CỦA CHÍNH PHỦ SỐ 87-CP NGÀY 19 THÁNG 12 NĂM 1996 QUY ĐỊNH CHI TIẾT VIỆC PHÂN CẤP QUẢN LÝ, LẬP, CHẤP HÀNH VÀ QUYẾT TOÁN NGÂN SÁCH NHÀ NƯỚC

Căn cứ Luật Tổ chức Chính phủ
ngày 30 tháng 9 năm 1992;
Căn cứ Luật Ngân sách Nhà nước ngày 20 tháng 3 năm 1996;
Theo đề nghị của Bộ trưởng Bộ Tài chính,
NGHỊ ĐỊNH:
Điều 1.- Thu ngân sách Nhà nước gồm:
1. Thuế, phí, lệ phí do các tổ chức và cá nhân nộp theo quy định của pháp luật;
2. Các khoản thu từ hoạt động kinh tế của Nhà nước:
Lợi tức từ vốn góp của Nhà nước vào các cơ sở kinh tế;
Tiền thu hồi vốn của Nhà nước tại các cơ sở kinh tế;
Thu hồi tiền cho vay của Nhà nước (cả gốc và lãi).
3. Thu từ hoạt động sự nghiệp;
4. Thu hồi quỹ dự trữ Nhà nước;
5. Tiền sử dụng đất; thu từ hoa lợi công sản và đất công ích;
6. Các khoản huy động đóng góp của các tổ chức, cá nhân để đầu tư xây dựng các công trình kết cấu hạ tầng cơ sở;
7. Các khoản đóng góp tự nguyện của các tổ chức, cá nhân ở trong và ngoài nước;
8. Các khoản di sản Nhà nước được hưởng;
9. Thu kết dư ngân sách năm trước;
10. Tiền bán hoặc cho thuê tài sản thuộc sở hữu Nhà nước tại các đơn vị hành chính, sự nghiệp;
11. Các khoản tiền phạt, tịch thu;
12. Các khoản thu khác theo quy định của pháp luật;
13. Các khoản viện trợ không hoàn lại bằng tiền, bằng hiện vật của Chính phủ các nước, các tổ chức, cá nhân ở nước ngoài;
14. Các khoản vay trong nước, vay nước ngoài của Chính phủ để bù đắp bội chi và khoản huy động vốn đầu tư trong nước của tỉnh, thành phố trực thuộc Trung ương (gọi chung là tỉnh) quy định tại khoản 3 Điều 8 của Luật Ngân sách Nhà nước được đưa vào cân đối ngân sách.
Điều 2.- Chi ngân sách Nhà nước gồm:
1. Chi thường xuyên về:
a/ Các hoạt động sự nghiệp giáo dục, đào tạo, y tế, xã hội, văn hoá, thông tin, thể dục thể thao, sự nghiệp khoa học, công nghệ và môi trường và các sự nghiệp khác;
b/ Các hoạt động sự nghiệp kinh tế;
c/ Quốc phòng, an ninh và trật tự an toàn xã hội;
d/ Hoạt động của các cơ quan nhà nước;
đ/ Hoạt động của Đảng cộng sản Việt Nam;
e/ Hoạt động của Mặt trận Tổ quốc Việt Nam, Liên đoàn lao động Việt Nam, Đoàn thanh niên cộng sản Hồ Chí Minh, Hội Cựu chiến binh Việt Nam, Hội Liên hiệp phụ nữ Việt Nam, Hội nông dân Việt Nam;
g/ Trợ giá theo chính sách của Nhà nước;
h/ Các chương trình quốc gia;
i/ Hỗ trợ quỹ bảo hiểm xã hội theo quy định của Chính phủ;
k/ Trợ cấp cho các đối tượng chính sách xã hội;
l/ Tài trợ cho các tổ chức xã hội, xã hội - nghề nghiệp theo quy định của pháp luật;
m/ Trả lãi tiền do Nhà nước vay;
n/ Viện trợ cho các Chính phủ và tổ chức nước ngoài;
o/ Các khoản chi khác theo quy định của pháp luật.
2. Chi đầu tư phát triển:
a/ Đầu tư xây dựng các công trình kết cấu hạ tầng kinh tế - xã hội không có khả năng thu hồi vốn;
b/ Đầu tư và hỗ trợ vốn cho các doanh nghiệp nhà nước; góp vốn cổ phần, liên doanh vào các doanh nghiệp thuộc lĩnh vực cần thiết có sự tham gia của Nhà nước theo quy định của pháp luật;
c/ Chi cho Quỹ hỗ trợ đầu tư quốc gia và các Quỹ hỗ trợ phát triển đối với các chương trình, dự án phát triển kinh tế;
d/ Dự trữ nhà nước;
đ/ Cho vay của Chính phủ để đầu tư phát triển.
3. Chi trả nợ gốc tiền do Nhà nước vay.
4. Chi bổ sung quỹ dự trữ tài chính.
Ngân sách các cấp chính quyền địa phương gồm:
1. Ngân sách cấp tỉnh, thành phố trực thuộc Trung ương (gọi chung là ngân sách cấp tỉnh);
2. Ngân sách cấp huyện, quận, thị xã, thành phố thuộc tỉnh (gọi chung là ngân sách cấp huyện);
3. Ngân sách cấp xã, phường, thị trấn (gọi chung là ngân sách cấp xã).
Điều 4.- Phân cấp quản lý ngân sách nhà nước phải bảo đảm nguyên tắc:
1. Phù hợp với phân cấp quản lý kinh tế - xã hội của Nhà nước;
2. Ngân sách trung ương giữ vai trò chủ đạo, tập trung các nguồn lực cơ bản để bảo đảm thực hiện các mục tiêu trọng yếu trên phạm vi cả nước;
3. Phân định rõ nguồn thu, nhiệm vụ chi giữa các cấp và ổn định tỷ lệ phần trăm (%) phân chia các khoản thu, số bổ sung từ ngân sách cấp trên cho ngân sách cấp dưới từ 3 đến 5 năm. Hàng năm, trong trường hợp có trượt giá, chỉ xem xét điều chỉnh tăng số bổ sung cho ngân sách cấp dưới theo một phần trượt giá;
4. Kết thúc mỗi kỳ ổn định, căn cứ khả năng thu và yêu cầu chi, Chính phủ, Uỷ ban nhân dân tỉnh thực hiện việc điều chỉnh tỷ lệ phần trăm (%) phân chia các khoản thu giữa ngân sách các cấp và mức bổ sung từ ngân sách cấp trên cho ngân sách cấp dưới.
Điều 6.-
1. Các cơ quan nhà nước trong phạm vi nhiệm vụ quyền hạn của mình, đề ra những biện pháp cần thiết nhằm bảo đảm hoàn thành tốt nhiệm vụ thu, chi ngân sách được giao; thực hiện tiết kiệm; chống tham ô, lãng phí; chấp hành nghiêm chỉnh kỷ luật tài chính. Thủ trưởng cơ quan, đơn vị chịu trách nhiệm trước pháp luật về kết quả thực hiện thu, chi ngân sách theo quy định của pháp luật.
2. Các đơn vị dự toán ngân sách, các tổ chức và cá nhân phải chấp hành nghĩa vụ nộp ngân sách theo quy định của pháp luật; sử dụng kinh phí ngân sách nhà nước đúng mục đích, đúng chế độ, tiết kiệm, có hiệu quả. Ngoài cơ quan có thẩm quyền giao ngân sách, không một tổ chức, cá nhân nào được thay đổi nhiệm vụ ngân sách đã được giao.
3. Cơ quan tài chính các cấp, trong phạm vi nhiệm vụ, quyền hạn của mình, có trách nhiệm đôn đốc, kiểm tra các tổ chức cá nhân có nghĩa vụ nộp ngân sách nộp đầy đủ, đúng thời hạn các khoản phải nộp vào ngân sách nhà nước; căn cứ nguồn thu ngân sách nhà nước, cấp phát đầy đủ, kịp thời các khoản chi theo dự toán, đúng chế độ, tiêu chuẩn và theo tiến độ thực hiện công việc.
4. Nghiêm cấm các ngành, các cấp, các cơ quan, đơn vị tự đặt ra chế độ, tiêu chuẩn thu, chi ngân sách nhà nước không đúng thẩm quyền, trái quy định của pháp luật.
Điều 7.-
1. Tất cả các khoản thu, chi của ngân sách nhà nước phải được hạch toán đầy đủ vào ngân sách nhà nước.
Các tổ chức, cá nhân có nhiệm vụ thu, nộp và sử dụng ngân sách nhà nước phải tổ chức hạch toán kế toán, báo cáo và quyết toán theo đúng chế độ kế toán nhà nước; quyết toán đầy đủ và trung thực các khoản thu, chi phát sinh; sử dụng hoá đơn, chứng từ thu, chi thống nhất do Bộ Tài chính phát hành.
2. Nghiêm cấm các cấp chính quyền, tổ chức và cá nhân tự giữ lại nguồn thu của ngân sách nhà nước hoặc dùng nguồn ngân sách nhà nước để lập quỹ ngoài ngân sách trái quy định của Chính phủ.
Điều 9.- Mọi khoản thu, chi ngân sách nhà nước được hạch toán bằng đồng ViệtNam.
Đối với các nhu cầu chi ngân sách nhà nước bằng ngoại tệ, phải lập dự toán, cấp phát và quyết toán bằng tiền đồng Việt Nam để các đơn vị mua ngoại tệ của Ngân hàng, trừ trường hợp trả nợ nước ngoài bằng ngoại tệ và một số trường hợp đặc biệt khác theo quy định của Bộ Tài chính.
Trường hợp thu ngân sách nhà nước bằng hiện vật, phải quy đổi thành tiền theo mức giá thị trường tại địa phương để phản ánh vào ngân sách nhà nước.
Điều 12.- Các tổ chức chính trị - xã hội nêu tại Điều 11 của Luật Ngân sách nhà nước gồm:
Mặt trận Tổ quốc Việt Nam;
Liên đoàn lao động Việt Nam;
Đoàn thanh niên cộng sản Hồ Chí Minh;
Hội Cựu chiến binh Việt Nam;
Hội Liên hiệp Phụ nữ Việt Nam;
Hội Nông dân Việt Nam.
Điều 13.-
1. Ngân sách nhà nước bảo đảm cân đối kinh phí hoạt động của Đảng cộng sản Việt Nam và các tổ chức chính trị - xã hội theo nguyên tắc sau:
Ngân sách nhà nước cấp chênh lệch giữa các nguồn thu theo chế độ quy định (gồm thu Đảng phí, hội phí; thu từ hoạt động sản xuất, kinh doanh sau khi hoàn thành nghĩa vụ đối với ngân sách nhà nước; các nguồn thu khác theo quy định của pháp luật) với dự toán chi được duyệt theo tiêu chuẩn, định mức, chế độ của Nhà nước.
2. Các tổ chức được ngân sách nhà nước bảo đảm kinh phí hoạt động phải lập dự toán, thực hiện dự toán và quyết toán theo đúng chế độ quản lý ngân sách.
Trong một số trường hợp đặc biệt, đối với các tổ chức xã hội, tổ chức xã hội - nghề nghiệp có hoạt động gắn với nhiệm vụ của Nhà nước, ngân sách nhà nước sẽ tài trợ một phần kinh phí hoạt động theo mức do Thủ tướng Chính phủ quyết định.
PHÂN CẤP QUẢN LÝ NGÂN SÁCH VÀ MỐI QUAN HỆ GIỮA NGÂN SÁCH CÁC CẤP
Điều 15.- Nguồn thu của ngân sách trung ương gồm:
1. Các khoản thu 100%:
a/ Thuế xuất khẩu, thuế nhập khẩu;
b/ Thuê tiêu thụ đặc biệt;
c/ Thuế lợi tức của các đơn vị hạch toán toàn ngành;
d/ Các khoản thuế và thu khác từ các hoạt động thăm dò, khai thác dầu khí (kể cả tiền thuê mặt đất, mặt nước) do Trung ương quản lý;
đ/ Lợi tức từ vốn góp của Nhà nước, tiền thu hồi vốn của Nhà nước tại các cơ sở kinh tế, thu hồi tiền cho vay của Nhà nước (cả gốc và lãi), thu từ quỹ dự trữ nhà nước, thu từ quỹ dự trữ tài chính của Trung ương trong trường hợp đặc biệt;
e/ Các khoản do Chính phủ vay; viện trợ không hoàn lại của Chính phủ các nước, các tổ chức, cá nhân ở nước ngoài cho Chính phủ theo quy định của pháp luật;
g/ Các khoản phí và lệ phí nộp ngân sách trung ương: lệ phí xuất nhập cảnh, lệ phí bay qua bầu trời, phí giao thông và các khoản phí, lệ phí khác theo quy định của Chính phủ;
h/ Thu sự nghiệp của các đơn vị do các cơ quan trung ương quản lý;
i/ Thu kết dư ngân sách trung ương;
k/ Các khoản thu khác theo quy định của pháp luật.
