố trí kiêm nhiệm lớn hơn số lượng cán bộ, công chức cấp xã giảm được quy định tại khoản 1 Điều 20 Nghị định này;

g) Tổ chức việc đào tạo, bồi dưỡng cán bộ, công chức cấp xã theo hướng dẫn và phân cấp của Ủy ban nhân dân cấp tỉnh;

h) Quyết định khen thưởng, kỷ luật đối với cán bộ, công chức cấp xã theo phân cấp quản lý cán bộ, công chức của Ủy ban nhân dân cấp tỉnh;

i) Thanh tra, kiểm tra, đánh giá việc thực hiện các quy định về cán bộ, công chức cấp xã;

k) Giải quyết khiếu nại, tố cáo đối với cán bộ, công chức cấp xã theo quy định của pháp luật;

l) Tổng hợp thống kê, báo cáo số lượng, chất lượng đội ngũ cán bộ, công chức cấp xã trên địa bàn cấp huyện;

m) Hướng dẫn, kiểm tra Ủy ban nhân dân cấp xã trong việc nhận xét, đánh giá, xếp loại chất lượng cán bộ, công chức cấp xã hàng năm; kiểm tra việc thực hiện chế độ, chính sách đối với cán bộ, công chức cấp xã;

n) Hướng dẫn Ủy ban nhân dân cấp xã lập và quản lý hồ sơ cán bộ, công chức cấp xã.

4. Ủy ban nhân dân cấp xã có nhiệm vụ và quyền hạn:

a) Trực tiếp quản lý và sử dụng công chức cấp xã; nhận xét, đánh giá, xếp loại chất lượng hàng năm đối với công chức cấp xã;

b) Thực hiện chế độ, chính sách, kế hoạch đào tạo, bồi dưỡng; quy hoạch, tạo nguồn đối với công chức cấp xã;

c) Trình Ủy ban nhân dân cấp huyện xem xét, quyết định chức danh được hưởng phụ cấp kiêm nhiệm trong trường hợp số lượng chức danh bố trí kiêm nhiệm lớn hơn số lượng cán bộ, công chức cấp xã giảm được quy định tại khoản 1 Điều 20 Nghị định này;

d) Đề nghị cơ quan, tổ chức có thẩm quyền ở cấp huyện khen thưởng cán bộ, công chức cấp xã theo phân cấp quản lý cán bộ, công chức ở địa phương;

đ) Đề nghị cơ quan, tổ chức có thẩm quyền cấp huyện về xử lý kỷ luật đối với cán bộ, công chức cấp xã;

e) Giải quyết khiếu nại, tố cáo đối với công chức cấp xã theo quy định của pháp luật;

g) Thống kê, báo cáo số lượng, chất lượng đội ngũ cán bộ, công chức cấp xã;

h) Lập và quản lý hồ sơ cán bộ, công chức cấp xã.

Chương III

NGƯỜI HOẠT ĐỘNG KHÔNG CHUYÊN TRÁCH Ở CẤP XÃ, Ở THÔN, TỔ DÂN PHỐ

Điều 33. Số lượng người hoạt động không chuyên trách ở cấp xã, ở thôn, tổ dân phố

1. Số lượng người hoạt động không chuyên trách ở cấp xã được tính theo loại đơn vị hành chính cấp xã, cụ thể như sau: Loại I là 14 người; loại II là 12 người; loại III là 10 người.

2. Ủy ban nhân dân cấp tỉnh căn cứ số lượng đơn vị hành chính cấp xã có quy mô dân số, diện tích tự nhiên lớn hơn so với tiêu chuẩn quy định tại Nghị quyết của Ủy ban Thường vụ Quốc hội về tiêu chuẩn của đơn vị hành chính và phân loại đơn vị hành chính để tính số lượng người hoạt động không chuyên trách ở cấp xã tăng thêm như sau:

a) Phường thuộc quận cứ tăng thêm đủ 1/3 (một phần ba) mức quy định về quy mô dân số thì được tăng thêm 01 người hoạt động không chuyên trách. Các đơn vị hành chính cấp xã còn lại cứ tăng thêm đủ 1/2 (một phần hai) mức quy định về quy mô dân số thì được tăng thêm 01 người hoạt động không chuyên trách;

b) Ngoài việc tăng thêm người hoạt động không chuyên trách theo quy mô dân số quy định tại điểm a khoản này thì đơn vị hành chính cấp xã cứ tăng thêm đủ 100% mức quy định về diện tích tự nhiên được tăng thêm 01 người hoạt động không chuyên trách.

3. Quy mô dân số (bao gồm dân số thường trú và dân số tạm trú quy đổi) và diện tích tự nhiên tính đến ngày 31 tháng 12 hàng năm để xác định số lượng người hoạt động không chuyên trách ở cấp xã quy định tại khoản 2 Điều này thực hiện theo Nghị quyết của Ủy ban Thường vụ Quốc hội về tiêu chuẩn của đơn vị hành chính và phân loại đơn vị hành chính.

Trường hợp ở đơn vị hành chính cấp xã tính đến ngày 31 tháng 12 hàng năm có thay đổi về quy mô dân số, diện tích tự nhiên quy định tại khoản 2 Điều này hoặc có thay đổi về loại đơn vị hành chính thì Ủy ban nhân dân cấp tỉnh trình Hội đồng nhân dân cùng cấp xem xét, điều chỉnh tổng số lượng người hoạt động không chuyên trách ở cấp xã (tính cho cả đơn vị hành chính cấp tỉnh) bảo đảm theo đúng quy định.

4. Hàng năm, Ủy ban nhân dân cấp tỉnh trình Hội đồng nhân dân cùng cấp quyết định số lượng người hoạt động không chuyên trách ở cấp xã đối với từng đơn vị hành chính cấp huyện thuộc phạm vi quản lý cho phù hợp với yêu cầu của thực tiễn, nhưng phải bảo đảm tổng số lượng người hoạt động không chuyên trách ở cấp xã thuộc các đơn vị hành chính cấp huyện không vượt quá tổng số lượng người hoạt động không chuyên trách ở cấp xã tính cho cả đơn vị hành chính cấp tỉnh theo quy định tại các khoản 1, 2 Điều này.

5. Hàng năm, Ủy ban nhân dân cấp huyện quyết định số lượng cụ thể người hoạt động không chuyên trách cấp xã ở từng đơn vị hành chính cấp xã và bố trí số lượng người hoạt động không chuyên trách ở cấp xã thuộc phạm vi quản lý cho phù hợp với yêu cầu, nhiệm vụ của từng đơn vị hành chính cấp xã. Số lượng người hoạt động không chuyên trách cấp xã ở từng đơn vị hành chính cấp xã có thể thấp hơn mức của cấp xã loại III hoặc có thể cao hơn mức của cấp xã loại I quy định tại khoản 1 Điều này, nhưng phải bảo đảm không vượt quá tổng số lượng người hoạt động không chuyên trách ở cấp xã của cả đơn vị hành chính cấp huyện được Hội đồng nhân dân cấp tỉnh giao.

6. Người hoạt động không chuyên trách ở thôn, tổ dân phố có không quá 03 chức danh (bao gồm Bí thư chi bộ, Trưởng thôn hoặc Tổ trưởng tổ dân phố, Trưởng Ban công tác Mặt trận) được hưởng phụ cấp hàng tháng. Trường hợp Luật có quy định khác thì thực hiện theo quy định của luật đó.

Khuyến khích việc kiêm nhiệm chức danh Bí thư Chi bộ đồng thời là Trưởng thôn, Tổ trưởng tổ dân phố hoặc Trưởng Ban công tác Mặt trận thôn, tổ dân phố.

7. Người trực tiếp tham gia hoạt động ở thôn, tổ dân phố ngoài 03 chức danh quy định tại khoản 6 Điều này được hưởng hỗ trợ hàng tháng.

8. Người hoạt động không chuyên trách ở cấp xã, ở thôn, tổ dân phố được kiêm nhiệm người hoạt động không chuyên trách khác ở cấp xã, ở thôn, tổ dân phố; người hoạt động không chuyên trách ở thôn, tổ dân phố được kiêm nhiệm người trực tiếp tham gia hoạt động ở thôn, tổ dân phố.

Điều 34. Chế độ phụ cấp đối với người hoạt động không chuyên trách ở cấp xã, ở thôn, tổ dân phố

1. Người hoạt động không chuyên trách ở cấp xã được hưởng chế độ phụ cấp. Ngân sách Trung ương thực hiện khoán quỹ phụ cấp bao gồm cả hỗ trợ đóng bảo hiểm xã hội và bảo hiểm y tế để chi trả hàng tháng đối với những người hoạt động không chuyên trách ở cấp xã như sau:

a) Đơn vị hành chính cấp xã loại I được khoán quỹ phụ cấp bằng 21,0 lần mức lương cơ sở;

b) Đơn vị hành chính cấp xã loại II được khoán quỹ phụ cấp bằng 18,0 lần mức lương cơ sở;

c) Đơn vị hành chính cấp xã loại III được khoán quỹ phụ cấp bằng 15,0 lần mức lương cơ sở.

Đối với đơn vị hành chính cấp xã có số lượng người hoạt động không chuyên trách ở cấp xã tăng thêm theo quy định tại khoản 2 Điều 33 Nghị định này thì tổng mức khoán quỹ phụ cấp được tính tăng thêm tương ứng bằng 1,5 lần mức lương cơ sở/01 người hoạt động không chuyên trách tăng thêm.

2. Thực hiện khoán quỹ phụ cấp đối với những người hoạt động không chuyên trách ở thôn, tổ dân phố. Ngân sách Trung ương khoán quỹ phụ cấp để chi trả hàng tháng đối với người hoạt động không chuyên trách ở mỗi thôn, tổ dân phố như sau:

a) Đối với thôn có từ 350 hộ gia đình trở lên; tổ dân phố có từ 500 hộ gia đình trở lên; thôn, tổ dân phố thuộc đơn vị hành chính cấp xã trọng điểm, phức tạp về an ninh, trật tự theo quyết định của cơ quan có thẩm quyền; thôn, tổ dân phố thuộc đơn vị hành chính cấp xã ở khu vực biên giới, hải đảo được khoán quỹ phụ cấp bằng 6,0 lần mức lương cơ sở. Trường hợp thôn có từ 350 hộ gia đình trở lên chuyển thành tổ dân phố do thành lập đơn vị hành chính đô thị cấp xã thì được giữ mức khoán quỹ phụ cấp bằng 6,0 lần mức lương cơ sở;

b) Đối với các thôn, tổ dân phố không thuộc quy định tại điểm a khoản 2 Điều này được khoán quỹ phụ cấp bằng 4,5 lần mức lương cơ sở;

c) Trường hợp đơn vị hành chính cấp huyện không tổ chức đơn vị hành chính cấp xã thì thôn, tổ dân phố quy định tại điểm a và điểm b khoản này được xác định theo đơn vị hành chính cấp huyện đó.

3. Căn cứ vào quỹ phụ cấp được ngân sách Trung ương khoán cho mỗi cấp xã, mỗi thôn, tổ dân phố quy định tại các khoản 1, 2 Điều này; nguồn kinh phí ngân sách chi cho cải cách chính sách tiền lương của địa phương; các quy định của pháp luật có liên quan và đặc thù của từng cấp xã, từng thôn, tổ dân phố, Ủy ban nhân dân cấp tỉnh trình Hội đồng nhân dân cùng cấp quy định cụ thể những nội dung sau:

a) Chức danh người hoạt động không chuyên trách ở cấp xã;

b) Việc kiêm nhiệm chức danh người hoạt động không chuyên trách ở cấp xã, ở thôn, tổ dân phố và người hoạt động không chuyên trách ở thôn, tổ dân phố kiêm nhiệm người trực tiếp tham gia hoạt động ở thôn, tổ dân phố;

c) Mức phụ cấp của từng chức danh người hoạt động không chuyên trách ở cấp xã, ở thôn, tổ dân phố bảo đảm tương quan hợp lý với mức lương bậc 1 của công chức cấp xã có cùng trình độ đào tạo nhằm khuyến khích người hoạt động không chuyên trách ở cấp xã, ở thôn, tổ dân phố học tập nâng cao trình độ chuyên môn, nghiệp vụ; quy định cụ thể mức khoán kinh phí hoạt động của tổ chức chính trị - xã hội ở cấp xã; mức hỗ trợ hàng tháng đối với người trực tiếp tham gia hoạt động ở thôn, tổ dân phố và mức phụ cấp kiêm nhiệm người trực tiếp tham gia hoạt động ở thôn, tổ dân phố phù hợp với tình hình thực tiễn của địa phương.