2. Các khoản thu được phân chia theo tỷ lệ phần trăm (%) giữa ngân sách trung ương và ngân sách cấp tỉnh:
a/ Thuế doanh thu, trừ thuế doanh thu thu từ hoạt động xổ số kiến thiết;
b/ Thuế lợi tức, trừ thuế lợi tức của các đơn vị hạch toán toàn ngành và thuế lợi tức thu từ hoạt động xổ số kiến thiết;
c/ Thuế thu nhập đối với người có thu nhập cao;
d/ Thuế chuyển lợi nhuận ra nước ngoài của các tổ chức, cá nhân nước ngoài có vốn đầu tư tại Việt Nam;
đ/ Thuế tài nguyên;
e/ Thu sử dụng vốn ngân sách của các doanh nghiệp Nhà nước.
Điều 16.- Nhiệm vụ chi của ngân sách trung ương gồm:
1. Chi thường xuyên về:
a/ Các hoạt động sự nghiệp giáo dục, đào tạo, y tế, xã hội, văn hoá, thông tin, thể dục thể thao, sự nghiệp khoa học, công nghệ và môi trường, các sự nghiệp khác do các cơ quan trung ương quản lý:
Các trường phổ thông dân tộc nội trú;
Đào tạo sau đại học, đại học, cao đẳng, trung học chuyên nghiệp, đào tạo nghề và các hình thức đào tạo bồi dưỡng khác;
Phòng bệnh, chữa bệnh và các hoạt dộng sự nghiệp y tế khác;
Các trại xã hội, phòng chống các tệ nạn xã hội và các hoạt động xã hội khác;
Bảo tồn, bảo tàng, thư viện, trùng tu di tích lịch sử đã được xếp hạng, các hoạt động biểu diễn nghệ thuật và các hoạt động văn hoá khác;
Phát thanh, truyền hình và các hoạt động thông tin khác;
Bồi dưỡng, huấn luyện huấn luyện viên, vận động viên các đội tuyển quốc gia; các giải thi đấu quốc gia và quốc tế; quản lý các cơ sở thi đấu thể dục thể thao và các hoạt động thể dục thể thao khác;
Nghiên cứu khoa học và công nghệ;
Các hoạt động về môi trường;
Các sự nghiệp khác.
b/ Các hoạt động sự nghiệp kinh tế do các cơ quan trung ương quản lý:
Sự nghiệp giao thông: duy tu, bảo dưỡng, sửa chữa cầu đường, các công trình giao thông khác, lập biển báo và các biện pháp đảm bảo an toàn giao thông trên các tuyến đường;
Sự nghiệp nông nghiệp, thuỷ lợi, ngư nghiệp và lâm nghiệp: bảo dưỡng, sửa chữa các tuyến đê, các công trình thuỷ lợi, các trạm trại nông nghiệp, ngư nghiệp, lâm nghiệp; công tác khuyến lâm, khuyến nông, khuyến ngư; công tác khoanh nuôi, bảo vệ, phòng chống cháy rừng, bảo vệ nguồn lợi thuỷ sản;
Điều tra cơ bản;
Đo đạc địa giới hành chính các cấp;
Đo vẽ bản đồ;
Đo đạc biên giới, cắm mốc biên giới;
Đo đạc, lập bản đồ và lưu trữ hồ sơ địa chính;
Định canh định cư và kinh tế mới;
Các sự nghiệp kinh tế khác.
c/ Quốc phòng, an ninh và trật tự an toàn xã hội:
Quốc phòng:
+ Đảm bảo đời sống vật chất tinh thần, chính sách cho toàn quân;
+ Đào tạo huấn luyện, nghiên cứu khoa học;
+ Mua sắm trang thiết bị vũ khí và các phương tiện quân sự cho toàn quân, kể cả bộ đội địa phương;
+ Chuẩn bị ngòi lựu, thuốc nổ và hoả cụ cung cấp cho sản xuất mìn, lựu đạn để trang bị cho dân quân tự vệ, quân nhân dự bị;
+ Chuẩn bị động viên công nghiệp, bao gồm chuẩn bị tài liệu thiết kế, công nghệ, hướng dẫn triển khai kỹ thuật, chuẩn bị các loại dụng cụ chuyên dùng, các loại trang bị đặc chủng quốc phòng;
+ Diễn tập dài ngày (trên 5 ngày) của các đơn vị dự bị động viên thuộc bộ đội chủ lực;
+ Điều động các đơn vị dân quân tự vệ, quân nhân dự bị từ tỉnh này sang tỉnh khác;
+ Xây dựng mới, sửa chữa các công trình quân sự đặc biệt, các công trình chiến đấu, trụ sở làm việc, doanh trại, kho tàng của cơ quan quân sự từ cấp huyện trở lên;
- An ninh và trật tự an toàn xã hội:
+ Đảm bảo đời sống vật chất tinh thần, chính sách xã hội cho lực lượng công an nhân dân;
+ Đào tạo huấn luyện, nghiên cứu khoa học;
+ Mua sắm trang thiết bị vũ khí và các phương tiện nghiệp vụ cho lực lượng công an nhân dân;
+ Quản lý và cải tảo phạm nhân;
+ Phòng cháy, chữa cháy;
+ Xây dựng mới, sửa chữa các công trình đặc biệt, doanh trại, trụ sở làm việc, kho tàng của lực lượng công an nhân dân; sửa chữa trại giam, trại cải tạo phạm nhân từ cấp huyện trở lên;
d/ Hoạt động của Quốc hội, Chủ tịch nước, các Bộ, cơ quan ngang Bộ, cơ quan thuộc Chính phủ, hệ thống Toà án nhân dân, Viện kiểm sát nhân dân;
đ/ Hoạt động của các cơ quan Trung ương của Đảng cộng sản Việt Nam;
e/ Hoạt động của các cơ quan trung ương của Mặt trận Tổ quốc Việt Nam, Đoàn thanh niên cộng sản Hồ Chí Minh, Hội Cựu chiến binh Việt Nam, Hội Liên hiệp phụ nữ Việt Nam, Hội Nông dân Việt Nam; hoạt động của Tổng liên đoàn lao động Việt Nam;
g/ Trợ giá theo chính sách của Nhà nước;
h/ Các chương trình quốc gia do Trung ương quản lý;
i/ Hỗ trợ quỹ bảo hiểm xã hội theo quy định của Chính phủ;
k/ Thực hiện các chính sách đối với thương binh, bệnh binh, thân nhân liệt sĩ, gia đình có công với cách mạng và các đối tượng chính sách xã hội khác;
l/ Tài trợ cho các tổ chức xã hội, xã hội - nghề nghiệp ở Trung ương theo quy định của pháp luật;
m/ Trả lãi tiền do Chính phủ vay;
n/ Viện trợ;
o/ Các khoản chi khác theo quy định của pháp luật.
2. Chi đầu tư phát triển:
a/ Đầu tư xây dựng các công trình kết cấu hạ tầng kinh tế - xã hội không có khả năng thu hồi vốn do Trung ương quản lý;
b/ Đầu tư và hỗ trợ vốn cho các doanh nghiệp nhà nước; góp vốn cổ phần, liên doanh vào các doanh nghiệp thuộc các lĩnh vực cần thiết có sự tham gia của Nhà nước theo quy định của pháp luật;
c/ Chi cho Quỹ hỗ trợ đầu tư quốc gia và các Quỹ hỗ trợ phát triển đối với các chương trình, dự án phát triển kinh tế;
d/ Dự trữ nhà nước;
đ/ Cho vay của Chính phủ để đầu tư phát triển.
3. Trả nợ gốc tiền do Chính phủ vay.
4. Bổ sung quỹ dự trữ tài chính.
5. Bổ sung cho ngân sách cấp tỉnh.
Điều 17.- Nguồn thu của ngân sách cấp tỉnh gồm:
1. Các khoản thu 100%:
a/ Tiền cho thuê mặt đất, mặt nước đối với các doanh nghiệp, kể cả doanh nghiệp có 100% vốn nước ngoài, trừ tiền cho thuê mặt đất, mặt nước từ các hoạt động thăm dò, khai thác dầu khí do Trung ương quản lý;
b/ Tiền cho thuê và tiền bán nhà ở thuộc sở hữu nhà nước;
c/ Lệ phí trước bạ;
d/ Các khoản thu từ hoạt động xổ số kiến thiết;
đ/ Viện trợ không hoàn lại bằng tiền, bằng hiện vật của các tổ chức, cá nhân ở nước ngoài trực tiếp cho cấp tỉnh theo quy định của pháp luật;
e/ Các khoản phí, lệ phí nộp vào ngân sách cấp tỉnh theo quy định của Chính phủ;
g/ Huy động của các tổ chức, cá nhân để đầu tư xây dựng các công trình kết cấu hạ tầng theo quy định của Chính phủ;
h/ Đóng góp tự nguyện của các tổ chức, cá nhân ở trong và ngoài nước cho ngân sách cấp tỉnh;
i/ Thu từ quỹ dự trữ tài chính tỉnh trong trường hợp đặc biệt;
k/ Thu sự nghiệp của các đơn vị do các cơ quan cấp tỉnh quản lý;
l/ Thu tiền vay cho đầu tư theo quy định tại khoản 3 Điều 8 của Luật ngân sách nhà nước;
m/ Thu kết dư ngân sách cấp tỉnh;
n/ Các khoản thu khác theo quy định của pháp luật;
o/ Thu bổ sung từ ngân sách trung ương.
2. Các khoản thu phân chia theo tỷ lệ phần trăm (%) giữa ngân sách trung ương và ngân sách cấp tỉnh:
a) Thuế doanh thu, trừ thuế doanh thu từ hoạt động xổ số kiến thiết;
b/ Thuế lợi tức, trừ thuế lợi tức của các đơn vị hạch toán toàn ngành và thuế lợi tức thu từ hoạt động xổ số kiến thiết;
c/ Thuế thu nhập đối với người có thu nhập cao;
d/ Thuế chuyển lợi nhuận ra nước ngoài của các tổ chức, cá nhân nước ngoài có vốn đầu tư tại Việt Nam;
đ/ Thuế tài nguyên;
e/ Thu sử dụng vốn ngân sách của các doanh nghiệp nhà nước;
3. Các khoản thu phân chia theo tỷ lệ phần trăm (%) giữa ngân sách cấp tỉnh, ngân sách cấp huyện và ngân sách xã, thị trấn:
a/ Thuế sử dụng đất nông nghiệp;
b/ Thuế chuyển quyền sử dụng đất;
c/ Thuế nhà, đất;
d/ Tiền sử dụng đất.
Điều 18.- Nhiệm vụ chi của ngân sách cấp tỉnh gồm:
1. Chi thường xuyên về:
a/ Các hoạt động sự nghiệp giáo dục, đào tạo, y tế, xã hội, văn hoá, thông tin, thể dục thể thao, sự nghiệp khoa học, công nghê và môi trường, các sự nghiệp khác do các cơ quan cấp tỉnh quản lý:
Giáo dục phổ thông, bổ túc văn hoá, nhà trẻ, mẫu giáo, phổ thông dân tộc nội trú và các hoạt động giáo dục khác;
Đại học tại chức, cao đẳng, trung học chuyên nghiệp, đào tạo nghề, đào tạo ngắn hạn và các hình thức đào tạo bồi dưỡng khác;
Phòng bệnh, chữa bệnh và các hoạt động y tế khác;
Các trại xã hội, cứu tế xã hội, cứu đói, phòng chống các tệ nạn xã hội và các hoạt động xã hội khác;
Bảo tồn, bảo tàng, thư viện, biểu diễn nghệ thuật và hoạt động văn hoá khác;
Phát thanh, truyền hình và các hoạt động thông tin khác;
Bồi dưỡng, huấn luyện huấn luyện viên, vận động viên các đội tuyển cấp tỉnh, các giải thi đấu cấp tỉnh; quản lý các cơ sở thi đấu thể dục thể thao và các hoạt động thể dục thể thao khác;
Nghiên cứu khoa học, ứng dụng tiến bộ kỹ thuật, các hoạt động sự nghiệp khoa học công nghệ khác;
Các hoạt đồng về môi trường;
Các sự nghiệp khác.
b/ Các hoạt động sự nghiệp kinh tế do các cơ quan cấp tỉnh quản lý:
Sự nghiệp giao thông: duy tu, bảo dưỡng và sữa chữa cầu đường và các công trình giao thông khác; lập biển báo và các biện pháp đảm bảo an toàn giao thông các tuyến đường;
Sự nghiệp nông nghiệp, thuỷ lợi, ngư nghiệp và lâm nghiệp: duy tu, bảo dưỡng các tuyến đê, các công trình thuỷ lợi, các trạm trại nông nghiệp, lâm nghiệp, ngư nghiệp; công tác khuyến lâm, khuyến nông, khuyến ngư; chi khoanh nuôi, bảo vệ, phòng chống cháy rừng, bảo vệ nguồn lợi thuỷ sản;
Sự nghiệp thị chính (áp dụng cho các thành phố trực thuộc Trung ương, trừ phần giao cho thị xã): duy tu, bảo dưỡng hệ thống đèn chiếu sáng, vỉa hè, hệ thống cấp thoát nước, giao thông nội thị, công viên và các sự nghiệp thị chính khác;
Đo đạc, lập bản đồ và lưu trữ hồ sơ địa chính;
Điều tra cơ bản;
Các sự nghiệp kinh tế khác;
c/ Quốc phòng, an ninh và trật tự an toàn xã hội, gồm:
Quốc phòng:
+ Huấn luyện cán bộ dân quân tự vệ;
+ Tổ chức hội nghị, tập huấn nghiệp vụ và báo cáo công tác;
+ Hoạt động của các đơn vị tự vệ luân phiên thoát ly sản xuất làm nghĩa vụ thường trực chiến đấu hoặc sẵn sàng chiến đấu ở những vùng trọng điểm biên giới, hải đảo trong một số trường hợp đặc biệt theo chỉ đạo của Bộ Quốc phòng;
+ Xây dựng phương án phòng thủ khu vực;
+ Vận chuyển vũ khí, khí tài, quân trang quân dụng cho lực lượng dân quân tự vệ và quân nhân dự bị;
+ Tiếp đón quân nhân hoàn thành nghĩa vụ quân sự trở về.
- An ninh và trật tư an toàn xã hội:
+ Hỗ trợ các chiến dịch phòng ngừa, phòng chống các loại tội phạm;
+ Hỗ trợ các chiến dịch giữ gìn an ninh và trật tự an toàn xã hội;
+ Hỗ trợ công tác phòng cháy, chữa cháy; + Hỗ trợ sửa chữa nhà tạm giam, tạm giữ.
d/ Hoạt động của các cơ quan nhà nước cấp tỉnh;
đ/ Hoạt động của các cơ quan cấp tỉnh của Đảng cộng sản Việt Nam; e/ Hoạt động các cơ quan cấp tỉnh của Mặt trận Tổ quốc Việt Nam, Đoàn thanh niên cộng sản Hồ Chí Minh, Hội Cựu chiến binh Việt Nam, Hội Liên hiệp Phụ nữ Việt Nam, Hội Nông dân Việt Nam;
g/ Tài trợ cho các tổ chức xã hội, xã hội - nghề nghiệp cấp tỉnh theo quy định của pháp luật;
h/ Thực hiện các chính sách xã hội do cấp tỉnh quản lý;
i/ Các chương trình quốc gia do Chính phủ giao cho cấp tỉnh quản lý;
k/ Trợ giá theo chính sách của Nhà nước;
l/ Trả lãi tiền vay cho đầu tư theo quy định tại khoản 3 Điều 8 của Luật ngân sách Nhà nước;
m/ Các khoản chi khác theo quy định của pháp luật.
2. Chi đầu tư phát triển:
a/ Đầu tư xây dựng các công trình kết cấu hạ tầng kinh tế - xã hội do cấp tỉnh quản lý;
b/ Đầu tư và hỗ trợ vốn cho các doanh nghiệp nhà nước theo quy định của pháp luật.
3. Chi trả nợ gốc tiền vay cho đầu tư theo quy định tại khoản 3 Điều 8 của Luật ngân sách nhà nước.
4. Chi bổ sung quỹ dự trữ tài chính.
5. Chi bổ sung cho ngân sách cấp dưới.
Điều 19.- Nguồn thu của ngân sách cấp huyện gồm:
1. Các khoản thu 100%:
a/ Thuế môn bài, trừ thuế môn bài thu từ các hộ kinh doanh nhỏ trên địa bàn xã, thị trấn;
b/ Thuế sát sinh thu từ các doanh nghiệp giết mổ gia súc trên địa bàn phường;
c/ Các khoản phí và lệ phí từ các hoạt động do các cơ quan thuộc cấp huyện quản lý;
d/ Tiền thu từ hoạt động sự nghiệp của các đơn vị do cấp huyện quản lý;
đ/ Viện trợ không hoàn lại của các tổ chức, cá nhân ở nước ngoài trực tiếp cho cấp huyện theo quy định của pháp luật;
e/ Đóng góp của các tổ chức, cá nhân để đầu tư xây dựng các công trình kết cấu hạ tầng theo quy định của Chính phủ;
g/ Đóng góp tự nguyện của các tổ chức, cá nhân ở trong và ngoài nước cho ngân sách cấp huyện;
h/ Thu kết dư ngân sách cấp huyện;
i/ Bổ sung từ ngân sách cấp tỉnh;
k/ Các khoản thu khác theo quy định của pháp luật.
2. Các khoản thu phân chia theo tỷ lệ phần trăm (%) giữa ngân sách cấp tỉnh, ngân sách cấp huyện và ngân sách xã, thị trấn:
a/ Thuế sử dụng đất nông nghiệp;
b/ Thuế chuyển quyền sử dụng đất;
c/ Thuế nhà, đất;
d/ Tiền sử dụng đất.
3. Ngoài các khoản thu quy định tại các khoản 1 và 2 Điều này, đối với các thị xã, thành phố thuộc tỉnh còn được phân chia thêm một phần theo tỷ lệ phần trăm (%) về thuế doanh thu (trừ thuế doanh thu thu từ hoạt động xổ số kiến thiết), thuế lợi tức (trừ thuế lợi tức của các đơn vị hạch toán toàn ngành và thuế lợi tức thu từ hoạt động xổ số kiến thiết), lệ phí trước bạ thu trên địa bàn.
Điều 20.- Nhiệm vụ chi của ngân sách cấp huyện gồm:
1. Chi thường xuyên về:
a/ Các hoạt động sự nghiệp văn hoá, thông tin, thể dục thể thao, xã hội và các sự nghiệp khác do cơ quan cấp huyện quản lý.
b/ Các hoạt động sự nghiệp kinh tế do cơ quan cấp huyện quản lý:
Nông nghiệp, ngư nghiệp, lâm nghiệp, thuỷ lợi;
Giao thông;
Sự nghiệp thị chính (áp dụng đối với ngân sách thị xã, thành phố thuộc tỉnh): duy tu, bảo dưỡng hệ thống đèn chiếu sáng, vỉa hè, hệ thống cấp thoát nước, giao thông nội thị, công viên và các sự nghiệp thị chính khác;
Các sự nghiệp kinh tế khác.
c/ Quốc phòng an ninh và trật tự an toàn xã hội:
- Quốc phòng:
+ Công tác giáo dục quốc phòng toàn dân;
+ Công tác tuyển quân và đón tiếp quân nhân hoàn thành nghĩa vụ trở về;
+ Đăng ký quân nhân dự bị;
+ Tổ chức huấn luyện cán bộ dân quân tự vệ;
+ Hội nghị và tập huấn nghiệp vụ dân quân tự vệ.
An ninh và trật tư an toàn xã hội:
+ Tuyên truyền giáo dục phong trào quần chúng bảo vệ an ninh;
+ Hỗ trợ các chiến dịch giữ gìn an ninh và trật tự an toàn xã hội;
d/ Hoạt động của các cơ quan nhà nước cấp huyện;
đ/ Hoạt động của các cơ quan cấp huyện của Đảng cộng sản Việt Nam;
e/ Hoạt động các cơ quan cấp huyện của Mặt trận Tổ quốc Việt Nam, Đoàn thanh niên cộng sản Hồ Chí Minh, Hội Cựu chiến binh Việt Nam, Hội Liên hiệp Phụ nữ Việt Nam, Hội Nông dân Việt Nam;
g/ Tài trợ cho các tổ chức xã hội, xã hội - nghề nghiệp cấp huyện theo quy định của pháp luật;
h/ Các khoản chi khác theo quy định của pháp luật.
2. Chi đầu tư phát triển:
Chi đầu tư xây dựng các công trình kết cấu hạ tầng kinh tế - xã hội theo phân cấp của tỉnh. Trong phân cấp đối với thị xã, thành phố thuộc tỉnh, phải có nhiệm vụ chi đầu tư xây dựng các trường phổ thông quốc lập các cấp và các công trình phúc lợi công cộng, điện chiếu sáng, cấp thoát nước, giao thông nội thị, an toàn giao thông, vệ sinh đô thị.
3. Chi bổ sung cho ngân sách cấp dưới.
Điều 21.- Nguồn thu của ngân sách xã, thị trấn gồm:
1. Các khoản thu 100%:
a/ Thuế môn bài thu từ các hộ kinh doanh nhỏ;
b/ Thuế sát sinh;
c/ Các khoản phí, lệ phí và các khoản đóng góp cho ngân sách xã, thị trấn theo quy định của pháp luật;
d/ Thu từ sử dụng quỹ đất công ích và thu hoa lợi công sản khác;
đ/ Tiền thu từ các hoạt động sự nghiệp do xã, thị trấn quản lý;
e/ Các khoản đóng góp tự nguyện cho xã, thị trấn;
g/ Viện trợ không hoàn lại của các tổ chức và cá nhân ở nước ngoài trực tiếp cho xã, thị trấn theo quy định của pháp luật;
h/ Thu kết dư của ngân sách xã, thị trấn;
i/ Bổ sung từ ngân sách cấp trên;
k/ Các khoản thu khác theo quy định của pháp luật.
2. Các khoản thu phân chia theo tỷ lệ phần trăm (%) giữa ngân sách cấp tỉnh, ngân sách cấp huyện và ngân sách xã, thị trấn:
a/ Thuế sử dụng đất nông nghiệp;
b/ Thuế chuyển quyền sử dụng đất;
c/ Thuế nhà, đất;
d/ Tiền sử dụng đất.
Điều 22.- Nhiệm vụ chi của ngân sách xã, thị trấn gồm:
1. Chi thường xuyên về:
a/ Công tác xã hội và hoạt động văn hoá, thông tin, thể dục thể thao do xã, thị trấn quản lý;
b/ Hỗ trợ kinh phí bổ túc văn hoá, nhà trẻ, mẫu giáo do xã, thị trấn quản lý;
c/ Hoạt động y tế xã, thị trấn;
d/ Quản lý, duy tu, bảo dưỡng các công trình kiến trúc, tài sản, công trình phúc lợi, đường giao thông do xã, thị trấn quản lý;
đ/Hoạt động của các cơ quan nhà nước xã, thị trấn;
e/ Hoạt động của cơ quan Đảng cộng sản Việt Nam, Mặt trận Tổ quốc Việt Nam, Đoàn thanh niên cộng sản Việt Nam, Hội Cựu chiến binh Việt Nam, Hội liên hiệp Phụ nữ Việt Nam, Hội Nông dân Việt Nam xã, thị trấn;
g/ Công tác dân quân tự vệ, trật tự an toàn xã hội:
Huấn luyện dân quân tự vệ;
Đăng ký nghĩa vụ quân sự, đưa thanh niên đi làm nghĩa vụ quân sự;
Tuyên truyền, vận động phong trào quần chúng bảo vệ an ninh, trật tự an toàn xã hội.
h) Các khoản chi khác theo quy định của pháp luật.
2. Chi đầu tư phát triển:
Đầu tư xây dựng các công trình kết cấu hạ tầng kinh tế - xã hội theo phân cấp của tỉnh.
Điều 24.- Nguồn thu của ngân sách phường gồm:
1. Các khoản phí, lệ phí và các khoản đóng góp cho ngân sách phường theo quy định của pháp luật;
2. Thuế sát sinh, trừ thuế sát sinh thu từ các doanh nghiệp giết mổ gia súc;
3. Các khoản đóng góp tự nguyện của các tổ chức, cá nhân cho phường;
4. Viện trợ không hoàn lại của các tổ chức và cá nhân ở nước ngoài trực tiếp cho phường theo quy định của pháp luật;
5. Thu kết dư ngân sách địa phường;
6. Bổ sung từ ngân sách cấp trên;
7. Các khoản thu khác theo quy định của pháp luật.
Điều 25.- Nhiệm vụ chi của ngân sách phường gồm:
1. Chi công tác xã hội và hoạt động văn hoá, thông tin, thể dục thể thao do phường quản lý;
2. Chi về hoạt động cơ quan nhà nước phường;
3. Hoạt động của cơ quan Đảng cộng sản Việt Nam, Mặt trận Tổ quốc Việt Nam, Đoàn thanh niên cộng sản Hồ Chí Minh, Hội Cựu chiến bình Việt Nam, Hội Liên hiệp Phụ nữ Việt Nam, Hội Nông dân Việt Nam phường;
4. Chi về công tác dân quân tự vệ, trật tư an toàn xã hội:
Huấn luyện dân quân tự vệ;
Đăng ký nghĩa vụ quân sự, đưa thanh niên đi là nghĩa vụ quân sự;
Tuyên truyền, vận động phong trào quần chúng bảo vệ an ninh, trật tự an toàn xã hội.