4. Trường hợp người hoạt động không chuyên trách ở cấp xã, ở thôn, tổ dân phố kiêm nhiệm thực hiện nhiệm vụ của người hoạt động không chuyên trách khác ở cấp xã, ở thôn, tổ dân phố thì được hưởng phụ cấp kiêm nhiệm bằng 100% mức phụ cấp quy định của chức danh kiêm nhiệm.

5. Ủy ban nhân dân cấp tỉnh trình Hội đồng nhân dân cùng cấp quy định cụ thể các nội dung tại điểm c khoản 3 Điều này không phải xin ý kiến các Bộ, cơ quan trung ương.

Điều 35. Chế độ đào tạo, bồi dưỡng, bảo hiểm xã hội, bảo hiểm y tế đối với người hoạt động không chuyên trách ở cấp xã, ở thôn, tổ dân phố và người trực tiếp tham gia hoạt động ở thôn, tổ dân phố

1. Người hoạt động không chuyên trách ở cấp xã, ở thôn, tổ dân phố và người trực tiếp tham gia hoạt động ở thôn, tổ dân phố được đào tạo, bồi dưỡng kiến thức phù hợp với yêu cầu nhiệm vụ hiện đang đảm nhiệm; khi được cử đi đào tạo, bồi dưỡng thì được hưởng chế độ theo quy định của pháp luật.

2. Người hoạt động không chuyên trách ở cấp xã thực hiện chế độ bảo hiểm xã hội bắt buộc và bảo hiểm y tế theo quy định của pháp luật về bảo hiểm xã hội và bảo hiểm y tế.

Điều 36. Tiêu chuẩn, nhiệm vụ, bầu cử, tuyển chọn, tiếp nhận, sử dụng, quản lý, đánh giá, xếp loại, khen thưởng, kỷ luật và bãi nhiệm, miễn nhiệm, thôi việc đối với người hoạt động không chuyên trách ở cấp xã

1. Tiêu chuẩn

a) Là công dân Việt Nam, đủ 18 tuổi trở lên; có đầy đủ năng lực hành vi dân sự và có đủ sức khỏe để thực hiện nhiệm vụ được giao;

b) Có phẩm chất chính trị, đạo đức tốt; gương mẫu chấp hành chủ trương, đường lối của Đảng, chính sách, pháp luật của Nhà nước; có năng lực tổ chức thực hiện và vận động Nhân dân ở địa phương thực hiện có hiệu quả chủ trương, đường lối của Đảng, chính sách, pháp luật của Nhà nước;

c) Không trong thời gian bị truy cứu trách nhiệm hình sự, chấp hành án phạt tù, cải tạo không giam giữ, quản chế, đang bị áp dụng biện pháp giáo dục tại cấp xã hoặc đưa vào cơ sở chữa bệnh, cơ sở giáo dục;

d) Trình độ giáo dục phổ thông: Tốt nghiệp Trung học phổ thông;

đ) Trình độ chuyên môn: Tốt nghiệp Trung cấp trở lên.

2. Nhiệm vụ của người hoạt động không chuyên trách ở cấp xã

Người hoạt động không chuyên trách ở cấp xã thực hiện các nhiệm vụ theo quy định tại điều lệ tổ chức mà mình là thành viên, của pháp luật liên quan và của cấp có thẩm quyền quản lý; phối hợp, giúp cán bộ, công chức cấp xã thực hiện chức trách, nhiệm vụ được giao, đảm bảo các lĩnh vực công tác của cấp ủy, chính quyền địa phương cấp xã đều có người đảm nhiệm, theo dõi thực hiện.

3. Bầu cử, tuyển chọn người hoạt động không chuyên trách ở cấp xã

a) Các chức danh bầu cử thực hiện theo quy định của điều lệ tổ chức mà người hoạt động không chuyên trách ở cấp xã là thành viên, quy định của pháp luật có liên quan và quy định của cơ quan có thẩm quyền quản lý.

b) Các chức danh người hoạt động không chuyên trách ở cấp xã ngoài quy định tại điểm a khoản này thực hiện tuyển chọn thông qua hình thức xét tuyển.

Riêng đối với chức danh giúp việc cho Chỉ huy trưởng Ban Chỉ huy Quân sự cấp xã thực hiện theo quy định của pháp luật chuyên ngành về quân sự.

4. Đánh giá, xếp loại người hoạt động không chuyên trách ở cấp xã

a) Các chức danh bầu cử thực hiện theo quy định của điều lệ tổ chức mà người hoạt động không chuyên trách ở cấp xã là thành viên và quy định của cơ quan có thẩm quyền quản lý.

b) Người hoạt động không chuyên trách ở cấp xã giúp việc cho chính quyền địa phương cấp xã do Chủ tịch Ủy ban nhân dân cấp xã đánh giá, xếp loại.

c) Chức danh người hoạt động không chuyên trách ở cấp xã giúp việc cho Chỉ huy trưởng Ban Chỉ huy Quân sự cấp xã thực hiện theo quy định của pháp luật chuyên ngành về quân sự.

d) Nội dung, hình thức, quy trình đánh giá, xếp loại đối với người hoạt động không chuyên trách ở cấp xã áp dụng tương tự như đối với cán bộ, công chức cấp xã quy định tại Nghị định này.

5. Khen thưởng người hoạt động không chuyên trách ở cấp xã

Người hoạt động không chuyên trách ở cấp xã có thành tích trong việc thực hiện nhiệm vụ thì được xét khen thưởng theo quy định của pháp luật về thi đua khen thưởng.

6. Xử lý kỷ luật người hoạt động không chuyên trách ở cấp xã

a) Các chức danh bầu cử thực hiện xử lý kỷ luật theo quy định của điều lệ tổ chức mà người hoạt động không chuyên trách ở cấp xã là thành viên và của cơ quan có thẩm quyền quản lý.

b) Chủ tịch Ủy ban nhân dân cấp xã có thẩm quyền xem xét, quyết định kỷ luật đối với người hoạt động không chuyên trách ở cấp xã giúp việc cho chính quyền địa phương ở cấp xã.

c) Chức danh người hoạt động không chuyên trách ở cấp xã giúp việc cho Chỉ huy trưởng Ban Chỉ huy Quân sự cấp xã thực hiện theo quy định của pháp luật chuyên ngành về quân sự.

d) Nội dung, hình thức, quy trình xử lý kỷ luật đối với người hoạt động không chuyên trách ở cấp xã áp dụng tương tự như đối với cán bộ, công chức quy định tại Nghị định này.

Riêng hình thức kỷ luật thì không áp dụng hình thức hạ bậc lương.

7. Bãi nhiệm, miễn nhiệm và giải quyết thôi việc đối với người hoạt động không chuyên trách ở cấp xã

Người hoạt động không chuyên trách ở cấp xã bị bãi nhiệm, miễn nhiệm, thôi việc được hưởng chế độ, chính sách theo quy định của pháp luật có liên quan và quy định của điều lệ tổ chức mà người hoạt động không chuyên trách ở cấp xã là thành viên.

8. Ủy ban nhân dân cấp tỉnh căn cứ quy định tại các khoản 1, 2, 3, 4, 5, 6 và 7 Điều này, quy định của điều lệ tổ chức mà người hoạt động không chuyên trách ở cấp xã là thành viên và quy định của pháp luật có liên quan để quy định cụ thể việc quản lý, sử dụng đối với từng chức danh người hoạt động không chuyên trách ở cấp xã cho phù hợp với thực tiễn của từng địa phương.

9. Ủy ban nhân dân cấp huyện căn cứ nhiệm vụ quy định tại khoản 2 Điều này, quy định của Ủy ban nhân dân cấp tỉnh về quản lý, sử dụng người hoạt động không chuyên trách ở cấp xã ở địa phương và căn cứ chức danh người hoạt động không chuyên trách ở cấp xã quy định tại điểm a khoản 3 Điều 34 Nghị định này để quy định cụ thể nhiệm vụ của từng chức danh người hoạt động không chuyên trách ở cấp xã cho phù hợp với yêu cầu thực hiện nhiệm vụ của từng cấp xã.

Chương IV

ĐIỀU KHOẢN THI HÀNH

Điều 37. Hiệu lực thi hành

1. Nghị định này có hiệu lực từ ngày 01 tháng 8 năm 2023.

2. Bãi bỏ các Nghị định số 114/2003/NĐ-CP ngày 10 tháng 10 năm 2003 về cán bộ, công chức xã, phường, thị trấn; Nghị định số 112/2011/NĐ-CP ngày 05 tháng 12 năm 2011 về công chức xã, phường, thị trấn; Nghị định số 92/2009/NĐ-CP ngày 22 tháng 10 năm 2009 của Chính phủ về chức danh, số lượng, một số chế độ, chính sách đối với cán bộ, công chức ở xã, phường, thị trấn và những người hoạt động không chuyên trách ở cấp xã; Nghị định số 34/2019/NĐ-CP ngày 24 tháng 4 năm 2019 về việc sửa đổi, bổ sung một số quy định về cán bộ, công chức cấp xã và người hoạt động không chuyên trách ở cấp xã, ở thôn, tổ dân phố.

3. Tại nơi tổ chức mô hình chính quyền đô thị theo Nghị quyết của Quốc hội và quy định của Chính phủ, nếu có những quy định khác với những quy định tại Nghị định này về cán bộ, công chức cấp xã và người hoạt động không chuyên trách ở cấp xã, ở thôn, tổ dân phố thì thực hiện theo quy định của Nghị quyết của Quốc hội và quy định của Chính phủ.

4. Áp dụng việc thực hiện chế độ, chính sách quy định tại Nghị định này đối với Bí thư, Phó Bí thư chi bộ (nơi chưa thành lập Đảng ủy cấp xã) như Bí thư, Phó Bí thư Đảng ủy cấp xã; Thường trực đảng ủy (nơi không có Phó Bí thư chuyên trách công tác đảng) như Phó Bí thư Đảng ủy cấp xã.

Điều 38. Điều khoản chuyển tiếp

1. Cán bộ cấp xã đang giữ chức vụ bầu cử quy định tại khoản 1 Điều 5 mà chưa đáp ứng đủ tiêu chuẩn quy định tại Điều 8; công chức cấp xã đang giữ chức danh quy định tại khoản 2 Điều 5 mà chưa đáp ứng đủ tiêu chuẩn quy định tại Điều 10 và người hoạt động không chuyên trách ở cấp xã quy định tại điểm a khoản 3 Điều 34 mà chưa đáp ứng đủ tiêu chuẩn quy định tại khoản 1 Điều 36 Nghị định này thì trong thời hạn 05 năm kể từ ngày Nghị định này có hiệu lực thi hành phải đáp ứng đủ tiêu chuẩn theo quy định. Hết thời hạn này mà chưa đáp ứng đủ tiêu chuẩn theo quy định thì thực hiện chế độ nghỉ hưu (nếu đủ điều kiện) hoặc thực hiện chính sách tinh giản biên chế theo quy định của Chính phủ.

2. Trường hợp trong quá trình công tác mà cán bộ, công chức cấp xã có thay đổi về trình độ đào tạo chuyên môn, nghiệp vụ phù hợp với chức vụ, chức danh hiện đảm nhiệm, đã được cấp bằng tốt nghiệp và chưa được xếp lương theo trình độ đào tạo mới trước ngày Nghị định này có hiệu lực thi hành thì được xếp lương theo trình độ đào tạo mới kể từ ngày Nghị định này có hiệu lực thi hành.