5. Các khoản chi khác theo quy định của pháp luật.
Điều 26.- Ngoài các nguồn thu quy định tại Điều 17 của Nghị định này; chính quyền tỉnh được quyền:
1. Huy động vốn trong nước để đầu tư xây dựng các công trình kết cấu hạ tầng quy định tại khoản 3 Điều 8 của Luật Ngân sách Nhà nước. Mức dư nợ các nguồn vốn huy động tại thời điểm huy động không vượt quá 30% vốn đầu tư xây dựng cơ bản hàng năm của ngân sách cấp tỉnh. Khi có nhu cầu huy động vốn, Uỷ ban nhân dân tỉnh lập phương án báo cáo Hội đồng nhân dân thông qua, gửi Bộ Tài chính và Bộ Kế hoạch và Đầu tư thẩm định trình Thủ tướng Chính phủ xem xét, quyết định. Các nguồn vốn huy động được đưa vào cân đối ngân sách cấp tỉnh và chỉ được chi cho mục tiêu đã định. Nội dung phương án phải nêu rõ:
Dự án đầu tư được cơ quan có thẩm quyền quyết định;
Hiệu quả kinh tế - xã hội của dự án;
Tổng số vốn đầu tư cần huy động và dự kiến nguồn bảo đảm trả nợ của ngân sách cấp tỉnh;
Hình thức huy động vốn; khối lượng huy động; lãi suất và phương án trả nợ khi đến hạn;
Dư nợ vốn huy động;
Cân đối ngân sách cấp tỉnh năm hiện tại và kế hoạch ngân sách các năm tiếp theo;
Các tài liệu khác nhằm thuyết minh rõ phương án.
2. Quyết định mức phụ thu theo quy định của Thủ tướng Chính phủ để xây dựng các công trình kết cấu hạ tầng và chi cho các mục tiêu nhất định. Uỷ ban nhân dân tỉnh lập phương án huy động và sử dụng tiền phụ thu báo cáo Hội đồng nhân dân xem xét, quyết định. Các nguồn phụ thu được đưa vào cân đối ngân sách cấp tỉnh và chỉ được chi cho mục tiêu đã định.
3. Quyết định mức thu phí và lệ phí theo quy định của pháp luật.
Điều 27.- Việc lập quỹ đầu tư của thành phố, thị xã được thực hiện theo quy định riêng của Chính phủ.
Điều 28.-
1. Chính phủ quyết định cụ thể tỷ lệ phần trăm (%) phân chia các khoản thu giữa ngân sách Trung ương với ngân sách từng tỉnh, thành phố trực thuộc Trung ương; tỷ lệ này được áp dụng chung đối với tất cả các khoản thu được phân chia.
2. Uỷ ban nhân dân tỉnh quy định tỷ lệ phần trăm (%) phân chia các khoản thu giữa ngân sách cấp tỉnh với ngân sách từng huyện, quận, thị xã, thành phố thuộc tỉnh và ngân sách từng xã, thị trấn. Việc quy định tỷ lệ phần trăm (%) về thuế doanh thu, thuế lợi tức quy định tại khoản 3 Điều 32 Luật Ngân sách Nhà nước phải bảo đảm tổng mức phân chia cho ngân sách cấp tỉnh và ngân sách thị xã, thành phố thuộc tỉnh không được vượt quá mức quy định cho tỉnh về 2 loại thuế này.
Bộ trưởng Bộ Tài chính quy định phương pháp tính số bổ sung từ ngân sách cấp trên cho ngân sách cấp dưới theo quy định tại Điều 40 Luật Ngân sách Nhà nước.
LẬP DỰ TOÁN NGÂN SÁCH NHÀ NƯỚC
Điều 30.- Căn cứ lập dự toán ngân sách nhà nước hàng năm:
Nhiệm vụ phát triển kinh tế - xã hội và bảo đảm quốc phòng, an ninh;
Những nhiệm vụ cụ thể của các Bộ, ngành, địa phương;
Phân cấp quản lý ngân sách nhà nước; tỷ lệ phần trăm (%) phân chia các khoản thu và mức bổ sung của ngân sách cấp trên cho ngân sách cấp dưới đã được quy định;
Chế độ thu; chế độ, tiêu chuẩn, định mức chi ngân sách;
Số kiểm tra về dự toán ngân sách do cơ quan có thẩm quyền thông báo;
Tình hình thực hiện dự toán ngân sách các năm trước.
Điều 31.-
1. Trước ngày 15 tháng 6 hàng năm, Thủ tướng Chính phủ ra chỉ thị về việc xây dựng kế hoạch phát triển kinh tế - xã hội và dự toán ngân sách năm sau, làm căn cứ hướng dẫn lập dự toán ngân sách nhà nước.
2. Căn cứ vào Chỉ thị của Thủ tướng Chính phủ, Bộ Tài chính hướng dẫn các cơ quan trung ương, các địa phương về yêu cầu, nội dung, thời hạn lập dự toán ngân sách nhà nước và thông báo số kiểm tra về dự toán ngân sách nhà nước.
3. Các cơ quan trung ương, Uỷ ban nhân dân tỉnh căn cứ Chỉ thị của Thủ tướng Chính phủ, hướng dẫn của Bộ Tài chính và căn cứ yêu cầu nhiệm vụ cụ thể của cơ quan, địa phương, hướng dẫn và thông báo số kiểm tra về dự toán ngân sách cho các đơn vị trực thuộc và Uỷ ban nhân dân cấp dưới lập dự toán thu, chi ngân sách thuộc phạm vi quan lý.
Điều 32.- Yêu cầu đối với dự toán ngân sách hàng năm:
2. Dự toán ngân sách các cấp phải tổng hợp theo từng loại thu, từng lĩnh vực chi và theo cơ cấu giữa chi thường xuyên, chi đầu tư phát triển, chi trả nợ.
3. Dự toán ngân sách phải kèm theo báo cáo thuyết minh rõ cơ sở, căn cứ tính toán.
Điều 34.-
1. Cục Hải quan các tỉnh lập kế hoạch thu thuế xuất khẩu, thuế nhập khẩu thuộc mình quản lý và các khoản thu khác liên quan đến xuất, nhập khẩu gửi Tổng cục Hải quan, Uỷ ban nhân dân tỉnh, đồng gửi Sở Tài chính, Vật giá.
Tổng cục Hải quan phối hợp với Bộ Tài chính, Bộ Kế hoạch và Đầu tư, Bộ Thương mại lập dự toán thu thuế xuất khẩu, thuế nhập khẩu, thuế tiêu thụ đặc biệt hàng nhập khẩu và các khoản thu khác liên quan đến xuất, nhập khẩu của cả nước gửi Bộ Tài chính để tổng hợp vào dự toán thu ngân sách nhà nước trình Chính phủ.
2. Cơ quan thuế ở địa phương lập dự toán thu ngân sách nhà nước trên địa bàn thuộc phạm vi quản lý gửi cơ quan thuế cấp trên, Uỷ ban nhân dân và cơ quan tài chính cùng cấp.
Điều 35.-
1. Các đơn vị dự toán và các doanh nghiệp nhà nước lập dự toán thu, chi ngân sách thuộc phạm vi nhiệm vụ được giao, gửi cơ quan quản lý cấp trên.
2. Các cơ quan nhà nước ở Trung ương và địa phương lập dự toán thu, chi ngân sách thuộc phạm vi trực tiếp quản lý, xem xét dự toán do các đơn vị trực thuộc lập; tổng hợp và lập dự toán thu, chi ngân sách thuộc phạm vi quản lý gửi cơ quan tài chính cùng cấp, đồng gửi:
- Cơ quan kế hoạch cùng cấp (phần dự toán chi đầu tư xây dựng cơ bản);
- Cơ quan quản lý ngành, lĩnh vực cấp trên (phần dự toán chi ngân sách theo ngành, lĩnh vực);
- Cơ quan quản lý chương trình quốc gia (phần dự toán chi chương trình quốc gia).
Cơ quan quản lý ngành, lĩnh vực tổng hợp và lập dự toán thu, chi ngân sách thuộc ngành, lĩnh vực gửi cơ quan tài chính cùng cấp và cơ quan quản lý ngành, lĩnh vực cấp trên.
Dự toán thu, chi ngân sách phải kèm theo bản thuyết minh chi tiết căn cứ tính toán từng khoản thu, chi.
Điều 36.- Lập và quyết định dự toán ngân sách nhà nước và dự toán ngân sách các cấp:
1. Lập và quyết định dự toán ngân sách xã:
Uỷ ban nhân dân xã lập dự toán thu, chi ngân sách xã, trình Hội đồng nhân dân xã xem xét quyết định và báo cáo Uỷ ban nhân dân huyện, đồng gửi Phòng Tài chính - Vật giá huyện.
Hội đồng nhân dân xã quyết định dự toán ngân sách xã năm sau trước ngày 15 tháng 8 năm trước.
2. Lập và quyết định dự toán ngân sách huyện:
Phòng Tài chính huyện xem xét dự toán ngân sách của các đơn vị thuộc huyện và dự toán thu do cơ quan thuế lập, lập dự toán và phương án phân bổ ngân sách cấp huyện; tổng hợp, lập dự toán thu ngân sách nhà nước trên địa bàn, dự toán thu, chi ngân sách huyện (gồm dự toán ngân sách các xã và dự toán ngân sách cấp huyện) báo cáo Uỷ ban nhân dân huyện để trình Hội đồng nhân dân huyện quyết định và báo cáo Uỷ ban nhân dân tỉnh, Sở Tài chính Vật giá, đồng gửi:
Sở Kế hoạch và Đầu tư (phần dự toán vốn đầu tư xây dựng cơ bản);
Sở quản lý ngành, lĩnh vực (phần dự toán chi theo ngành, lĩnh vực do Sở quản lý).
Hội đồng nhân dân huyện quyết định dự toán ngân sách huyện năm sau trước 31 tháng 8 năm trước.
3. Lập và quyết định dự toán ngân sách tỉnh:
Sở Tài chính - Vật giá xem xét dự toán ngân sách của các đơn vị thuộc tỉnh lập, dự toán thu do cơ quan thuế, cơ quan hải quan lập (nếu có), lập dự toán và phương án phân bổ ngân sách cấp tỉnh; tổng hợp, lập dự toán thu ngân sách nhà nước trên địa bàn, dự toán thu, chi ngân sách tỉnh (gồm dự toán ngân sách huyện và dự toán ngân sách cấp tỉnh) trình Uỷ ban nhân dân tỉnh để trình Hội đồng nhân dân tỉnh quyết định, trình Chính phủ và báo cáo Bộ Tài chính, đồng gửi:
Bộ Kế hoạch và Đầu tư (phần dự toán chi đầu tư xây dựng cơ bản);
Cơ quan quản lý ngành, lĩnh vực (phần dự toán chi theo ngành, lĩnh vực);
Cơ quan quản lý chương trình quốc gia (phần dự toán chi chương trình quốc gia).
Hội đồng nhân dân tỉnh quyết định dự toán ngân sách tỉnh năm sau trước ngày 15 tháng 9 năm trước.
4. Lập và quyết định dự toán ngân sách nhà nước và ngân sách trung ương.
Bộ Tài chính chủ trì phối hợp với các Bộ, căn cứ vào dự toán thu, chi ngân sách do các Bộ, cơ quan nhà nước trung ương và các tỉnh lập, dự toán chi theo ngành, lĩnh vực, chi chương trình quốc gia do các Bộ, cơ quan quản lý chương trình quốc gia lập, nhu cầu trả nợ và khả năng vay, lập dự toán thu, chi ngân sách trung ương, tổng hợp và lập dự toán thu, chi ngân sách nhà nước trình Chính phủ để trình Quốc hội quyết định; lập phương án phân bổ ngân sách trung ương cho từng Bộ, ngành và mức bổ sung ừ ngân sách trung ương cho từng tỉnh trình Chính phủ để trình Uỷ ban thường vụ Quốc hội quyết định.
1. Uỷ ban nhân dân:
a/ Hướng dẫn, tổ chức và chỉ đạo các đơn vị trực thuộc, chính quyền cấp dưới lập dự toán thu, chi ngân sách thuộc phạm vi quản lý; phối hợp và chỉ đạo cơ quan thuế, hải quan ở địa phương lập dự toán thu ngân sách nhà nước trên địa bàn;
b/ Trước khi trình Hội đồng nhân dân quyết định dự toán ngân sách, phải xin ý kiến của Uỷ ban nhân dân cấp trên (đối với Uỷ ban nhân dân tỉnh phải xin ý kiến của Thủ tướng Chính phủ);
c/ Kiểm tra nghị quyết về dự toán ngân sách của Hội đồng nhân dân cấp dưới; yêu cầu Hội đồng nhân dân cấp dưới điều chỉnh lại dự toán ngân sách trong trường hợp cần thiết.
2. Cơ quan tài chính các cấp:
a/ Tổ chức làm việc với Uỷ ban nhân dân cấp dưới, các cơ quan, đơn vị có liên quan; có quyền yêu cầu bố trí lại những khoản thu, chi trong dự toán chưa đúng chế độ, tiêu chuẩn, chưa hợp lý, chưa tiết kiệm, chưa phù hợp với khả năng ngân sách và định hướng phát triển kinh tế - xã hội trước khi Hội đồng nhân dân quyết định ngân sách; dự kiến mức bổ sung hàng năm từ ngân sách cấp trên cho ngân sách cấp dưới.
Trong quá trình thảo luận để tổng hợp và lập dự toán ngân sách, nếu còn có ý kiến khác nhau giữa cơ quan tài chính với các cơ quan và chính quyền cấp dưới, cơ quan tài chính các cấp ở địa phương phải trình Chủ tịch Uỷ ban nhân dân cùng cấp quyết định; Bộ Tài chính phải trình Chính phủ hoặc Thủ tướng Chính phủ quyết định;
b/ Chủ trì phối hợp với các cơ quan, đơn vị có liên quan lập phương án phân bổ dự toán ngân sách cấp mình;
c/ Phối hợp với cơ quan kế hoạch và đầu tư cùng cấp trong việc lập và phân bổ dự toán chi đầu tư xây dựng cơ bản tập trung cho từng đơn vị, từng dự án, công trình;
d/ Phối hợp với cơ quan quản lý chương trình quốc gia trong việc lập phương án phân bổ dự toán chi chương trình quốc gia cho các đơn vị;
đ/ Đề xuất các phương án cân đối ngân sách và các biện pháp nhằm thực hiện chính sách tăng thu, tiết kiệm chi ngân sách.
g/ Bộ Tài chính xem xét Nghị quyết về dự toán ngân sách của Hội đồng nhân dân tỉnh để đề xuất ý kiến trình Thủ tướng Chính phủ yêu cầu Hội đồng nhân dân tỉnh điều chỉnh lại dự toán ngân sách tỉnh trong trường hợp cần thiết;
3. Cơ quan kế hoạch và đầu tư các cấp:
a/ Bộ Kế hoạch và Đầu tư trình Chính phủ dự án kế hoạch phát triển kinh tế - xã hội của cả nước và các cân đối chủ yếu của nền kinh tế quốc dân, trong đó có cân đối tài chính, tiền tệ, vốn đầu tư xây dựng cơ bản, làm cơ sở cho việc xây dựng kế hoạch tài chính, ngân sách; trình Chính phủ để trình Quốc hội danh mục các chương trình, dự án quốc gia, các công trình xây dựng cơ bản quan trọng được đầu tư từ nguồn ngân sách nhà nước.
b/ Bộ Kế hoạch và Đầu tư, cơ quan kế hoạch và đầu tư ở địa phương thống nhất với cơ quan tài chính cùng cấp lập và phân bổ kế hoạch đầu tư xây dựng cơ bản tập trung cho từng đơn vị, từng dự án, công trình gửi cơ quan tài chính cùng cấp để làm căn cứ tổng hợp, lập dự toán ngân sách trình cấp có thẩm quyền quyết định và giao cho các đơn vị.
4. Các cơ quan nhà nước ở Trung ương và địa phương:
a/ Các Bộ, ngành phối hợp với Bộ Tài chính trong việc xây dựng chế độ, tiêu chuẩn, định mức chi ngân sách nhà nước thuộc ngành, lĩnh vực phụ trách;
b/ Các cơ quan nhà nước ở Trung ương và địa phương tổ chức lập dự toán thu, chi ngân sách thuộc phạm vi quản lý, lập dự toán chi theo ngành, lĩnh vực phụ trách gửi cơ quan tài chính cùng cấp và cơ quan quản lý ngành, lĩnh vực cấp trên; phối hợp với cơ quan tài chính cùng cấp và Uỷ ban nhân dân cấp dưới lập và phân bổ dự toán ngân sách theo ngành, lĩnh vực;
c/ Các cơ quan quản lý chương trình quốc gia phối hợp với cơ quan tài chính cùng cấp lập dự toán và phương án phân bổ dự toán chi chương trình quốc gia cho các đơn vị, địa phương gửi cơ quan tài chính cùng cấp để tổng hợp vào dự toán ngân sách và phương án phân bổ ngân sách trình cấp có thẩm quyền quyết định và giao cho các đơn vị.
Điều 38.-
1. Sau khi dự toán ngân sách nhà nước được Quốc hội quyết định, Bộ Tài chính có trách nhiệm:
a/ Trình Chính phủ phương án phân bổ ngân sách trung ương cho từng Bộ, ngành và mức bổ sung từ ngân sách trung ương cho từng tỉnh để Chính phủ trình Uỷ ban thường vụ Quốc hội quyết định;
b/ Căn cứ vào Nghị quyết của Quốc hội và Nghị quyết của Uỷ ban thường vụ Quốc hội, trình Thủ tướng Chính phủ quyết định giao nhiệm vụ thu, chi ngân sách cho từng Bộ, ngành; nhiệm vụ thu, chi và mức bổ sung từ ngân sách trung ương cho từng tỉnh;
c/ Hướng dẫn chi tiết nhiệm vụ thu, chi ngân sách cho các cơ quan trung ương, Uỷ ban nhân dân tỉnh, các doanh nghiệp nhà nước.
2. Trong trường hợp Nghị quyết của Hội đồng nhân dân không phù hợp với nhiệm vụ thu, chi ngân sách cấp trên giao, Uỷ ban nhân dân điều chỉnh lại dự toán ngân sách và phương án phân bổ thu, chi ngân sách, trình Hội đồng nhân dân quyết định.
3. Căn cứ vào Nghị quyết của Hội đồng nhân dân cùng cấp, Uỷ ban nhân dân quyết định giao nhiệm vụ thu, chi ngân sách cho từng cơ quan, đơn vị trực thuộc; nhiệm vụ thu, chi và mức bổ sung cho ngân sách cấp dưới.
Điều 39.-
1. Dự toán ngân sách nhà nước khi trình Quốc hội phải kèm theo các tài liệu cần thiết theo quy định tại Điều 47 Luật Ngân sách nhà nước.
2. Dự toán ngân sách các cấp chính quyền địa phương khi trình Hội đồng nhân dân phải kèm theo các tài liệu cần thiết sau:
a/ Báo cáo tình hình thực hiện ngân sách năm trước, phương hướng, nhiệm vụ, mục tiêu, căn cứ xây dựng dự toán ngân sách và biện pháp thực hiện dự toán ngân sách;
b/ Danh mục các công trình xây dựng kết cấu hạ tầng kinh tế - xã hội;
c/ Phương án phụ thu và sử dụng phụ thu;
d/ Phương án huy động và sử dụng khoản đóng góp của các tổ chức, cá nhân để đầu tư xây dựng công trình kết cấu hạ tầng;
đ/ Trường hợp ngân sách cấp tỉnh có nhu cầu huy động vốn đầu tư trong nước để đầu tư xây dựng công trình kết cấu hạ tầng do cấp tỉnh quản lý, phải có thêm hồ sơ dự án để trình Hội đồng nhân dân, gửi Bộ Kế hoạch và Đầu tư, Bộ Tài chính thẩm định trình Thủ tướng Chính phủ quyết định;
e/ Các tài liệu khác nhằm thuyết minh rõ dự toán thu, chi ngân sách.
Điều 41.-
1. Sau khi được Chính phủ, Uỷ ban nhân dân giao kế hoạch ngân sách, các cơ quan nhà nước ở Trung ương và địa phương có trách nhiệm phân bổ dự toán ngân sách được giao cho các đơn vị sử dụng ngân sách, bảo đảm đúng với dự toán ngân sách được giao cả về tổng mức và chi tiết.
2. Kết quả phân bổ dự toán ngân sách cho các đơn vị sử dụng ngân sách phải gửi cơ quan tài chính cùng cấp và kho bạc nơi giao dịch; cơ quan tài chính có trách nhiệm kiểm tra nếu có vấn đề không phù hợp với nội dung dự toán do cơ quan có thẩm quyền giao thì yêu cầu điều chỉnh lại.
3. Việc phân bổ và giao dự toán ngân sách cho các đơn vị sử dụng ngân sách phải kết thúc trước 31 tháng 12 năm trước.
Điều 42.-
1. Trong trường hợp vào đầu năm ngân sách, dự toán ngân sách và phân bổ ngân sách chưa được cơ quan nhà nước có thẩm quyền quyết định, cơ quan tài chính được phép tạm cấp kinh phí cho các nhiệm vụ chi sau:
Chi lương và các khoản có tính chất tiền lương;
Chi nghiệp vụ phí và công vụ phí;
Một số khoản chi cần thiết khác để bảo đảm hoạt động của bộ máy, trừ các khoản mua sắm trang thiết bị, sửa chữa.
Chi cho các công trình xây dựng cơ bản chuyển tiếp thuộc nguồn ngân sách nhà nước đã xác định khối lượng đủ điều kiện thanh toán;
Chi cho dự án chuyển tiếp thuộc các chương trình quốc gia;
Chi bổ sung cho ngân sách cấp dưới.
2. Mức tạm cấp hàng tháng tối đa không quá mức chi bình quân 1 tháng của 1 năm trước.
Điều 43.-
1. Các tổ chức, cá nhân, kể cả các tổ chức, cá nhân nước ngoài hoạt động trên lãnh thổ nước Cộng hoà xã hội chủ nghĩa Việt Nam có nghĩa vụ nộp đầy đủ, đúng hạn các khoản thuế, phí, lệ phí và các khoản thu khác vào ngân sách nhà nước theo quy định của pháp luật.
2. Khi các tổ chức, cá nhân chậm nộp các khoản phải nộp ngân sách nhà nước mà không có lý do chính đáng, căn cứ vào yêu cầu của cơ quan có thẩm quyền nêu tại khoản 3 Điều này, các ngân hàng và kho bạc phải trích từ tài khoản tiền gửi của tổ chức, cá nhân đó nộp vào ngân sách nhà nước hoặc áp dụng các biện pháp tài chính khác để thu cho ngân sách.
3. Các cơ quan có thẩm quyền yêu cầu ngân hàng, kho bạc trích tài khoản của tổ chức, cá nhân để nộp ngân sách nhà nước là:
- Cơ quan thuế, cơ quan hải quan đối với việc chậm nộp các khoản thuế và phí;
- Cơ quan tài chính đối với việc chậm nộp các khoản thu khác.
4. Trường hợp các tổ chức, cá nhân cố tình không nộp thì ngoài việc trích tài khoản để nộp ngân sách còn bị xử lý theo quy định của pháp luật.
Điều 45.-
1. Chỉ các cơ quan dưới đây được tổ chức thu ngân sách nhà nước:
Cơ quan Thuế nhà nước;
Cơ quan Hải quan;
Cơ quan tài chính và các cơ quan khác được Chính phủ cho phép, hoặc được Bộ Tài chính uỷ quyền.
2. Cơ quan thu có nhiệm vụ và quyền hạn quy định tại Điều 59 của Luật ngân sách nhà nước.
3. Cơ quan thu phải sử dụng chứng từ do Bộ Tài chính phát hành để thực hiện thu, nộp ngân sách.
Điều 46.-
1. Căn cứ vào mục đích vay, việc sử dụng vốn vay được thực hiện theo nguyên tắc:
Đối với các khoản vay cho các dự án đầu tư xây dựng các công trình kết cấu hạ tầng và các dự án phát triển kinh tế - xã hội thuộc đối tượng ngân sách nhà nước cấp phát, Bộ Tài chính thực hiện cấp phát vốn theo chế độ quy định.