3. Trường hợp cán bộ, công chức làm việc trong cơ quan, tổ chức, đơn vị từ cấp huyện trở lên được điều động, luân chuyển, biệt phái về làm cán bộ, công chức cấp xã thì tiếp tục được thực hiện việc xếp lương, nâng bậc lương và phụ cấp thâm niên vượt khung theo quy định của Chính phủ về chế độ tiền lương đối với cán bộ, công chức, viên chức và lực lượng vũ trang.

4. Cán bộ cấp xã là người đang hưởng chế độ hưu trí hoặc trợ cấp mất sức lao động, ngoài lương hưu hoặc trợ cấp mất sức lao động hàng tháng hiện hưởng được xếp, hưởng lương và các chế độ phụ cấp theo chức vụ hiện đảm nhiệm quy định tại Nghị định này và không phải đóng bảo hiểm xã hội, bảo hiểm y tế.

5. Cán bộ, công chức cấp xã là người đang hưởng chế độ thương binh, bệnh binh các hạng mà không thuộc đối tượng đang hưởng chế độ hưu trí hoặc trợ cấp mất sức lao động, ngoài chế độ thương binh, bệnh binh hàng tháng hiện hưởng được xếp, hưởng lương và các chế độ phụ cấp theo chức vụ cán bộ hoặc chức danh công chức hiện đảm nhiệm quy định tại Nghị định này.

6. Cán bộ cấp xã già yếu, nghỉ việc theo Quyết định số 130/CP ngày 30 tháng 6 năm 1975 của Hội đồng Chính phủ và Quyết định số 111/HĐBT ngày 13 tháng 10 năm 1981 của Hội đồng Bộ trưởng (nay là Chính phủ) được điều chỉnh mức trợ cấp hàng tháng khi nhà nước điều chỉnh mức lương cơ sở; được chuyển trợ cấp đến nơi ở mới hợp pháp; khi từ trần thì người lo mai táng được nhận tiền mai táng phí bằng 10 lần mức lương cơ sở.

Trường hợp cán bộ cấp xã già yếu, nghỉ việc bị tạm dừng hưởng chế độ trợ cấp hàng tháng trong thời gian chấp hành hình phạt tù, nay có đơn đề nghị kèm theo bản sao giấy chứng nhận đã chấp hành xong hình phạt tù gửi Ủy ban nhân dân cấp huyện xem xét, giải quyết để tiếp tục hưởng chế độ trợ cấp hàng tháng.

7. Cán bộ cấp xã có thời gian đảm nhiệm chức danh khác thuộc Ủy ban nhân dân theo quy định tại khoản 5 Điều 3 Nghị định số 09/1998/NĐ-CP ngày 23 tháng 01 năm 1998 của Chính phủ sửa đổi, bổ sung Nghị định số 50/CP ngày 26 tháng 7 năm 1995 của Chính phủ về chế độ sinh hoạt phí đối với cán bộ xã, phường, thị trấn (sau đây gọi chung là Nghị định số 09/1998/NĐ-CP) đã đóng bảo hiểm xã hội theo chức danh này mà chưa được hưởng trợ cấp một lần thì được tính là thời gian có đóng bảo hiểm xã hội để tính hưởng chế độ bảo hiểm xã hội.

Đối với trường hợp giữ chức danh khác thuộc Ủy ban nhân dân nhưng chưa đóng bảo hiểm xã hội thì được truy nộp tiền đóng bảo hiểm xã hội để làm cơ sở tính hưởng bảo hiểm xã hội.

8. Cán bộ cấp xã có thời gian đóng bảo hiểm xã hội theo quy định tại Nghị định số 09/1998/NĐ-CP mà chưa hưởng trợ cấp một lần thì thời gian làm việc có đóng bảo hiểm xã hội được tính là thời gian để hưởng bảo hiểm xã hội hoặc được cộng nối với thời gian tham gia bảo hiểm xã hội tự nguyện, bảo hiểm xã hội bắt buộc để tính hưởng chế độ bảo hiểm xã hội theo quy định của pháp luật về bảo hiểm xã hội.

Đối với trường hợp cán bộ cấp xã đã được giải quyết hưởng trợ cấp hàng tháng hoặc hưởng trợ cấp một lần trước ngày Nghị định này có hiệu lực thì không áp dụng quy định tại Nghị định này để giải quyết lại.

9. Những người đã có thời gian làm cán bộ cấp xã trước ngày 01 tháng 01 năm 1998, nếu trong thời gian công tác này mà đảm nhiệm chức danh có quy định tại Nghị định số 09/1998/NĐ-CP và được điều động, tuyển dụng vào quân đội nhân dân, công an nhân dân hoặc vào làm việc trong các cơ quan, đơn vị, doanh nghiệp của Nhà nước, tổ chức chính trị, tổ chức chính trị - xã hội thì thời gian đảm nhiệm chức danh trước ngày 01 tháng 01 năm 1998 nếu chưa được tính hưởng trợ cấp hàng tháng hoặc trợ cấp một lần được tính là thời gian đã đóng bảo hiểm xã hội.

10. Trường hợp thực hiện sắp xếp đơn vị hành chính cấp xã theo Nghị quyết của Ủy ban thường vụ Quốc hội thì số lượng và việc bố trí, giải quyết chế độ, chính sách đối với cán bộ, công chức cấp xã và người hoạt động không chuyên trách ở cấp xã, ở thôn, tổ dân phố thực hiện theo quy định của cơ quan có thẩm quyền.

Điều 39. Nguồn kinh phí thực hiện chế độ, chính sách đối với cán bộ, công chức cấp xã, người hoạt động không chuyên trách ở cấp xã, ở thôn, tổ dân phố và người trực tiếp tham gia hoạt động ở thôn, tổ dân phố

1. Nguồn kinh phí để thực hiện chế độ, chính sách đối với cán bộ, công chức cấp xã và người hoạt động không chuyên trách ở cấp xã, ở thôn, tổ dân phố, người trực tiếp tham gia hoạt động ở thôn, tổ dân phố; cán bộ cấp xã già yếu nghỉ việc quy định tại khoản 6 Điều 38 Nghị định này do ngân sách nhà nước bảo đảm theo phân cấp ngân sách hiện hành.

2. Quỹ Bảo hiểm xã hội bảo đảm kinh phí chi trả các chế độ theo quy định của pháp luật về bảo hiểm xã hội đối với cán bộ, công chức cấp xã và người hoạt động không chuyên trách ở cấp xã.

Điều 40. Trách nhiệm thi hành

1. Ủy ban nhân dân cấp tỉnh trình Hội đồng nhân dân cùng cấp bố trí kinh phí thực hiện các chế độ, chính sách theo quy định tại Nghị định này.

2. Bảo hiểm Xã hội Việt Nam hướng dẫn, kiểm tra Bảo hiểm xã hội cấp tỉnh, cấp huyện thực hiện chế độ bảo hiểm xã hội đối với cán bộ, công chức cấp xã theo quy định của Nghị định này.

3. Các Bộ, cơ quan ngang Bộ rà soát quy định của pháp luật về cán bộ, công chức cấp xã, người hoạt động không chuyên trách ở cấp xã, ở thôn, tổ dân phố thuộc phạm vi quản lý bảo đảm phù hợp với quy định tại Nghị định này.

4. Ủy ban nhân dân cấp tỉnh hướng dẫn việc kiêm nhiệm các chức danh để bảo đảm các lĩnh vực công tác ở địa phương đều có cán bộ, công chức đảm nhiệm; bố trí, hướng dẫn, kiểm tra việc sử dụng nguồn kinh phí để thực hiện chế độ, chính sách đối với cán bộ, công chức cấp xã, người hoạt động không chuyên trách ở cấp xã, ở thôn, tổ dân phố và người trực tiếp tham gia hoạt động ở thôn, tổ dân phố theo quy định tại Nghị định này.

5. Ủy ban nhân dân cấp huyện hướng dẫn, kiểm tra Ủy ban nhân dân cấp xã trong việc thực hiện chế độ, chính sách đối với cán bộ, công chức cấp xã và người hoạt động không chuyên trách ở cấp xã, ở thôn, tổ dân phố, người trực tiếp tham gia hoạt động ở thôn, tổ dân phố theo quy định của Ủy ban nhân dân cấp tỉnh và theo quy định tại Nghị định này.

6. Bộ trưởng, Thủ trưởng cơ quan ngang bộ, Thủ trưởng cơ quan thuộc Chính phủ, Chủ tịch Ủy ban nhân dân tỉnh, thành phố trực thuộc trung ương và các cơ quan, tổ chức, cá nhân có liên quan chịu trách nhiệm thi hành Nghị định này./.

Chapter I

Article 2. Regulated entities

1. The commune-level officials prescribed in Clause 3 Article 4 and Article 61 of the Law on Officials in 2008 (which is amended in 2019).

2. Part-time officials of communes and neighborhoods.

Article 3. Rules for management of commune-level officials and part-time officials of communes and neighborhoods

1. Ensure the unified leadership of the CPV.

2. Ensure the Democratic centralism and strengthen roles and responsibilities of leaders of agencies, organizations and units.

3. Combine standards of positions, titles and quantity of commune-level officials with quantity and titles of part-time officials of communes and neighborhoods.

Article 4. Responsibilities of commune-level officials and part-time officials of communes and neighborhoods

Commune-level officials and part-time officials of communes and neighborhoods shall be responsible for complying with the regulations herein, organizational charters and regulations of relevant law.

COMMUNE-LEVEL OFFICIALS

Section 1. Positions, titles and quantity of commune-level officials

Article 5. Positions, titles

1. The commune-level officials prescribed in Clause 1 Article 2 hereof shall hold the following positions:

a) Secretary, Deputy Secretary of the Communist Party Committee;

b) Chairperson and Vice Chairpersons of the People's Council;

c) Chairperson and Vice Chairpersons of the People's Committee;

d) Chairperson of Vietnam Fatherland Front Central Committee;

dd) Secretary of the Ho Chi Minh Communist Youth Union.

g) Chairperson of Vietnam Farmer’s Union (applicable to communes, wards, townships engaged in agricultural, forestry, fishery and salt production activities and involved in Vietnam Farmers' Union.

h) Chairperson of Vietnam War Veteran Association;

2. The commune-level officials prescribed in Clause 1 Article 2 hereof shall hold the following titles:

a) The commanding officer of Military Command;

b) Office administration/management - statistical officials;

c) Cadastral - construction - urban and environment officials (for wards and townships) or Cadastral - agriculture - construction and environment officials (for communes);

d) Finance - accounting officials;

dd) Judicial - Civil status officials;

e) Socio - Cultural officials.

1. The commune-level officials are classified according to third-level administrative subdivisions. To be specific:

a) Wards: Class-I: 23 persons; Class-II: 21 persons; Class-III: 19 persons;

b) Communes and townships: Class-I: 22 persons; Class-II: 20 persons; Class-III: 18 persons;

2. The provincial People’s Committees shall, based on the number of third-level administrative subdivisions where population sizes and natural areas are higher than the standard sizes prescribed in the Resolution of the Standing Committee of National Assembly on standards of administrative divisions and classification of administrative divisions, calculate the increasing number of officials of communes as follows:

a) If the population of any ward of an urban district increases by every one-third (1/3) of the prescribed population size, 01 more official may be newly recruited. If the population of any of the remaining third-level administrative subdivisions increases by every half (1/2) of the prescribed population size, 01 more official may be newly recruited.

b) In addition to increase in the number of officials according to the population size prescribed in Point a of this Clause, if the population of any of the third-level administrative subdivisions increases by one hundred percent (100%) of the prescribed natural area, 01 more official may be newly recruited.

3. The population size (including permanent resident population and temporary resident population converted) and natural area calculated til December 31 of every year to determine the number of commune-level officials prescribed in Clause 2 of this Article shall comply with the Resolution of the Standing Committee of National Assembly on standards of administrative divisions and classification of administrative divisions.