Đối với các khoản vay cho các dự án thuộc đối tượng tín dụng nhà nước, Bộ Tài chính thực hiện cho vay lại.
1. Đối với các khoản viện trợ đã xác định được đơn vị sử dụng thì cơ quan tài chính làm thủ tục ghi thu, ghi chi qua ngân sách nhà nước.
2. Đối với các khoản viện trợ chưa xác định đơn vị sử dụng, cơ quan tài chính có trách nhiệm quản lý và ghi thu ngân sách, đồng thời xác định phương án sử dụng theo đúng các cam kết, mục tiêu đã thoả thuận với phía viện trợ, trình cấp có thẩm quyền quyết định, sau đó phân phối cho các đơn vị sử dụng và làm thủ tục cấp phát ngân sách nhà nước.
Điều 48.- Chi ngân sách nhà nước chỉ được thực hiện khi có đủ các điều kiện sau đây:
1. Đã có trong dự toán ngân sách nhà nước được duyệt, trừ các trường hợp sau:
a/ Dự toán ngân sách và phân bổ dự toán ngân sách chưa được cơ quan có thẩm quyền quyết định hoặc phải điều chỉnh phân bổ dự toán ngân sách như quy định tại các Điều 56 và 62 của Luật ngân sách nhà nước;
b/ Chi từ nguồn dự phòng ngân sách theo quyết định của cấp có thẩm quyền;
2. Đúng chế độ, tiêu chuẩn, định mức do cơ quan nhà nước có thẩm quyền quy định;
3. Đã được thủ trưởng đơn vị sử dụng ngân sách hoặc người được uỷ quyền chuẩn chi;
4. Ngoài các điều kiện quy định tại các khoản 1, 2, 3 của Điều này, trường hợp sử dụng kinh phí ngân sách nhà nước để đầu tư xây dựng cơ bản, mua sắm trang thiết bị, phương tiện làm việc và các công việc khác phải đấu thấu thì còn phải tổ chức đấu thầu theo quy định của Chính phủ.
1. Cơ quan tài chính:
a) Kiểm tra việc phân bổ dự toán ngân sách cho các đơn vị sử dụng theo quy định tại Điều 41 của Nghị định này;
b) Thông báo hạn mức chi hàng quý phù hợp với nội dung và tiến độ thực hiện nhiệm vụ chi trong phạm vi dự toán năm được duyệt;
c) Kiểm tra mục đích, tính chát của từng khoản chi, bảo đảm đủ các điều kiện chi được quy định trước khi ra lệnh xuất quỹ ngân sách trong các trường hợp cơ quan tài chính cấp phát trực tiếp;
d) Kiểm tra việc sử dụng ngân sách ở các cơ quan và đơn vị sử dụng ngân sách.
2. Cơ quan Kho bạc nhà nước:
Kiểm tra lệnh chuẩn chi; nếu lệnh chuẩn chi phù hợp với hạn mức chi do cơ quan tài chính thông báo và bảo đảm các điều kiện chi quy định tại Điều 48 Nghị định này thì thanh toán cho người nhận tiền.
3. Cơ quan nhà nước ở Trung ương và địa phương:
a/ Căn cứ vào hạn mức chi hàng quý được cơ quan tài chính thông báo, phân phối mức chi hàng quý cho các đơn vị trực thuộc theo uỷ quyền của cơ quan tài chính; đồng gửi cho cơ quan tài chính đồng cấp và Kho bạc Nhà nước nơi giao dịch;
b/ Hướng dẫn, theo dõi, kiểm tra việc sử dụng ngân sách thuộc ngành, lĩnh vực do cơ quan quản lý và của các đơn vị trực thuộc.
4. Đơn vị sử dụng ngân sách:
a/ Chuẩn chi đúng chế độ, tiêu chuẩn và mức chi được phân phối do cơ quan có thẩm quyền quy định;
b/ Quản lý, sử dụng kinh phí ngân sách đúng mục đích, tiết kiệm, có hiệu quả.
Điều 50.-
1. Cấp phát các khoản chi thường xuyên của các đơn vị hành chính, sự nghiệp:
a/ Căn cứ vào dự toán ngân sách được giao, các đơn vị sử dụng ngân sách lập dự toán chi hàng quý gửi cơ quan quản lý cấp trên; cơ quan quản lý cấp trên tổng hợp gửi cơ quan tài chính cùng cấp.
b/ Cơ quan tài chính thẩm tra dự toán chi của từng đơn vị sử dụng ngân sách và căn cứ vào khả năng ngân sách để bố trí mức chi cho các đơn vị sử dụng ngân sách hoặc bố trí mức chi cho cơ quan quản lý cấp trên của đơn vị và uỷ quyền cho cơ quan quản lý cấp trên phân phối cho từng đơn vị sử dụng ngân sách, thông báo cho đơn vị sử dụng ngân sách và kho bạc nơi giao dịch để thực hiện.
c/ Mức chi hàng quý được phân phối là hạn mức cao nhất mà đơn vị sử dụng ngân sách được chi trong quý.
d/ Căn cứ vào hạn mức chi được phân phối, thủ trưởng đơn vị sử dụng ngân sách ra lệnh chuẩn chi kèm theo hồ sơ thanh toán gửi Kho bạc Nhà nước nơi giao dịch.
đ/ Kho bạc Nhà nước nơi giao dịch căn cứ vào thông báo hạn mức chi được cơ quan tài chính hoặc cơ quan quản lý cấp trên phân phối cho đơn vị, kiểm tra tính hợp pháp của hồ sơ thanh toán, các điều kiện chi và lệnh chuẩn chi của thủ trưởng đơn vị sử dụng ngân sách, thực hiện việc cấp phát, thanh toán.
e/ Bộ trưởng Bộ Tài chính hướng dẫn thực hiện từng bước nguyên tắc thanh toán trực tiếp từ Kho bạc Nhà nước cho người hưởng lương, người cung cấp hoặc người nhận thầu.
g/ Đối với các khoản chi nhỏ và các khoản chi chưa có điều kiện thực hiện việc thanh toán trực tiếp, Kho bạc Nhà nước cấp tạm ứng cho đơn vị sử dụng ngân sách để chủ động chi theo dự toán được duyệt, sau đó thanh toán với Kho bạc Nhà nước để chuyển từ cấp tạm ứng sang thực chi.
Bộ Tài chính quy định cụ thể hạn mức được tạm ứng phù hựp với loại hình và quy mô hoạt động của các đơn vị sử dụng ngân sách.
h/ Đối với các khoản chi của cơ quan đại diện Việt Nam ở nước ngoài, căn cứ vào hạn mức chi hàng quý do cơ quan tài chính thông báo, đơn vị được rút tiền từ quỹ ngân sách do Bộ Tài chính uỷ quyền cho đơn vị quản lý để chi tiêu theo dự toán được duyệt và theo chế độ quy định.
2. Cấp phát và cho vay vốn đầu tư xây dựng:
a/ Căn cứ vào kế hoạch vốn đầu tư xây dựng từ nguồn ngân sách được giao, chủ đầu tư lập kế hoạch thanh toán hàng quý gửi cơ quan cấp phát vốn đầu tư (Tổng cục Đầu tư phát triển, Cục Đầu tư phát triển các tỉnh hoặc chi cục đầu tư phát triển các quận, huyện). Cơ quan cấp phát vốn đầu tư xem xét, tổng hợp kế hoạch quý gửi cơ quan tài chính.
b/ Cơ quan tài chính thẩm tra kế hoạch chi của cơ quan cấp phát vốn đầu tư và căn cứ vào khả năng ngân sách để bố trí mức chi hàng quý cho cơ quan cấp phát vốn đầu tư, trong đó có chi tiết mức chi cho những công trình quan trọng;
c/ Căn cứ mức chi do cơ quan tài chính thông báo, cơ quan cấp phát vốn đầu tư phân bổ hạn mức chi hàng quý cho từng chủ đầu tư;
d/ Căn cứ hạn mức chi được phân bổ và khối lượng XDCB đủ điều kiện thanh toán, chủ đầu tư gửi hồ sơ thanh toán đến cơ quan cấp phát vốn đầu tư;
đ/ Cơ quan cấp phát vốn đầu tư thẩm định hồ sơ cấp phát thanh toán và yêu cầu Kho bạc Nhà nước thanh toán cho chủ đầu tư hoặc thay chủ đầu tư thanh toán cho người nhận thầu;
e/ Bộ trưởng Bộ Tài chính quy định cụ thể phương pháp và trình tự cấp phát, cho vay và thanh toán vốn đầu tư xây dưng cơ bản thuộc nguồn ngân sách nhà nước phù hợp với Luật Ngân sách nhà nước, Điều lệ quản lý đầu tư và xây dựng và các điều kiện của từng khoản cấp phát, vay.
4. Bộ trưởng Bộ Tài chính quy định phương thức cấp phát các khoản chi khác của ngân sách nhà nước.
Điều 51.-
1. Chính phủ điều chỉnh dự toán ngân sách đã giao cho các Bộ, cơ quan ngang Bộ, cơ quan thuộc Chính phủ và các cơ quan Trung ương khác; điều chỉnh tỷ lệ phần trăm (%) phân chia các khoản thu giữa ngân sách Trung ương và ngân sách cấp tỉnh, mức bổ sung từ ngân sách Trung ương cho ngân sách cấp tỉnh và báo cáo Uỷ ban thường vụ Quốc hội, Quốc hội trong các trường hợp sau:
a/ Quốc hội điều chỉnh dự toán ngân sách nhà nước;
b/ Có yêu cầu cấp bách về quốc phòng, an ninh;
c/ Có biến động lớn về thu, chi ngân sách so với mức đã phân bổ.
2. Uỷ ban nhân dân các cấp theo thẩm quyền, điều chỉnh dự toán ngân sách đã giao cho các cơ quan trực thuộc; điều chỉnh tỷ lệ phần trăm phân chia các khoản thu giữa ngân sách các cấp chính quyền địa phương, số bổ sung cho ngân sách cấp dưới và báo cáo Hội đồng nhân dân trong các trường hợp sau:
a/ Hội đồng nhân dân điều chỉnh dự toán ngân sách địa phương;
b/ Có biến động lớn về thu, chi ngân sách so với mức đã phân bổ.
3. Cơ quan nhà nước điều chỉnh dự toán ngân sách của các đơn vị trực thuộc, sau khi thoả thuận với cơ quan tài chính cùng cấp, trong các trường hợp sau:
a/ Chính phủ, Uỷ ban nhân dân quyết định điều chỉnh dự toán ngân sách của cơ quan đó;
b/ Cần phân bổ lại ngân sách cho các đơn vị.
4. Đối với các đơn vị sử dụng ngân sách khi cần thiết phải sắp xếp lại các khoản chi để đáp ứng các yêu cầu cần thiết thì thủ trưởng đơn vị lập phương án điều chỉnh báo cáo cơ quan quản lý cấp trên, báo cáo cơ quan tài chính cùng cấp để giải quyết.
1. Nếu tăng thu hoặc tiết kiệm chi so với dự toán được duyệt thì số tăng thu hoặc tiết kiệm chi được dùng để giảm bội chi, tăng chi trả nợ hoặc để bổ sung quỹ dự trữ tài chính, hoặc tăng chi một số khoản cần thiết khác nhưng không được tăng chi về quỹ tiền lương, trừ trường hợp đặc biệt được cấp có thẩm quyền cho phép.
2. Nếu giảm thu so với dự toán được duyệt thì phải sắp xếp lại để giảm một số khoản chi tương ứng.
3. Nếu có nhu cầu chi đột xuất ngoài dự toán nhưng không thể trì hoán được mà nguồn dự phòng không đủ đáp ứng thì phải sắp xếp lại các khoản chi, để có nguồn đáp ứng nhu cầu chi đột xuất đó.
4. Khi thực hiện việc tăng, giảm thu, chi, Thủ tướng Chính phủ (đối với ngân sách Trung ương), Chủ tịch Uỷ ban nhân dân (đối với ngân sách địa phương) phải báo cáo Uỷ ban thường Vụ Quốc hội, Quốc hội hoặc Hội đồng nhân dân cùng cấp vào kỳ họp gần nhất.
Điều 53.-
3. Kho bạc Nhà nước mở tài khoản tại Ngân hàng Nhà nước và các ngân hàng thương mại quốc doanh theo quy định để tập trung các khoản thu, cấp phát, thanh toán các khoản chi của ngân sách nhà nước. Ngân hàng nơi Kho bạc Nhà nước mở tài khoản có trách nhiệm bảo đảm thanh toán, điều hoà tiền mặt, ngoại tệ cho Kho bạc Nhà nước đầy đủ, kịp thời theo nhiệm vụ thu, chi của ngân sách Nhà nước. Tiền gửi của Kho bạc Nhà nước tại ngân hàng được hưởng lãi suất như các đơn vị, tổ chức kinh tế; các khoản thanh toán của Kho bạc Nhà nước qua ngân hàng phải trả phí thanh toán.