In case, in third-level administrative subdivisions, on and by December 31 of every year, there is a change in the population size and natural area prescribed in Clause 2 of this Article, or there is a change in levels of administrative divisions, the provincial People’s Committees shall propose to the People's Councils at the same level consideration for adjustment to the total number of commune-level officials (including first-level administrative subdivisions) to be in accordance with regulations.

4. Annually, the provincial People’s Committees shall propose to the People's Councils at the same level decision on the number of commune-level officials for each second-level administrative subdivision under their management in accordance with realistic demands, but it must be ensured that the total commune-level officials of second-level administrative subdivisions shall not exceed the total commune-level officials of first-level administrative subdivisions according to the regulations in Clauses 1 and 2 of this Article.

6. The number of commune-level officials prescribed in this Article including persons who are given pensions or a loss of earning capacity benefits (LOEC benefit) voted for holding positions of commune-level officials shall be rotated, assigned and seconded to third-level administrative subdivisions.

In case an official is rotated to hold the position of the Vice Chairperson of the People’s Committee of a commune, regulations of the Government on the number of Vice Chairpersons of the People’s Committee and procedures for election, resignation, dismissal and assignment of members of the People's Committee shall be applied.

Section 2. Standards and tasks of COMMUNE-LEVEL OFFICIALS

Article 7. General standards of commune-level officials

1. General standards of commune-level officials shall be applied according to applicable regulations of law on officials, organizational charters and regulations of the CPV and of socio-political organizations at the central level.

2. Officials who are Commanding Officers of Military Commands of communes shall not only meet the standards prescribed in Clause 1 of this Article but also have the capacity to cooperate with units of people's army, people's police and other forces in these communes in developing the all-people national defense, performing civil defense duties; maintaining security, politics, social order and safety, protecting the CPV, government and property of the State and protecting the people's lives and property.

Article 8. Standards of each position of commune-level officials

1. Secretary, Deputy Secretary of the Communist Party Committee:

a) Age: when officials participate in holding these positions for the first time, they must have served at least 01 term of office (60 months); For particular cases, they shall abide by decisions of authorities competent to manage officials;

c) Professional level: officials must have tertiary education degrees. If otherwise prescribed by the CPV charter, the regulations of the CPV charter shall be applied;

d) Political theory level: officials must have graduated from intermediate schools or equivalent or higher. If otherwise prescribed by the CPV charter, the regulations of the CPV charter shall be applied;

dd) For other standards, regulations of the CPV and authorities competent to manage officials shall be applied.

2. The Chairperson of Vietnam Fatherland Front Central Committee, Secretary of Ho Chi Minh Communist Youth Union, Chairperson of Vietnam Women’s Union, Chairperson of Vietnam Farmer’s Union, Chairperson of Vietnam War Veteran Association at the commune-level:

a) Ages of officials shall comply with regulations of law, organizational charters and regulations of socio-political organizations at the central level.

b) Education level: officials must have graduated from high schools;

c) Professional level: officials must have tertiary education degrees. If otherwise prescribed by laws and organizational charters, regulations of such laws and organizations shall be applied;

d) Political theory level: officials must have graduated from intermediate schools or equivalent or higher. If otherwise prescribed by laws and organizational charters, regulations of such laws and charters shall be applied;

dd) For other standards, regulations of the CPV, socio-political organizations at the central level and authorities competent to manage officials shall be applied.

4. The Provincial People’s Committees shall provide specific regulations on the professional qualification of from intermediate level or higher for commune-level officials working in communes, wards and townships of mountainous regions, highland areas, border regions, islands, island communes, remote areas, ethnic minority areas and areas with extremely difficult socio-economic conditions.

5. On the basis of the standards of each position of commune-level officials prescribed in this Article, the provincial People’s Committees shall provide specific standards of each title of commune-level officials in a manner that is satisfactory to characteristics and requirements for task performance of each commune level and is not lower than the standards prescribed in this Decree.

Article 9. Tasks of each position of commune-level officials

1. Secretary of the Communist Party Committee of a commune shall

a) Taking charge and directing the formulation of the working regulations, annually, quarterly and monthly work contents and plans of the Executive Committee and the Standing Committee;

b) Assigning tasks to members of the Executive Committee and the Standing Committee;

c) Directing formulation and approval of annually, quarterly and monthly work plans and regular tasks of members of the Executive Committee, the Standing Committee;

d) Inspecting, urging and regulating activities of members of the Executive Committee and the Standing Committee in terms of execution of work programs and plans;

dd) Monitoring and evaluating the implementation of work plans of each member of the Executive Committee and the Standing Committee;

e) Directing the implementation of resolutions and conclusions of the Executive Committee and the Standing Committee and directives and resolutions of the CPV and superior authorities;

g) Signing documents according to working regulations of the Executive Committee and the Standing Committee;

h) Periodically or ad hoc reporting the operation of the Executive Committee and the Standing Committee to superior authorities of the CPV;

i) Directing preliminary and final review of the annual, 6-month, quarterly, monthly and weekly work according to regulations;

l) Being responsible for the use of finance and property assigned by competent authorities to the Communist Party Committee of the commune according to regulations;

m) Summoning and presiding over periodic and ad hoc conferences and meetings;

n) Performing other tasks according to regulations of the CPV, relevant laws and authorities competent to manage officials.

2. Deputy Secretary of the Communist Party Committee of a commune shall

a) Perform tasks according to the assignment of the Executive Committee and Standing Committee and the Secretary of the Communist Party Committee of the commune;

b) Assist the Secretary of the Communist Party Committee of the commune in directing operations of the Communist Party Committee of the commune within its jurisdiction; sign assigned documents; resolve tasks of the Communist Party Committee of the commune according to the authorization of the Secretary of the Communist Party Committee of the commune;

c) Preside over or participate in conferences and meetings according to the assignment of the Secretary of the Communist Party Committee; summon and preside over periodic and ad hoc meetings according to the assignment of the Secretary of the Communist Party Committee or the working regulations of the Executive Committee and the Standing Committee;

d) Directly implement in other directions of the Secretary of the Communist Party Committee or according to the working regulations of the Executive Committee and the Standing Committee;

dd) Perform other tasks according to regulations of the CPV, relevant laws and authorities competent to manage officials.

Direct operations of the Standing People’s Council, committees of the People's Council of the commune. On behalf of the Standing People’s Council of the commune, maintain the relationship with the People’s Committee, regulatory agencies, the Standing Committee of the Vietnam Fatherland Front Central Committee, members of the Vietnamese Fatherland Front at the same level, other social organizations and citizens. Perform tasks and entitlements according to regulations of law, the working regulations of the People's Council and the following tasks:

a) Taking charge of building working regulations, annual, quarterly and monthly work contents and plans of the Communal People's Council;

b) Assigning tasks in the Standing People's Council of the commune;

c) Directing formulation and approval of annual, quarterly and monthly work plans of the Standing People's Council and Committees of the People's Council of the commune;

d) Inspecting, urging and regulating activities of members of the Standing People's Council of the commune in terms of execution of work programs and plans;

dd) Monitoring and evaluating the execution of work programs and plans of each member of the Standing People's Council of the commune;

e) Directing the implementation of resolutions and conclusions of the Standing People's Council of the commune and superior regulatory agencies;

g) Signing documents according to rules and working regulations of the Standing People's Council of the commune;

h) Periodically reporting the operation of the People's Council, the Standing People's Council of the commune to superior authorities;

k) Being a representative of the People's Council, the Standing People's Council of the commune in a working relationship with communal and superior authorities; authorizing Deputy Chairpersons of the communal People's Council to perform the Chairperson’s tasks when absenting at the office according to the working regulations of the communal People's Council;

l) Being responsible for the use of finance and property assigned by competent authorities to the communal People's Council according to regulations;

m) Summoning and presiding over periodic and ad hoc conferences and meetings;

n) Performing other tasks according to regulations of the CPV, relevant laws and authorities competent to manage officials.

4. The Vice Chairpersons of the People's Council of a commune shall;

a) Perform tasks according to the assignment of the Standing People's Council and the Chairperson of the People's Council of the commune;

b) Assist the Chairperson of the communal People's Council in directing operations of the Standing People's Council and committees of the People's Council of the commune under his/her authority; sign documents and resolve tasks of the Standing People's Council according to the authorization of the Chairperson of the People's Council;

c) Preside over or participate in conferences and meetings according to the assignment of the Chairperson of the People's Council; summon and preside over periodic and ad hoc meetings according to the assignment of the Standing People's Council of the commune or the working regulations of the communal People's Council;

d) Perform other tasks according to regulations of the CPV, relevant laws and authorities competent to manage officials.

a) Manage operations of the People’s Committee, members of the People’s Committee of the commune

b) Direct the performance of tasks in terms of organization and assurance of the implementation of the Constitution, law and documents of superior regulatory agencies, the People's Council and People’s Committee of the commune; perform tasks in terms of national defense, security and assurance of social order and safety, combat, prevention and control of crimes and other violations against law; prevent and control bureaucracy and corruption; organize implementation of measures to protect property of agencies, organizations and protect the life, freedom, honor, dignity, property, other lawful rights and interests of citizens; implement measures to manage population in the commune according to regulations of law;

c) Manage and organize the effective use of Government offices, property, working facilities and allocated state budget as prescribed by law;

d) Handle complaints and denunciations, handle violations against law, receive citizens according to regulations of law;

dd) Authorize Vice Chairpersons of the communal People’s Committee to perform tasks and entitlements within the competence of the Chairperson of the communal People’s Committee;

e) Direct implementation of measures to protect environment, prevent and control fire and explosion; apply measures to solve unexpected and urgent tasks in prevention and control of natural disasters, epidemics, security, social order and safety in the commune according to regulations of law;

g) Perform tasks and entitlements according to the authorization of superior regulatory agencies;

h) Perform other tasks according to regulations of the CPV, the Law on Organization of the Local Government, relevant laws and authorities competent to manage officials.

6. The Vice Chairpersons of the People’s Committee of a commune shall:

b) Take personal responsibility to the Chairperson of the communal People’s Committee for the assigned fields of work and their decisions and management; collaborate with the Chairperson of the communal People’s Committee and members of the communal People’s Committee in taking collective responsibility for the entire operation of the communal People’s Committee before the Communist Party Committee, the People's Council of the commune, the superior People’s Committee and the Chairperson of the superior People’s Committee. For issues beyond the competence of the Vice Chairpersons of the communal People’s Committee, they must report to the Chairperson of the communal People’s Committee for consideration and decision;

c) During the performance of tasks, if there is any problem relating to the competence and responsibility to deal with the tasks with the other Vice Chairpersons of the People’s Committee, they shall proactively discuss and cooperate to reach an agreement on solutions; if there still has a difference in opinions of these Vice Chairpersons, they shall report to the Chairperson of the communal People’s Committee for consideration and decision;

d) Perform other tasks according to regulations of the CPV, relevant laws and authorities competent to manage officials and according to the assignment of the Chairperson of the communal People’s Committee.

7. The Chairperson of Vietnam Fatherland Front Central Committee of a commune shall

Direct and collaborate with members of the Standing Committee of the Vietnam Fatherland Front Central Committee of the commune in performing the following tasks:

a) Summoning and presiding over conferences and meetings of Vietnam Fatherland Front Central Committee of the commune;

b) Organizing implementation of resolutions on and annual and 6-month programs for cooperation and unified action of Vietnam Fatherland Front Central Committee at the same level and the Vietnam Fatherland Front Central Committee at the higher level; the CPV's guidelines and policies, regulations of law, resolutions of the People's Council, decisions of the People’s Committee related to the tasks and entitlements of the Vietnam Fatherland Front Central Committee of the commune;

c) Regularly collecting opinions and petitions of electors and the people to respond and propose to Executive Committees of the CPV, the government and the Standing Committee of the Vietnam Fatherland Front Central Committee at the higher level;

d) Offering suggestions and proposals to Executive Committees of the CPV and the government at the same level concerning the implementation of policies and laws in the commune; implementing regulations of law on grassroots democracy, combat against bureaucracy, corruption, wastefulness, social evils; supervising operations of regulatory agencies and officials according to regulations of the CPV and law;

e) Directing and guiding operations of the Front Work Department, the People’s Inspection Commission, the Public Investment Supervision Board;

g) Maintaining the collaborative relationship with the government and members at the same level;

h) Guiding operations of consulting organizations and collaborators of Vietnam Fatherland Front Central Committee of the commune;

i) Directing formulation and promulgation of decisions and regulations on cooperation of Vietnam Fatherland Front Central Committee of the commune and organizing implementation of such documents;

k) Summoning and presiding over conferences and meetings of Vietnam Fatherland Front Central Committee of the commune; directing the budgetary planning, implementation and settlement of operating expenses and decision to allocate operating funds provided by the State to Vietnam Fatherland Front Central Committee of the commune;

l) Considering and deciding to commend and reward or penalize within his/her competence;

m) Perform other tasks according to regulations of the CPV, relevant laws, regulations of central socio-political organizations of the central government and authorities competent to manage officials.

8. The Secretary of Ho Chi Minh Communist Youth Union of a commune shall

Direct and collaborate with members of the Executive Committee and Standing Committee of Ho Chi Minh Communist Youth Union of the commune in performing the following tasks:

b) Cooperating with the local government of the commune, socio-political organizations at the same level in mobilizing and guiding officials and members of Ho Chi Minh Communist Youth Union of the commune to participate in execution of programs for socio-economic development and assurance about national defense and security, and emulation movements of Ho Chi Minh Communist Youth Union of the commune according to programs and resolutions proposed by of superior socio-political organizations;

c) Offering suggestions and proposals to Executive Committees of the CPV and the government at the same level concerning the implementation of policies and laws in the commune; implementing regulations of law on grassroots democracy, combat against bureaucracy, corruption, wastefulness, social evils; supervising operations of regulatory agencies and officials according to regulations of law;

d) Organizing implementation of resolutions, conclusions of the CPV and regulations of law; resolutions for members of Ho Chi Minh Communist Youth Union of the commune;

dd) Preparing contents, summoning and presiding over conferences and meetings of the Executive Committee and the Standing Committee;

e) Directing the budgetary planning, implementation and settlement of operating expenses and decision to allocate operating funds provided by the State to Ho Chi Minh Communist Youth Union of the commune;

g) Closely monitoring movements, periodically inspecting, evaluating and reporting to the Executive Committees of the CPV at the same level and the superior Ho Chi Minh Communist Youth Union on operations of Ho Chi Minh Communist Youth Union of the commune;

h) Directing operations of the Executive Committee and the Standing Committee according to the promulgated operating regulations;

i) Performing other tasks according to regulations of the CPV, relevant laws, regulations of central socio-political organizations of the central government and authorities competent to manage officials.

9. The Chairperson of Vietnam Women’s Union of a commune shall

a) Directing formulation and organizing implementation of operating regulations of the Executive Committee and the Standing Committee of Vietnam Women’s Union of the commune; developing work programs and plans and providing instructions on implementation for branches in villages and neighborhoods;

b) Cooperating with the local government of the commune, socio-political organizations at the same level in mobilizing and guiding officials and members of Vietnam Women’s Union of the commune to participate in execution of programs for socio-economic development and assurance about national defense and security, and emulation movements of Vietnam Women’s Union of the commune according to programs and resolutions proposed by of superior socio-political organizations;

c) Offering suggestions and proposals to Executive Committees of the CPV and the government at the same level concerning the implementation of policies and laws in the commune; implementing regulations of law on grassroots democracy, combat against bureaucracy, corruption, wastefulness, social evils; supervising operations of regulatory agencies and officials according to regulations of law;

e) Directing the budgetary planning, implementation and settlement of operating expenses and decision to allocate operating funds provided by the State to Vietnam Women’s Union of the commune;

g) Closely monitoring movements, periodically inspecting, evaluating and reporting to the Executive Committees of the CPV at the same level and the superior Vietnam Women’s Union on the operation of Vietnam Women’s Union of the commune;

h) Directing operations of the Executive Committee and the Standing Committee according to the promulgated operating regulations;

i) Performing other tasks according to regulations of the CPV, relevant laws, regulations of central socio-political organizations of the central government and authorities competent to manage officials.

b) Cooperating with the local government of the commune, socio-political organizations at the same level in mobilizing and guiding officials and members of Vietnam Farmer’s Union of the commune to participate in execution of programs for socio-economic development and assurance about national defense and security, and emulation movements of Vietnam Farmer’s Union of the commune according to programs and resolutions proposed by of superior socio-political organizations;

c) Offering suggestions and proposals to Executive Committees of the CPV and the government at the same level concerning the implementation of policies and laws in the commune; implementing regulations of law on grassroots democracy, combat against bureaucracy, corruption, wastefulness, social evils; supervising operations of regulatory agencies and officials according to regulations of law;

d) Organizing implementation of resolutions, conclusions of the CPV and regulations of law; resolutions for members of Vietnam Farmer’s Union of the commune;

dd) Summoning and presiding over conferences and meetings of the Executive Committee and the Standing Committee;

e) Directing the budgetary planning, implementation and settlement of operating expenses and decision to allocate operating funds provided by the State to Vietnam Farmer’s Union of the commune;

g) Closely monitoring movements, periodically inspecting, evaluating and reporting to the Executive Committees of the CPV at the same level and the superior Vietnam Farmer’s Union on the operation of Vietnam Farmer’s Union of the commune;

h) Directing operations of the Executive Committee and the Standing Committee according to the promulgated operating regulations;

11. The Chairperson of Vietnam War Veteran Association of a commune shall

Direct and collaborate with members of the Executive Committee and the Standing Committee of Vietnam War Veteran Association of the commune in performing the following tasks:

a) Directing formulation of operating regulations of the Executive Committee and the Standing Committee of Vietnam War Veteran Association of the commune; developing work programs and plans and providing instructions on implementation for branches in villages and neighborhoods;

b) Participating in development and protection of the CPV, the government and the socialist state; protecting the life, property of the People, property of the State; fighting against all plots and destructive activities of hostile forces; fighting against views that are contrary to the CPV’s guidelines and policies and the State's laws; implementing regulations of the law on grassroots democracy, fighting against bureaucracy, corruption, wastefulness and social evils; supervising activities of regulatory agencies and officials according to regulations of law;

c) Participating in socio-economic development, consolidating national defense and security; petitioning regulatory agencies and the local government for formulation and organization of implementation of policies and laws relating to veterans and veterans’ organizations;

d) Gathering, uniting, and encouraging veterans to practice, preserve revolutionary morals and qualities, improve political bravery, understanding of the CPV’s guidelines and policies and the State's laws, knowledge of economy, culture, science - technology, good performance of civic duties; gathering servicepersons who have completed their military service to continue promoting the tradition of "Uncle Ho's soldiers", participating in organization of Veterans Liaison Committees, clubs and other grassroots movements;

dd) Organizing assistance for veterans in the commune in improving material and spiritual aspects of life, developing family economy, eliminating hunger, reducing poverty, and getting rich legally; organizing gratitude activities for veterans to help each other in life;

e) Protecting the legitimate rights and interests of veterans; disseminating and educating laws, providing legal advice and legal aid for veterans;

g) Cooperating with Ho Chi Minh Communist Youth Union, other members of Vietnamese Fatherland Front, military agencies in educating the patriotic tradition, revolutionary heroism and self-reliance for the young generation;

i) Directing operations of the Executive Committee and the Standing Committee according to the promulgated operating regulations;

k) Perform other tasks according to regulations of the CPV, relevant laws, regulations of central socio-political organizations of the central government and authorities competent to manage officials.

12. On the basis of the standards of each position of commune-level officials prescribed in this Article, the district-level People’s Committees shall prescribe specific tasks of each position of commune-level officials in a manner that is satisfactory to characteristics and requirements for task performance of each commune level and ensures that officials are sent to all fields of work.

Article 10. Standards of each title of commune-level officials

1. Standards of Commanding Officers of Military Commands of communes shall comply with relevant military law provisions.

2. Standards of Office administration/management - statistical officials; Cadastral - construction - urban and environment officials (for wards and townships) or Cadastral - agriculture - construction and environment officials (for communes); Finance - accounting officials; Judicial - civil status officials; Socio-cultural officials shall be as follows:

a) Age: from at least 18 years of age;

b) Education level: graduated from high schools;

c) Professional qualifications: have tertiary education degrees in disciplines appropriate to requirements and tasks of each title of commune-level officials. If otherwise prescribed by laws, regulations of such laws shall be applied.

4. On the basis of the standards of each title of commune-level officials prescribed in Clause 2 of this Article and current conditions of communes, the provincial People’s Committees shall provide:

a) Specific standards of each title of commune-level officials in a manner that is satisfactory to characteristics and requirements for task performance of each commune level and is not lower than the standards prescribed herein;

b) Disciplines appropriate to requirements and tasks of each title of commune-level officials in each recruitment process;

c) Development of plans for creation of human resources and training for each title of commune-level officials in state management, political theory; foreign languages, informatics, minority languages (for areas where minority languages must be used in their assignment), implementation of regulations, policies and downsizing.

Article 11. Tasks of each title of commune-level officials

1. The Commanding Officer of Military Command of a commune shall:

a) Offer counseling and proposals to the Communist Party Committee, People's Council and People’s Committee of the commune on guidelines, measures and solutions to management of performance of national defense and military tasks; build militia and reserve forces; cooperate with socio-political organizations in performing national defense and military tasks in the commune;

b) Cooperate with units of people's army, people's police and other forces in these communes in developing the all-people national defense, civil defense areas; maintain security, politics, social order and safety;

c) Cooperate with units of border guard, navy, coast guard and other forces in protecting national sovereignty and border security and sovereignty and sovereign rights over Vietnam's seas;

dd) Assist the Chairperson of the People’s Committee of the commune in registration and management of citizens who are in the age of military service, reservists and militia and self-defense forces according to regulations of law, and mobilization and conscription of younger persons for military service;

e) Act as an advisor for the Military Service Board of the commune to handle violations according to regulations of the Law on Military Service;

g) Assist the Chairperson of the People’s Committee of the commune in building and directing the militia to cooperate with the police and other forces in protecting security and order, being ready for fighting and organizing disaster recovery, evacuation and rescue;

h) Take charge of cooperation with socio-political organizations in providing national defense education in the commune;

i) Assist the People’s Committee of the commune in implementing policies on the rear of the army and adopting policies on rear service and regimes and policies for militia and reservists in accordance with law;

k) Perform other tasks according to the assignment of the Chairperson of the communal People’s Committee and of the district-level Military Command and regulations of law on national defense.

2. An office administration/management - statistical official shall

a) Act as an advisor for the People's Council, the Standing People's Council, the People’s Committee and the Chairperson of the People’s Committee of the commune to formulate and monitor the execution of periodic and ad hoc work programs, plans and working schedules;

b) Cooperate with other officials in preparing material and technical conditions to organize sessions of the People's Council, sessions of the People’s Committee and other activities of the People's Council, the Standing People’s Council and the People’s Committee of the commune; electing members of the National Assembly, members of the People's Councils at all levels and members of the communal People’s Committee;

d) Act as an advisor for the communal People’s Committee to implement single-window system and interlinked single-window system; organize a unit receiving, processing and informing results of handling of administrative procedures of the communal People’s Committee; build an electronic Government, information technology, digital transformation; control administrative procedures;

dd) Assist the communal People’s Committee in setting up statistical schedules, organizing statistical surveys according to regulations of law on statistics; consolidating, listing and managing database according to fields in the commune (including database on commune-level officials and part-time officials of communes and neighborhoods); performing clerical work, archiving, emulation and commendation;

e) Take charge and cooperate with other officials in monitoring implementation of socio-economic development plans; consolidating and listing results of application of socio-economic development targets in the commune according to regulations of law;

g) Perform other tasks according to the assignment of the Chairperson of the communal People’s Committee and regulations of relevant laws.