Điều 55.-
1. Dự phòng ngân sách được sử dụng để khắc phục hậu quả thiên tai, địch hoạ và trong trường hợp phát sinh nhu cầu chi cấp thiết chưa được bố trí hoặc bố trí chưa đủ trong dự toán ngân sách được giao (kể cả nhu cầu tăng chi bổ sung cho ngân sách cấp dưới), mà sau khi sắp xếp lại các khoản chi, cơ quan chủ quản, đơn vị sử dụng ngân sách, chính quyền cấp dưới vẫn không xử lý được.
2. Thẩm quyền xử lý như sau:
a/ Đối với dự phòng ngân sách trung ương, Bộ trưởng Bộ Tài chính được quyết định mức chi từ 1.000 triệu đồng trở xuống sau đó tổng hợp báo cáo Thủ tướng Chính phủ. Trên mức này, Bộ trưởng Bộ Tài chính trình Thủ tướng Chính phủ xem xét, quyết định;
b/ Đối với dự phòng ngân sách địa phương, Chủ tịch Uỷ ban nhân dân quyết định hoặc uỷ quyền cho cơ quan tài chính quyết định.
3. Việc sử dụng dự phòng ngân sách phải tuân thủ các điều kiện về chi ngân sách và theo qui trình cấp phát quy định tại các Điều 48, 49, 50 của Nghị định này.
Điều 56.- Quỹ dự trữ tài chính:
1. Nguồn hình thành quỹ dự trữ tài chính:
a/ Quỹ dự trữ tài chính của Trung ương được hình thành từ các nguồn:
Một phần số tăng thu ngân sách Trung ương so với dự toán.
Mức cụ thể do Thủ tướng Chính phủ quyết định;
Năm mươi phần trăm (50%) kết dư ngân sách Trung ương;
Bố trí trong dự toán chi hàng năm của ngân sách Trung ương.
Mức cụ thể do Chính phủ trình Quốc hội quyết định.
b/ Quỹ dự trữ tài chính của tỉnh, được hình thành từ các nguồn:
Một phần số tăng thu so với sự toán của ngân sách cấp tỉnh.
Mức cụ thể do Chủ tịch Uỷ ban nhân dân tỉnh quyết định;
Năm mươi phần trăm (50%) kết dư ngân sách cấp tỉnh;
Bố trí trong dự toán chi hàng năm của ngân sách cấp tỉnh. Mức cụ thể do Chủ tịch Uỷ ban nhân dân tỉnh trình Hội đồng nhân dân quyết định.
2. Quản lý và sử dụng quỹ dự trữ tài chính:
a/ Quỹ dự trữ tài chính được quản lý tại Kho bạc Nhà nước.
b/ Quỹ dự trữ tài chính của Trung ương do Bộ trưởng Bộ Tài chính là chủ tài khoản; quỹ dự trữ tài chính của tỉnh do Chủ tịch Uỷ ban nhân dân tỉnh là chủ tài khoản.
c/ Việc trích lập quỹ dự trữ tài chính được thực hiện dần từng năm; mức khống chế tối đa là 25% dự toán chi ngân sách hàng năm của cấp tương ứng.
d/ Quỹ dự trữ tài chính được sử dụng để đáp ứng các nhu cầu chi khi nguồn thu chưa tập trung kịp và phải hoàn trả trong năm ngân sách, trừ các trường hợp đặc biệt được quy định tại điểm e khoản 2 Điều này. đ/ Ngân sách cấp tỉnh được vay quỹ dự trữ tài chính của Trung ương nếu đã sử dụng hết quỹ dự trữ của tỉnh. Ngân sách cấp huyện và cấp xã được vay quỹ dự trữ tài chính của tỉnh.
e/ Trong trường hợp thu ngân sách hoặc vay để bù đắp bội chi không đạt mức dự toán đã được duyệt hoặc xảy ra thiên tai, địch hoạ lớn mà sau khi đã sắp xếp lại ngân sách và sử dụng dự phòng ngân sách vẫn không đủ nguồn để đáp ứng nhiệm vụ chi:
Thủ tướng Chính phủ quyết định sử dụng quỹ dự trữ tài chính của Trung ương để xử lý cân đối ngân sách.
Chủ tịch Uỷ ban nhân dân tỉnh quyết định sử dụng quỹ dự trữ tài chính của tỉnh để xử lý cân đối ngân sách, báo cáo Hội đồng nhân dân cùng cấp và Bộ Tài chính.
KẾ TOÁN VÀ QUYẾT TOÁN NGÂN SÁCH NHÀ NƯỚC
Điều 61.-
1. Công tác kế toán và quyết toán ngân sách nhà nước phải thực hiện thống nhất về:
Chứng từ thu, chi ngân sách nhà nước;
Hệ thống tài khoản, sổ sách, mẫu biểu báo cáo kế toán ngân sách;
Mục lục ngân sách nhà nước.
2. Năm ngân sách bắt đầu từ ngày 01 tháng 01 và kết thúc vào ngày 31 tháng 12 năm dương lịch.
1. Tất cả các khoản thu thuộc ngân sách các năm trước, nộp trong năm sau phải hạch toán và quyết toán vào thu ngân sách năm sau.
2. Tất cả các khoản chi ngân sách thuộc dự toán năm trước chưa thực hiện, không được chuyển sang năm sau cấp phát tiếp. Trường hợp đặc biệt được Bộ trưởng Bộ Tài chính (đối với ngân sách trung ương), Chủ tịch Uỷ ban nhân dân (đối với ngân sách các cấp chính quyền địa phương) quyết định cho cấp phát tiếp thì hạch toán và quyết toán như sau:
- Nếu được quyết định vào chi ngân sách năm trước, thì dùng tồn quỹ ngân sách năm trước để xử lý và hạch toán, quyết toán vào chi ngân sách năm trước (trong thời gian chỉnh lý quyết toán);
- Nếu được quyết định vào chi ngân sách năm sau thì được bố trí vào dự toán chi của ngân sách năm sau.
3. Các khoản nợ, vay và tạm ứng của đơn vị dự toán và của ngân sách các cấp chính quyền phải thanh toán trước khi khoá sổ kế toán cuối năm; trường hợp đặc biệt, nếu được cơ quan có thẩm quyền cho phép thì chuyển nợ, vay và tạm ứng của ngân sách năm trước sang nợ, vay và tạm ứng của ngân sách năm sau.
4. Các khoản tạm thu, tạm giữ phải dược xem xét cụ thể và xử lý như sau:
Hoàn trả cho các đối tượng bị tạm thu, tạm giữ hoặc nộp vào ngân sách nhà nước tuỳ từng trường hợp cụ thể theo quyết định của cấp có thẩm quyền.
Các khoản tạm thu, tạm giữ chờ xử lý được chuyển vào tại khoản tạm giữ theo hướng dẫn của các cấp có thẩm quyền.
5. Đối với các loại vật tư, hàng hoá tồn kho và tiền mặt tồn quỹ tại các đơn vị dự toán cuối ngày 31 tháng 12 phải thực hiện kiểm kê theo quy định hiện hành và được xử lý như sau:
Hàng hoá, vật tư còn sử dụng tiếp cho năm sau thì quyết toán vào chi ngân sách năm trước và trừ vào kinh phí ngân sách năm sau.
Hàng hoá, vật tư không sử dụng, được hạch toán và quyết toán vào chi ngân sách năm trước và thành lập hội đồng thanh lý bán nộp vào ngân sách nhà nước năm sau.
Tồn quỹ tiền mặt của đơn vị đến ngày 31 tháng 12 thuộc nguồn kinh phí của ngân sách nhà nước chưa sử dụng hết, trừ những khoản phải chi nhưng chưa chi, số còn lại nộp vào ngân sách nhà nước.
6. Số dư kinh phí uỷ quyền đến hết ngày 31 tháng 12, Kho bạc Nhà nước đồng cấp làm thủ tục chuyển trả ngân sách cấp trên và báo cáo cho cơ quan tài chính đồng cấp biết. Kho bạc Nhà nước cấp trên nhận được khoản nộp trả kinh phí uỷ quyền của ngân sách cấp dưới, hạch toán giảm cấp phát ngân sách cấp trên và báo cáo cho cơ quan tài chính đồng cấp biết.
Điều 63.- Thời gian chỉnh lý quyết toán quy định như sau:
1. Thời gian chỉnh lý quyết toán là thời gian để xử lý các việc sau đây:
Hạch toán tiếp các khoản thu, chi ngân sách đã phát sinh từ ngày 31 tháng 12 trở về trước, nhưng chứng từ còn đi trên đường;
Đối chiếu và xử lý những sai sót trong quá trình hạch toán kế toán;
Xử lý các khoản chi ngân sách thuộc năm trước theo quyết định của các cấp có thẩm quyền.
2. Thời gian chỉnh lý quyết toán quy định:
Hết ngày 20 tháng 01 đối với ngân sách cấp xã;
Hết ngày 15 tháng 02 đối với ngân sách cấp huyện;
Hết ngày 15 tháng 03 đối với ngân sách cấp tỉnh;
Hết ngày 31 tháng 03 đối với ngân sách Trung ương.
2. Báo cáo quyết toán của các đơn vị dự toán và của ngân sách các cấp chính quyền không được quyết toán chi lớn hơn thu.
3. Ngân sách cấp dưới không được quyết toán các khoản kinh phí uỷ quyền vào báo cáo quyết toán ngân sách cấp mình; cuối năm cơ quan tài chính cấp dưới lập báo cáo tình hình sử dụng nguồn vốn uỷ quyền gửi cơ quan tài chính cấp trên.
4. Báo cáo quyết toán năm gửi cho cơ quan có thẩm quyền phải kèm báo cáo phân tịch quyết toán, bảng cân đối tài khoản kê toán và phải có xác nhận của cơ quan Kho bạc Nhà nước nơi đơn vị giao dịch.
Điều 65.- Quyết toán năm của ngân sách cấp chính quyền nếu có kết dư thì xử lý như sau:
1. Kết dư ngân sách Trung ương, ngân sách cấp tỉnh được trích năm mươi phần trăm (50%) chuyển vào Quỹ dự trữ tài chính, năm mươi phần trăm (50%) chuyển vào thu ngân sách năm sau. Trường hợp Quỹ dự trữ tài chính đã đủ mức giới hạn theo quy định tại điểm c khoản 2 Điều 56 của nghị định này thì chuyển số dư còn lại vào thu ngân sách năm sau.
2. Kết dư ngân sách cấp huyện và ngân sách cấp xã chuyển một trăm phần trăm (100%) vào thu ngân sách năm sau.
1. Đơn vị dự toán cấp dưới có trách nhiệm lập báo cáo quyết toán ngân sách năm theo mẫu biểu quy định gửi đơn vị dự toán cấp trên; trong thời gian tối đa 20 ngày kể từ ngày nhận được báo cáo quyết toán, đơn vị dự toán cấp trên có trách nhiệm xét duyệt quyết toán và thông báo kết quả xét duyệt báo cáo quyết toán cho các đơn vị dự toán cấp dưới. Sau 10 ngày, kể từ ngày nhận được thông báo kết quả xét duyệt quyết toán của đơn vị dự toán cấp trên, đơn vị dự toán cấp dưới nếu không có ý kiến gì khác thì coi như chấp nhận để thi hành.
2- Cơ quan dự toán cấp I có trách nhiệm tổng hợp và lập báo cáo quyết toán năm (gồm báo cáo quyết toán đơn vị mình và báo cáo quyết toán của các đơn vị dự toán cấp dưới trực thuộc), gửi cho cơ quan tài chính đồng cấp.
3- Cơ quan tài chính có trách nhiệm xét duyệt báo cáo quyết toán năm của các đơn vị dự toán cấp I trực thuộc trong thời gian tối đa 10 ngày (đối với cấp huyện); 20 ngày (đối với cấp tỉnh); 30 ngày (đối với cấp trung ương) kể từ ngày nhận được báo cáo quyết toán và thông báo kết quả xét duyệt báo cáo quyết toán năm cho các đơn vị. Sau 10 ngày, kể từ khi nhận được thông báo xét duyệt báo cáo quyết toán năm của cơ quan tài chính, nếu đơn vị không có ý kiến gì khác thì coi như chấp nhận để thi hành.