3. A Cadastral - construction - urban and environment official of a ward or a township or a cadastral - agriculture - construction and environment official of a commune shall:

a) Act as an advisor for the communal People’s Committee to organize performance of tasks and entitlements of the People’s Committee, the Chairperson of the People’s Committee of the commune in fields of management of land, administrative boundaries, natural resources, environment, construction, urban areas, transport, agriculture and rural areas in the commune according to regulations of law;

b) Act as an advisor for the communal People’s Committee to develop and carry out sector and field, socio-economic development plannings and plans under the authority of the communal People’s Committee or of superior authorities that have approved them to be carried out in the commune;

c) Collect information, consolidate data, preserve dossiers and prepare reports relating to the authority to manage land, administrative boundaries, natural resources, environment, construction, urban areas, transport, agriculture and rural areas in the commune of the communal People’s Committee;

d) Act as an advisor for the communal People’s Committee to propose to the district-level People’s Committee a decision on land grant, land expropriation, issuance of land use right certificates for household businesses and individuals; make cadastral registers for legal land owners; instruct investigation procedures to confirm organizations, household businesses and individuals who register land and exercise civil rights related to land in the commune; cooperate with other officials in following administrative procedures for receiving dossiers and organizing investigations to confirm origins and status of registration and use of land, status of land disputes and changes in land in the commune;

e) Take charge of works in the fields of land, administrative boundaries, natural resources, environment, construction, urban areas, transport, agriculture and rural areas at the One-stop shop and interconnected one-stop shop of the Government office according to the assignment of the Chairperson of the communal People’s Committee;

g) Perform other tasks according to the assignment of the Chairperson of the communal People’s Committee and regulations of relevant laws.

4. A finance and accounting official shall:

a) Act as an advisor for the communal People’s Committee to organize performance of tasks and entitlements of the communal People’s Committee in fields of finance and budget in the commune in accordance with law;

b) Act as an advisor for the communal People’s Committee to make estimates of commune-level budget revenues and expenditures and submit them to the communal People's Council for approval; organize implementation of budget revenue and expenditure estimates and measures to exploit revenue sources in the commune;

c) Organize financial and budgetary activities under the guidance of superior financial authorities; settle the commune budget and make financial and budget statements according to regulations of law;

d) Assist the communal People’s Committee in managing capital sources of basic construction investment projects and public assets of the commune; inspect and make statements on construction investment projects under management of the communal People’s Committee;

dd) Act as an advisor for the Chairperson of the communal People’s Committee to implement regulations and policies for commune-level officials and part-time officials;

e) Perform other tasks according to the assignment of the Chairperson of the communal People’s Committee and regulations of relevant laws.

a) Act as an advisor for the communal People’s Committee to organize performance of tasks and entitlements of the communal People’s Committee and the Chairperson of the communal People’s Committee in fields of justice and civil status in the commune in accordance with law;

b) Assist the communal People’s Committee in drafting and promulgating documents according to regulations of law; assist the communal People’s Committee in carrying out surveys on the People’s opinions about legislative documents according to plans of the communal People’s Committee and guidelines of superior authorities;

c) Assist the communal People’s Committee in carrying out legal dissemination and education, legal aid, judgment enforcement; monitoring law enforcement and carrying out surveys on the People’s opinions in the commune about participation in law-making; building a commune achieving legal accessibility standards; instructing the operation of grassroots mediation organizations; cooperating with village heads, neighborhood leaders in preliminarily reviewing and summarizing grassroots mediation work and reporting results to the communal People's Committee; managing law bookcases at the communal People's Committee; cooperating with socio-cultural officials in guiding residential communities of villages and neighborhoods to formulate and organize the implementation of village conventions;

d) Assist the communal People’s Committee in registering and managing civil status as prescribed by law;

dd) Take charge of affairs of civil status, notarization and authentication at the unit receiving and informing results of the communal People’s Committee;

e) Assist the communal People’s Committee in combating and controlling corruption and performing tasks relating to inspection;

g) Perform other tasks according to the assignment of the Chairperson of the communal People’s Committee and regulations of relevant laws.

6. A socio-cultural official shall:

a) Act as an advisor for the communal People’s Committee to organize performance of tasks and entitlements of the communal People’s Committee and the Chairperson of the communal People’s Committee in fields of culture, information, communications, physical training, sports, tourism, labor, war invalids, society, health, education, belief, religion, ethnicity, family, children and youth in accordance with law; act as an advisor for the communal People’s Committee in affairs relating to social insurance, health insurance, occupational safety and health; set targets for development of participants in social insurance and health insurance in annual socio-economic development plans and submit them to the People's Council at the same level for decision;

c) Provide statistics on population, employees and jobs in the commune; monitor, summarize and report the number and changes of labor policy beneficiaries and people with meritorious services; belief, religion, ethnicity, family, children and youth; make payments to beneficiaries of social policies and people with meritorious services; manage martyrs' cemeteries and martyrs' merit works; provide social protection, hunger eradication and poverty reduction programs and food safety work in the commune; report information and communication data;

d) Take charge and cooperate with judicial officials and heads of village and neighborhood leaders in guiding the residential community of villages and neighborhoods to formulate and organize the implementation of village conventions; cooperate with office administration/management - statistical officials in setting databases on population, employees and jobs and policy beneficiaries;

dd) Perform other tasks according to the assignment of the Chairperson of the communal People’s Committee and regulations of relevant laws.

7. On the basis of the standards of each title of commune-level officials prescribed in this Article, the district-level People’s Committees shall prescribe specific tasks of each title of commune-level officials in a manner that is satisfactory to characteristics and requirements for task performance of each commune level and ensures that officials are sent to all fields of work.

Section 3. Election of commune-level officials and recruitment of commune-level officials

Article 12. Election of commune-level officials

1. Election of commune-level officials to positions in the People's Councils, People’s Committees shall comply with regulations of Law on Election of Members of the National Assembly and Members of the People's Councils; Law on Organization of Local Government and relevant legislative documents.

2. Election of commune-level officials to positions in the organizations of the CPV and socio-political organizations of communes shall comply with regulations of the Communist Party’s Charter, charters of socio-political organizations and regulations of the CPV and socio-political organizations of the central Government.

For commanding officers of Military Commands of communes, besides requirements for being applicants for commune-level officials in accordance with the regulations in this Clause, the standards prescribed in Article 7 and Clause 1 Article 10 of this Decree shall be applied.

For Young intellectuals volunteering to participate in rural and mountainous development and part-time officials of communes having at least 24 months of working there and evaluated and classified as completing their tasks or more, 2,5 points will be added to their results of round 2.

b) If recruited commune-level officials complete their apprenticeship according to the regulations of this Clause, the Chairpersons of the communal People’s Committees shall request the Chairpersons of the district-level People’s Committees to decide certification of completion of apprenticeship and pay step rearrangement of the recruited commune-level officials.

Article 14. Receipt of commune-level officials

1. Eligible entities:

a) Public employees working in public service providers;

b) Persons getting paid in the People's Armed Forces, persons working in cipher organizations as non-officials;

c) Persons who resign as commune-level officials (except for officials who are dismissed);

d) Persons who used to work as officials (including commune-level officials) then have been sent or rotated to hold other non-official positions at other agencies or organizations.

2. Standards and requirements for receipt; dossiers of persons who are requested to be received and inspection council upon receipt of recruited commune-level officials shall comply with regulations of the Government on recruitment, use and management of officials.

Section 4. REGULATIONS ON WAGES, ALLOWANCES AND OTHER REGULATIONS AND POLICIES FOR COMMUNE-LEVEL OFFICIALS

Article 16. Pay step rearrangement for commune-level officials

1. Pay steps of commune-level officials who have professional education degrees according to standards of professional qualifications prescribed in this Decree shall be rearranged as the same levels with administrative officials who have the same professional education degrees prescribed in the payroll of officials in regulatory agencies enclosed with the Decree of the Government on regulations on wages for officials, public employees and armed forces.

Education degrees shall comply with regulations of the Ministry of Education and Training and of agencies and organizations having authority to issue such degrees.

2. During the working period, commune-level officials adapting their educational qualifications for their current positions shall have the authority to request the Chairpersons of the district-level People’s Committees to rearrange their pay steps according to the new educational qualifications from the day on which education degrees are issued.

3. If the recruited commune official has been paying social insurance and has not claimed the one-off social insurance payout, the working period over which social insurance has been paid is also considered for salary determination (excluding apprenticeship and probation). The working period with intermittent social insurance payment can be accumulated.

The commune-level officials prescribed in Clause 1 Article 16 of this Decree shall raise salaries frequently and ahead of schedule; extend pay raise time according to regulations of the Government on salaries for officials, public employees and armed forces.

Article 18. Extra-seniority allowance

The commune-level officials prescribed in Clause 1 Article 16 of this Decree shall raise salaries frequently and ahead of schedule; extend pay raise time according to regulations of the Government on salaries for officials, public employees and armed forces.

The commune-level officials prescribed in Clause 1 Article 16 hereof shall be entitled to leader allowances which are added to the statutory pay rate as follows:

1. Secretaries of the Communist Party Committees: 0,30.

2. Deputy Secretary of the Communist Party Committee, Chairperson of the People's Council; Chairperson of the People’s Committee: 0,25.

3. Chairperson of Vietnam Fatherland Front Central Committee and Vice Chairperson of the People's Council; Vice Chairperson of the People’s Committee: 0,20.

4. Secretary of Ho Chi Minh Communist Youth Union, Chairperson of Vietnam Women’s Union, Chairperson of Vietnam Farmer’s Union, Chairperson of Vietnam War Veteran Association: 0,15.

Article 20. Multi-position allowance

1. If a commune-level official can concurrently hold the position of another commune-level official assigned by the district-level People’s Committee according to regulations in Clause 5 Article 6 of this Decree, he/she will receive a multi-position allowance equal to 50% of the step 1 salary, plus leadership allowance (if any) of the position that he/she concurrently holds; the multi-position allowance is not used to calculate the amounts of social insurance and health insurance to be paid or received.

If a person concurrently holds multiple positions or titles (even if he/she is concurrently holding the positions of both the CPV secretary and the Chairperson of the People’s Committee or the Chairperson of the People's Council), he/she is only entitled to the allowance of the highest position or title; and the district-level People’s Committee shall decide which positions or titles are eligible for multi-position allowance.

2. If a commune-level official concurrently holds the position of a part-time official of the commune or neighborhood, he/she shall receive a multi-position allowance equal to 100% of the prescribed allowance of the position that he/she concurrently holds.

Social insurance and health insurance regimes for commune-level officials shall comply with regulations of law on social insurance and health insurance.

Article 22. Training and retraining regimes

Training and retraining regimes for commune-level officials shall comply with regulations of the Government on training and retraining for officials and public employees and regulations of the CPV and socio-political organizations at the central level.

Section 5. Appointment, reassignment and receipt of commune-level officials

Section 23. Appointment, reassignment and receipt of commune-level officials from some communes, wards and townships to others

1. Regarding Office administration/management - statistical officials, Cadastral - construction - urban and environment officials (for wards and townships) or Cadastral - agriculture - construction and environment officials (for communes), Finance - accounting officials; Judicial - civil status officials, Socio-cultural officials:

a) The Chairperson of the district-level People’s Committee shall decide the appointment of commune-level officials from a commune/ ward/ township to another in the same second-level administrative subdivision;

b) The Chairperson of the district-level People’s Committee shall decide the reassignment and receipt of commune-level officials from a commune/ ward/ township of the district to that of another district after there is a consensus in writing of the Director of the Department of Home Affairs;

c) The Chairperson of the district-level People’s Committee shall decide the reassignment of commune-level officials to another province and receipt of commune-level officials from another province after there is a consensus in writing of the Director of the Department of Home Affairs of the province where the officials are received and the Director of the Department of Home Affairs of the province where the officials are reassigned.

The appointment, reassignment and receipt of Commanding Officers of Military Commands of communes shall comply with the specific requirements and tasks. The Chairpersons of the district-level People’s Committees shall decide the appointment, reassignment and receipt of Commanding Officers of Military Commands of communes shall comply with the hierarchy of management of the districts.

3. Commune-level officials who are appointed, reassigned and received to work in communes with extremely disadvantaged socio-economic conditions shall be entitled to preferential mechanisms and policies according to regulations of law.

Section 6. Evaluation and ranking of the quality of commune-level officials

Article 24. Evaluation and ranking of the quality of commune-level officials

Commune-level officials (except for commanding officers of communal Military Commands) shall carry out evaluation and ranking according to regulations of the Law on Officials, regulations of the Government on evaluation and ranking of the quality of officials and public employees, regulations of relevant laws, organizational charters and regulations of the CPV and socio-political organizations at the central level.

Article 25. Procedures for evaluation and ranking of commanding officers of communal Military Commands

1. Officials shall evaluate and rank working results by themselves according to assigned responsibilities and tasks.

2. Officials of communal Military Commands and officials of the communal People’s Committees shall participate in meetings to give their opinions. Their opinions shall be recorded and passed in the meetings.

3. The Chairpersons of the Communal People’s Committees shall evaluate and rank Commanding Officers of communal Military Commands and send notifications to such officers after asking opinions in writing of Commanding Officers of district-level Military Commands.

Article 26. Dismissal of and discharge from commune-level senior officials

The dismissal of and discharge from commune-level senior officials shall comply with applicable regulations of the Law on Officials, the Law on Organization of Local Government, the Law on Election of Members of the National Assembly and Members of the People's Councils and other regulations of relevant laws, organizational charters and regulations of the CPV and socio-political organizations at the central level.

Article 27. Resignation as commune-level senior officials and severance of commune-level officials

1. Commune-level officials who resign their positions (except for officials who are reassigned and officials who are disciplined according to regulations of laws on officials) shall be eligible for resignation benefits (for commune-level senior officials) and severance allowances (for commune-level officials) which are calculated according to regulations of the Government on severance allowances for officials.

2. Commanding officers of communal Military Commands shall be granted severance pay within 30 days from the dates on which disciplinary decisions come into force if they are dismissed and are not reassigned to other positions of commune-level officials. Besides severance pay in accordance with the regulations in Clause 1 of this Article, Commanding Officers of communal Military Commands shall also be granted other severance pay in accordance with regulations of law on militia and self-defense forces.

3. Funding for paying resignation benefits to commune-level senior officials and severance allowances to commune-level officials shall be allocated in operating expense estimates of the communal People’s Committees annually funded by competent authorities.

Article 28. Retirement as commune-level officials

1. The retirement of commune-level officials shall comply with regulations of labor laws and regulations of the CPV and of social-political organizations at the central level.

2. Authorities competent to manage commune-level officials must notify in writing of retirement time 06 months before the dates on which commune-level officials retire; and promulgate retirement decisions 03 months before the dates on which commune-level officials retire.

Article 29. Disciplining commune-level officials

Commune-level officials shall be disciplined according to regulations of the Government on taking disciplinary actions against officials and public employees.

If otherwise prescribed by laws and charters of the CPV and socio-political organizations, the regulations of the laws and charters shall be applied;

Article 30. Commending and rewarding commune-level officials

Commune-level officials shall be commended and rewarded according to regulations of law on emulation, commendation and reward, organizational charters and regulations of the CPV and social-political organizations at the central level.

Article 31. Contents of management of commune-level officials

1. Promulgating and organizing implementation of legislative documents, charters and regulations on commune-level officials.

2. Formulating plans and plannings for commune-level officials.

4. Specifying the number of commune-level officials; recruiting, using, managing, organizing training courses, refresher training courses and apprenticeships, providing for resignation, severance, retirement, evaluating and ranking quality of commune-level officials.

5. Implementing regulations on commendation, reward and discipline, regulations on salaries and other regulations and policies for commune-level officials.

6. Complying with regulations on report on statistics on and management of documents on commune-level officials.

7. Inspecting agencies, organizations and officials in implementing regulations of law on commune-level officials.

8. Settling complaints and denunciations of commune-level officials.

9. Other works related to the management of commune-level officials.

Article 32. Authority to manage commune-level officials

1. The Ministry of Home Affairs shall:

a) Propose to the Government and the Prime Minister promulgation of regulations on commune-level officials;

c) Inspect the People’s Committees at all levels and officials in the implementation of regulations of law on commune-level officials;

d) Provide statistics and consolidated documents on quantity and quality of commune-level officials nationwide.

2. The Provincial People’s Committees shall:

a) Propose to the People's Councils at the same level decision on the quantity of commune-level officials for each second-level administrative subdivision according to the regulations in Clause 4 Article 6 of this Decree;

b) Promulgate Regulations on organizing recruitment of commune-level officials; instruct and inspect the annual evaluation and ranking of quality of commune-level officials of the district-level People’s Committees.

c) Prescribe specific standards of each position of commune-level senior officials and each title of commune-level officials according regulations in Article 8 and Article 10 hereof;

d) Prescribe disciplines according to requirements and tasks of each title of commune-level officials;

dd) Inspect the organization of implementing regulations and policies for commune-level officials;

e) Direct, instruct and inspect the recruitment, preparation of plans and plannings for developing commune-level officials; gradually implement standardization to improve quality of commune-level officials;

h) Direct the settlement of complaints and denunciations of commune-level officials;

i) Promulgate regulations on hierarchy of management of commune-level officials;

k) Consolidate statistics and reports on the quantity and quality of commune-level officials in their provinces;

l) Instruct and inspect the use of sources of funding to implement regulations and policies according to regulations of the Government and according to Resolutions of the People's Councils at the same level for commune-level officials;

m) Provide instructions on preparation and management of profiles of commune-level officials.

3. The district-level People’s Committees shall:

a) Formulate plans and plannings for developing commune-level officials;

b) Decide the specific quantity of officials in third-level administrative subdivision and arrange the quantity of officials of each title of commune-level officials according to the regulations in Clause 5 Article 6 of this Decree;

c) Organize recruitment of commune-level officials according to regulations of this Decree and the Regulation on recruitment of officials of the Provincial People’s Committees; decide receipt, appointment, reassignment and management of commune-level officials according to regulations herein and according to hierarchy of management of officials of the provincial People’s Committees; accept resignation of commune-level senior officials, severance of commune-level officials and retirement as commune-level officials as prescribed by law;

dd) Organize implementation of regulations on salaries and other regulations and policies for commune-level officials;

e) Decide which titles are eligible for multi-position allowance as prescribed in Clause 1 Article 20 hereof;

g) Organize training and refresher training courses for commune-level officials according to instructions and authorization of the Provincial People’s Committees;

h) Decide to commend, reward or discipline commune-level officials according to hierarchy of management of officials of the Provincial People’s Committees;

i) Inspect and evaluate the implementation of regulations on commune-level officials;

k) Settle complaints and denunciations of commune-level officials according to regulations of law;

l) Consolidate statistics and reports on the quantity and quality of commune-level officials in their districts;

m) Instruct and inspect the annual evaluation and ranking of quality of commune-level officials of the communal People’s Committees; inspect the implementation of regulations and policies for commune-level officials;

n) Provide instructions on preparation and management of profiles of commune-level officials to the communal People’s Committees.

a) Directly manage and use commune-level officials; annually evaluate and rank quality of commune-level officials;

b) Implement training regulations, policies and plans; carry out planning and create human resources of commune-level officials;

c) Propose consideration and decision on which titles are eligible for multi-position allowance as prescribed in Clause 1 Article 20 hereof to the district-level People’s Committees;

d) Propose commendation and reward of commune-level officials according to hierarchy of management of officials in communes to competent agencies and organizations in their districts;

dd) Propose taking disciplinary actions against commune-level officials to competent agencies and organizations in their districts;

e) Settle complaints and denunciations of commune-level officials according to regulations of law;

g) Provide statistics and reports on the quantity and quality of commune-level officials;

h) Prepare and manage profiles of commune-level officials.

Article 33. Quantity of part-time officials of communes and neighborhoods

1. The number of part-time officials of communes shall be calculated according to classes of third-level administrative subdivisions: Class-I: 14 persons; Class-II: 12 persons; Class-III: 10 persons.

2. The provincial People’s Committees shall, based on the number of third-level administrative subdivisions where population sizes and natural areas are higher than the standard sizes prescribed in the Resolution of the Standing Committee of National Assembly on standards of administrative divisions and classification of administrative divisions, calculate the increasing number of part-time officials of communes as follows:

a) If the population of every ward of an urban district increases by one-third (1/3) of the prescribed population size, 01 more official may be newly recruited. If the population of any of the remaining third-level administrative subdivisions increases by every one-second (1/2) of the prescribed population size, 01 more part-time official may be newly recruited;

b) In addition to increase in the number of part-time officials according to the population size prescribed in Point a of this Clause, if the population of any of the third-level administrative subdivisions increases by every one hundred percent (100%) of the prescribed natural area, 01 more part-time official may be newly recruited.

3. The population size (including permanent resident population and temporary resident population converted) and natural area calculated til December 31 of every year to determine the number of commune-level part-time officials prescribed in Clause 2 of this Article shall comply with the Resolution of the Standing Committee of National Assembly on standards of administrative divisions and classification of administrative divisions.

In case, in third-level administrative subdivisions, on and by December 31 of every year, there is a change in the population size and natural area prescribed in Clause 2 of this Article, or there is a change in levels of administrative divisions, the provincial People’s Committees shall propose to the People's Councils at the same levels consideration for adjustment to the total number of commune-level part-time officials (including first-level administrative subdivisions) to be in accordance with regulations.

4. Annually, the provincial People’s Committees shall propose to the People's Councils at the same levels decision on the number of commune-level part-time officials for each second-level administrative subdivision under their management in accordance with realistic demands, but it must be ensured that the total commune-level part-time officials of second-level administrative subdivisions shall not exceed the total commune-level part-time officials of first-level administrative subdivisions according to the regulations in Clauses 1 and 2 of this Article.

5. Annually, the provincial People’s Committees shall decide the specific number of part-time officials at each third-level administrative subdivision and arrange the number of commune-level part-time officials under their management according to requirements and tasks of each third-level administrative subdivision. The number of part-time officials of each third-level administrative subdivision may be less than that of class-III third-level administrative subdivisions or more than that of class-I third-level administrative subdivisions prescribed in Clause 1 of this Article, but must not exceed the total commune-level part-time officials of its second-level administrative subdivision assigned by the People's Council.

Officials holding the title of Cell Secretaries are encouraged to concurrently hold the title of village heads, neighborhood leaders or heads of Front Work Departments of villages or neighborhoods.

7. Persons who directly participate in activities of villages and neighborhoods, apart from the 03 titles prescribed in Clause 6 of this Article, shall be entitled to monthly supports.

8. Part-time officials of communes and neighborhoods may concurrently hold positions of other part-time officials of communes and neighborhoods; part-time officials of neighborhoods may concurrently hold positions of persons directly participating in activities of neighborhoods.

Article 34. Allowances for part-time officials of communes and neighborhoods

1. Part-time officials of communes shall be entitled to allowances. Central government budgets allocated for monthly paying allowances (including supports of social insurance and health insurance premiums) to part-time officials of communes are as follows:

a) Class I third-level administrative subdivisions are entitled to an allowance equal to 21,0 times of the statutory pay rate;

b) Class II third-level administrative subdivisions are entitled to an allowance equal to 18,0 times of the statutory pay rate;

c) Class III third-level administrative subdivisions are entitled to an allowance equal to 15,0 times of the statutory pay rate.

For third-level administrative subdivisions in which the number of commune-level part-time officials increases in accordance with the regulations in Clause 2 Article 33 of this Decree, the total pay rate of allowances may increase by 1,5 times of the statutory pay rate for each part-time official who is newly recruited.

a) For villages with at least 350 households; neighborhoods with at least 500 households; villages and neighborhoods of key third-level administrative subdivisions where security and order are difficult to control according to competent authorities’ decisions; villages and neighborhoods of third-level administrative subdivisions in border regions and islands, allowances shall be paid at the fixed rate, equal to 6,0 times of the statutory pay rate. If villages with at least 350 households are developed into neighborhoods due to establishment of third-tier urban areas, allowances shall be paid at the fixed rate, equal to 6,0 times of the statutory pay rate;

b) For villages and neighborhoods that are not prescribed in point a Clause 2 of this Article, allowances shall be paid at the fixed rate, equal to 4,5 times of the statutory pay rate;

c) If second-level administrative subdivisions do not organize third-level administrative subdivisions, villages and neighborhoods prescribed in Points a and b of this Clause shall be determined according to such second-level administrative subdivisions.

3. On the basis of fixed allowances granted to communes, villages and neighborhoods by central government budget prescribed in Clauses 1 and 2 of this Article; funding for reform of local wage policies; regulations of relevant laws and characteristics of communes, villages and neighborhoods, the People’s Committees of provinces shall propose to the People's Councils at the same level provision of specific regulations on the following contents:

a) Titles of part-time officials of communes;

b) The plurality of titles of part-time officials of communes and neighborhoods, and regulations on part-time officials of neighborhoods concurrently holding positions of persons directly participating in activities of neighborhoods.

c) Allowance of each title of part-time officials of communes and neighborhoods appropriate to the grade-1 salary of commune-level officials who have the same professional qualifications to encourage part-time officials of communes and neighborhoods to study and improve their professional qualifications; specific regulations on the fixed rate of operating expenses of socio-political organizations of communes; monthly supports and multi-position allowances for persons directly participating in activities of villages and neighborhoods suitable for the current situation of their villages and neighborhoods.

4. If an official part-time official of a commune or neighborhood concurrently holds the position of another part-time official of the commune or neighborhood, he/she shall receive a multi-position allowance equal to 100% of the prescribed allowance of the position that he/she concurrently holds.

5. The People’s Committees of provinces shall propose to the People's Councils at the same level provision of specific regulations on the contents in Point c Clause 3 of this Article without permission of Ministries and central authorities.

1. Part-time officials of communes and neighborhoods and persons who directly participate in activities of villages and neighborhoods shall join in training and refresher training courses on knowledge to satisfy requirements for their concurrently assigned tasks; when they are assigned to participate in training and refresher training courses, they are entitled to benefits as prescribed by law.

2. Part-time officials of communes shall comply with regulations on compulsory social insurance and health insurance according to law on social insurance and health insurance.

Article 36. Standards, tasks, election, selection, receipt, use, management, evaluation, ranking, commendation, discipline and dismissal, discharge, resignation for part-time officials of communes

1. Standards

a) Persons who are Vietnamese citizens aged 18 or higher; have enough civil act capacity and good health to perform assigned tasks;

b) Persons who have good political and moral qualities; exemplarily observe the guidelines and lines of the CPV, policies and laws of the State; be capable of organizing the implementation and mobilizing the people of communes to effectively implement the guidelines and lines of the CPV, policies and laws of the State;

c) Persons who do not face criminal prosecution, imprisonment, community sentence, surveillance, or are being forced to deal with measures for education in communes; are sent to treatment facilities and educational institutions;

d) Education level: persons who have graduated from high schools;

dd) Professional qualifications: persons who have graduated from intermediate schools or higher.

Part-time officials of communes shall perform tasks according to regulations in organizational charters to which they are signatories, regulations of relevant laws and of authorities having the power to manage; cooperate with commune-level officials in performing assigned tasks and ensuring that there are enough persons performing and monitoring tasks of task-related fields of executive committees of the CPV and local government of communes;

3. Election and selection of part-time officials of communes

a) The elected titles shall comply with organizational charters to which part-time officials of communes are signatories, regulations of relevant laws and regulations of authorities having power to manage.

b) The selection of titles of part-time officials of communes, apart from regulations in point a of this Clause, shall comply with regulations on admission without examination.

As for the title of assistants to Commanding Officers of Military Commands of communes, regulations of relevant military laws shall be applied.

4. Evaluation and ranking of part-time officials of communes

a) The elected titles shall comply with organizational charters to which part-time officials of communes are signatories and regulations of authorities having power to manage.

b) Part-time officials of communes acting as assistants to the local government of communes shall be evaluated and ranked by the Presidents of the People’s Committees of communes.

c) As for the title of part-time officials of communes acting as assistants to Commanding Officers of Military Commands of communes, regulations of relevant military laws shall be applied.

5. Commendation and reward for part-time officials of communes

Part-time officials of communes who achieve succeeds in performing tasks shall be commended and rewarded according to regulations of law on emulation and commendation.

6. Penalty for part-time officials of communes

a) The elected titles shall be penalized in accordance with organizational charters to which part-time officials of communes are signatories and regulations of authorities having power to manage.

b) Presidents of the People’s Committees of communes have the power to consider and decide penalties for part-time officials of communes who act as assistants to the local government of communes.

c) As for the title of part-time officials of communes acting as assistants to Commanding Officers of Military Commands of communes, regulations of relevant military laws shall be applied.

d) Disciplinary actions, forms of disciplinary actions and disciplinary procedures imposed on part-time officials of communes shall be similar to those for officials prescribed herein.

Salaries of officials shall not be reduced even if they are penalized.

7. Dismissal of, discharge from and resignation as part-time officials of communes

8. The People’s Committees of provinces shall, based on the regulations in Clauses 1, 2, 3, 4, 5, 6 and 7 of this Article, regulations of organizational charters to which part-time officials of communes are signatories, regulations of relevant laws, provide specific regulations on management and use of titles of part-time officials of communes in a manner suitable for the current situation of each province.

9. The People’s Committees of districts shall, based on the tasks prescribed in Clause 2 of this Article, regulations of the People’s Committees of provinces on management and use of part-time officials of communes of provinces and based on titles of part-time officials of communes prescribed in point a Clause 3 Article 34 of this Decree, provide specific regulations on tasks of titles of part-time officials of communes in a manner that suits requirements for performing tasks of communes.

Chapter IV

IMPLEMENTATION CLAUSES

Article 37. Effect

1. This Decree comes into force from August 01, 2023.

2. Decree No. 114/2003/ND-CP dated October 10, 2003; Decree No. 112/2011/ND-CP dated December 05, 2011; Decree No. 92/2009/ND-CP dated October 22, 2009; Decree No. 34/2019/ND-CP dated April 24, 2019 shall be annulled.

3. In places where the model of urban area government is made according to Resolutions of National Assembly and regulations of the Government, other regulations (if any) and regulations herein, regulations of Resolutions of National Assembly and regulations of the Government shall be applied.

4. Regulations and policies herein applied to Secretaries and Deputy Secretaries for Party cells (at which Communist Party Committees of communes are not established) shall be similar to those applied to Secretaries and Deputy Secretaries for Communist Party Committees of communes; Regulations and policies herein applied to Standing Communist Party Committees of communes (at which Deputy Secretaries responsible for the CPV work) shall be similar to those applied to Deputy Secretaries for Communist Party Committees for communes.

1. Commune-level senior officials who are holding the elected positions prescribed in Clause 1 Article 5 and fail to meet standards prescribed in Article 8; commune-level officials who are holding the titles prescribed in Clause 2 of Article 5 and fail to fully meet standards prescribed in Article 10 and part-time officials of communes prescribed in Point a Clause 3 of Article 34 and fail to meet standards prescribed in Clause 1 Article 36 herein, within 05 years from the date on which this Decree comes into force, all standards must be met as prescribed. If the standards are not fully met according to regulations after 5 years, retirement benefits (if eligible) or downsizing policies shall be applied according to regulations of the Government.

2. During the working period, if commune-level officials have changes in professional qualifications to appropriate to their designated positions and titles, have granted graduate degrees and have not yet rearranged in accordance with their newly professional qualifications before the date on which this Decree comes into force, their salaries shall be rearranged according to their newly professional qualifications from the date on which this Decree comes into force.

3. If officials working in agencies, organizations and units of districts or higher are appointed, rotated and seconded to hold positions and titles of commune-level officials, the salary determination, raise of salaries and extra-seniority allowances shall be applied according to regulations of the Government on salaries for officials, public employees and armed forces.

4. Commune-level senior officials who are being granted retirement pensions or loss of earning capacity benefits (LOEC benefit), in addition to current pensions or LOEC benefits monthly granted, their salaries and responsibility allowances shall be paid according to regulations herein and social insurance and health insurance coverage are provided.

5. Commune-level officials who are enjoying benefits for injured and sick soldiers at all grades and are not eligible for pensions or LOEC benefits, in addition to benefits for injured and sick soldiers monthly provided, their salaries and responsibility allowances shall be paid according to regulations herein.

6. Commune-level officials who have retired due to old age according to Decision No. 130/CP dated June 30, 1975 of the Government Council and Decision No. 111/HDBT dated October 13, 1981 of the cabinet council (the Government) shall have their monthly allowances adjusted when the state adjusts the statutory pay rate; shall be eligible for transferring their allowances to new legal residences; Upon death, persons in charge of the funeral shall receive a funeral fee equal to 10 times of the statutory pay rate.

If commune-level officials who have retired due to old age are suspended from enjoying monthly allowances while serving their sentences of imprisonment, applications enclosed with copies of certificates of completion of prison sentences shall be submitted to the District-level People's Committees for consideration and settlement in order to continue enjoying monthly allowances.

7. If a commune-level senior official who has a period of holding a title of the People’s Committee according to regulations in Clause 5 Article 3 of Decree No. 09/1998/ND-CP dated January 23, 1998 of the Government which amends Decree No. 50/CP dated July 26, 1995 of the Government (has not yet received a lump-sum allowance, this period shall be determined as the period in which the social insurance is paid to enjoy social insurance benefits.

If the official holds another title of the People’s Committee and has not paid the social insurance for such title, his/her unpaid social insurance premiums shall be paid to be the basis for calculation of the social insurance benefits.

If the commune-level senior official has received monthly allowances or lump-sum allowance before the date on which this Decree comes into force, this Decree shall not be applied to resettle.

9. A person who has a period of working as a commune-level official before January 01, 1998, within this working period, if he/she holds a title prescribed in Decree No. 09/1998/ND-CP and is appointed or recruited to serve in the People's Army, People's Public Security or to work in a State agency, unit, enterprise, political organization or socio-political organization, this working period shall be considered as the period in which he/she has paid social insurance if he/she is not granted monthly allowances or a lump-sum allowance.

10. If third-level administrative subdivisions are arranged according to Resolutions of the Standing Committee of National Assembly, the quantity and rearrangement and settlement of benefits and policies for commune-level officials and part-time officials of communes and neighborhoods shall comply with regulations of competent authorities.

Article 39. Funding for benefits and policies for commune-level officials, part-time officials of communes and neighborhoods and persons who directly participate in activities of villages and neighborhoods

1. Funding for benefits and policies for commune-level officials, part-time officials of communes and neighborhoods and persons who directly participate in activities of villages and neighborhoods; commune-level senior officials who have retired due to old age according to regulations in Clause 6 Article 38 of this Decree, shall be provided by state budget in accordance with the current government budget hierarchy.

2. Social insurance funds for covering benefits shall comply with regulations of law on social insurance for commune-level officials and part-time officials of communes.

Article 40. Responsibility for implementation

1. The People’s Committees of provinces shall propose to the People's Councils at the same level provision of funding for benefits and policies according to regulations herein.

2. Vietnam Social Security shall instruct and inspect the provision of social insurance benefits for commune-level officials of Social Insurance Agencies of provinces and districts according to regulations herein.

4. People’s Committees of provinces shall provide instructions on multiple positions to ensure that work-related fields are staffed; provide, instruct, inspect the use of funding for benefits and policies for commune-level officials and part-time officials of communes, neighborhoods and persons who directly participate in activities of villages and neighborhoods according to regulations herein.

5. People’s Committees of district shall instruct and inspect the provision of benefits and policies for commune-level officials, part-time officials of communes, neighborhoods and persons who directly participate in activities of villages and neighborhoods according to regulations of the People’s Committees of provinces and according to regulations herein.

6. Ministers, Heads of ministerial agencies, Heads of Governmental agencies, Presidents of the People's Committees of provinces and central-affiliated cities, relevant agencies, organizations and individuals are responsible for implementation of this Decree./.