Trong quá trình xét duyệt quyết toán, cơ quan tài chính có quyền tham gia xét duyệt quyết toán năm của đơn vị dự toán cấp dưới trực thuộc các đơn vị dự toán đồng cấp nếu thấy cần thiết.
4. Trường hợp đơn vị có ý kiến không thống nhất với kết quả thông báo xét duyệt quyết toán của cơ quan tài chính thì đơn vị phải trình Uỷ ban nhân dân cùng cấp (nếu là đơn vị dự toán thuộc cấp chính quyền địa phương) hoặc trình Chính phủ (nếu là các đơn vị dự toán thuộc trung ương) để quyết định. Trong khi chờ ý kiến quyết định của Uỷ ban nhân dân cùng cấp và Chính phủ thì mọi quyết định của cơ quan tài chính vẫn được thi hành.
5. Cơ quan được giao nhiệm vụ thu có trách nhiệm tổ chức công tác kế toán thu ngân sách; lập báo cáo quyết toán thu ngân sách nhà nước hàng năm gửi cơ quan quản lý cấp trên và gửi cơ quan tài chính cùng cấp.
1. Ban tài chính xã có trách nhiệm lập báo cáo quyết toán thu, chi ngân sách hàng năm của cấp xã trình Uỷ ban nhân dân xã để trình Hội đồng nhân dân xã phê chuẩn.
Sau khi Hội đồng nhân dân xã phê chuẩn, báo cáo quyết toán được lập thành 04 bản gửi Hội đồng nhân dân xã, Uỷ ban nhân dân xã và Phòng tài chính huyện.
2. Phòng Tài chính huyện có trách nhiệm thẩm tra báo cáo quyết toán thu, chi ngân sách của cấp xã; lập báo cáo quyết toán thu, chi ngân sách cấp huyện; tổng hợp báo cáo thu ngân sách nhà nước trên địa bàn huyện; quyết toán chi ngân sách huyện (gồm chi ngân sách cấp huyện và chi ngân sách xã) trình Uỷ ban nhân dân huyện để trình Hội đồng nhân dân huyện phê chuẩn. Sau khi Hội đồng nhân dân huyện phê chuẩn, báo cáo quyết toán năm được lập thành 04 bản gửi Hội động nhân dân huyện, Uỷ ban nhân dân huyện và Sở Tài chính - Vật giá.
3. Sở Tài chính - Vật giá có trách nhiệm thẩm tra báo cáo quyết toán thu, chi ngân sách cấp huyện; lập báo cáo quyết toán thu, chi ngân sách của cấp tỉnh; tổng hợp báo cáo thu ngân sách nhà nước trên địa bàn tỉnh và báo cáo quyết toán chi ngân sách tỉnh (bao gồm: chi ngân sách cấp tỉnh, chi ngân sách cấp huyện và chi ngân sách cấp xã) trình Uỷ ban nhân dân tỉnh để trình Hội đồng nhân dân tỉnh phê chuẩn, đồng gửi cơ quan kiểm toán nhà nước khu vực. Sau khi được Hội đồng nhân dân tỉnh phê chuẩn, báo cáo quyết toán năm được lập thành 04 bản gửi Hội đồng nhân dân tỉnh, Uỷ ban nhân dân tỉnh và Bộ Tài chính;
4. Bộ Tài chính có trách nhiệm thẩm tra báo cáo quyết toán thu, chi ngân sách tỉnh; lập báo cáo quyết toán thu, chi ngân sách trung ương và tổng hợp lập báo cáo tổng quyết toán thu, chi ngân sách Nhà nước trình Chính phủ để trình Quốc hội phê chuẩn; đồng gửi cơ quan kiểm toán nhà nước.
1. Kết thúc năm ngân sách, đối với các công trình xây dựng cơ bản và chương trình dự án quốc gia đã hoàn thành thì chủ đầu tư, dự án phải lập báo cáo tổng quyết toán toàn bộ nguồn vốn, tình hình sử dụng vốn theo chế độ quy định hiện hành gửi cơ quan cấp phát vốn đầu tư và cơ quan có thẩm quyền xét duyệt; nếu công trình xây dựng cơ bản, chương trình dự án quốc gia chưa hoàn thành, cuối năm chủ đầu tư phải lập báo cáo quyết toán nguồn vốn đã được cấp, tình hình sử dụng vốn và tiến độ đã thực hiện gửi cơ quan cấp phát vốn đầu tư và cơ quan tài chính.
2. Riêng các công trình xây dựng cơ bản quan trọng, chủ đầu tư phải lập báo cáo quyết toán trình Chính phủ để Chính phủ trình Quốc hội.
Điều 70.-
1. Thời hạn nộp báo cáo kế toán và quyết toán quý, năm:
a/ Báo cáo tháng và quyết toán quý do Bộ trưởng Bộ Tài chính quy định.
b/ Báo cáo quyết toán năm gửi cơ quan tài chính chậm nhất 30 ngày sau khi kết thúc năm (đối với đơn vị dự toán cấp I của huyện), 60 ngày (đối với đơn vị dự toán cấp I của Tỉnh) và 90 ngày (đối với đơn vị dự toán cấp I của Trung ương).
c/ Báo cáo quyết toán năm của ngân sách cấp dưới gửi cấp trên chậm nhất là ngày 31 tháng 01 năm sau (đối với quyết toán ngân sách xã); chậm nhất là ngày 28 tháng 02 năm sau (đối với quyết toán ngân sách huyện) và chậm nhất là ngày 30 tháng 03 năm sau (đối với quyết toán ngân sách tỉnh).
2. Trường hợp đơn vị dự toán, ngân sách cấp dưới không gửi báo cáo quyết toán quý và báo cáo quyết toán năm đúng thời gian quy định, cơ quan tài chính có quyền tạm đình chỉ cấp kinh phí cho đến khi nhận được báo cáo quyết toán, trừ một số khoản chi cấp thiết theo quyết định của cấp có thẩm quyền.
Bộ Tài chính và các Bộ có liên quan có trách nhiệm hướng dẫn và tổ chức thực hiện Nghị định này.

g/ Price subsidies in accordance with the State policies;
h/ National programs;
i/ Support for the social insurance fund as stipulated by the Government;

k/ Financial support for social and socio-professional organizations in accordance with the provisions of law;

2. Spendings on development investment:
a/ Investment in the construction of socio-economic infrastructure projects without possibility of capital recovery;

c/ Spending on the National Investment Support Fund and Development Support Funds for economic development programs and projects;
d/ The State reserve;
e/ Government’s loans for development investment.
3. Payments of the principal of State borrowings.

The budgets of the local administration of various levels shall include:
1. The budgets of the provinces and the cities directly under the Central Government (provincial budget for short);
2. The budgets of the districts, precincts, towns and cities under the provinces (district budget for short);
3. The budgets of the communes, wards and townships (commune budget for short)
1. Being consistent with the State’s assignment of responsibilities for socio-economic management;
2. The central budget plays the leading role and concentrates major resources to ensure the achievement of the key national objectives;
3. Clearly determining the revenue sources and the spending tasks among the different levels and stabilizing the percentages (%) for the division of the revenues and additional allocations from the higher-level budget to the lower-level budget from 3 to 5 years. Every year, in case of price increases, additional allocations to the lower level budget shall be considered and made only in proportion to the price increases;

2. The budget drafting units, organizations and individuals must fulfill the obligation of payment to the State budget as prescribed by law; use the State budget allocations for the right purposes and according to the set regime in an economical and efficient manner. No organization or individual other than the agency competent to allocate the budget can change the assigned budget tasks.
3. The financial agencies of all levels shall, within the scope of their tasks and powers, have to urge and supervise the organizations and individuals that have the obligation to make remittances to the State budget to pay fully and in time; and shall, basing themselves on the sources of the State budget revenues, allocate fully and in time all the expenditures according to the draft budget, the regime, criteria and the work schedule.
4. Branches, agencies and units are strictly forbidden to design their own regime and criteria for the State budget collection and spending ultra vices and in contravention to the provisions of law.
1. All State budget revenues and expenditures must be fully accounted for in the State budget.
The organizations and individuals tasked to collect, remit to or use the State budget must organize cost-accounting accountancy, prepare accounting reports and final accounts in accordance with the accountancy regime of the State; make full and honest final statement of accounts of all revenues and expenditures that arise; use uniform receipts and vouchers issued by the Ministry of Finance.

Article 8.- During the process of drafting, implementing and making the final statement of accounts of the State budget, the Ministry of Finance, the Ministries, branches and the People�s Committees of various levels must produce concrete explanations and supply documents related to the budgetary revenues and expenditures at the request of the Budgetary and Economic Commission of the National Assembly, the Council for Nationalities or other Commissions of the National Assembly.
Article 9.- All State budget revenues and expenditures shall be accounted for in Vietnam Dong.
The State budget revenues in a foreign currency(ies) shall be put into the concentrated foreign currency fund of the State and accounted for in Vietnam Dong in the State budget in accordance with the regulations of the Minister of Finance. State budget revenues collected by the Vietnamese representative missions abroad must be paid to the budget fund managed, by authorization of the Ministry of Finance, by these missions and must be periodically accounted for in the State budget. The State Bank shall have to buy the foreign currencies from the budget when the Ministry of Finance needs to sell them.
With regard to the requirements for State budget expenditures in a foreign currency(ies), such expenditures must be drafted, allocated and settled in Vietnam Dong and the concerned units must buy foreign currencies from the Bank, except cases of paying foreign debts in foreign currencies and a number of other special cases stipulated by the Ministry of Finance.
In cases where the State budget revenues are paid in kind, the equivalent values in cash must be calculated according to the local market price so that they can be reported in the State budget.
Article 10.- When it is necessary to adjust the approved budget estimates due to a substantial change in the State budget or the budget of a local administration of any level, the Government shall submit to the National Assembly the proposed adjustment of the draft State budget, the People�s Committees of various levels shall submit to the People�s Councils of the same level the proposed adjustment of the draft local budget.

1. Mobilize the capital in the country for investment in the construction of infrastructure projects defined in Clause 3, Article 8 of the Law on the State Budget. The balance of the mobilized capital sources at the time of the mobilization shall not exceed 30 per cent of the annual capital construction investment capital of the provincial budget. When it needs to mobilize capital, the provincial People’s Committee shall draw up a plan and report it to the People’s Council for approval before sending it to the Ministry of Finance and the Ministry of Planning and Investment for submission to the Prime Minister for consideration and decision. The mobilized capital shall be used to balance the provincial budget and shall be spent only for the set purposes. The plan must clearly state:
- The investment project already decided by the competent agency;
- The socio-economic efficiency of the project;

- Forms of capital mobilization; amounts to be mobilized; interest rates and the mode of payment of due debts;
- The balance of the mobilized capital;
- The balance of the current year�s provincial budget and the budgetary plan for the following years;

2. Decide the additional revenues as prescribed by the Prime Minster for the construction of infrastructure projects and for given purposes. The provincial People’s Committee shall draw up a plan on mobilizing and using the additional revenues and report it to the People’s Council for consideration and decision. The additional revenue sources shall be used to balance the provincial budget and shall be spent only for the set purposes.
3. Decide the level of fees and charges to be collected in accordance with the provisions of law.
2. The provincial People’s Committee shall determine the percentages (%) for the division of the revenues between the provincial budget and the budget of each district, precinct, town or city directly under the province and the budget of each commune or township. The determination of the percentages (%) of the turnover tax and profit tax defined in Clause 3, Article 32 of the Law on the State Budget must ensure that total allocations to the provincial budget and the budgets of the towns and cities under the province shall not exceed the level of these two taxes set for the province.
The Minister of Finance shall stipulate the method for calculating the additional allocations from the higher-level budget to the lower-level budget in accordance with Article 40 of the Law on the State Budget.

Article 30.- Basis for drafting the annual State budget:

2. Basing itself on the Prime Minister�s directive, the Ministry of Finance shall guide the central agencies and the localities on the requirements, contents and time limit for drafting the State budget and shall notify the control number of the draft State budget.
3. The central agencies and the provincial People’s Committees shall base themselves on the Prime Minister’s directive, the Finance Ministry’s guidance and the specific requirements and tasks of their respective agencies and localities to provide guidance and notify the attached units and the lower-level People�s Committees of the control number of the draft budget so as to draft the budgetary revenues and expenditures within the scope of their management.
Article 32.- Requirements for the draft annual budget:
1. The draft budgets of the budget drafting agencies must comply with the regulations, the forms and time directed by the financial agency; must fully reflect the revenues and expenditures of the agencies according to the List of the State budget.
2. The draft budgets of various levels must categorize revenues by each type and expenditures by each spending area, and according to the ratio between regular spending, investment development spending and debt payment spending.
3. The draft budget must be attached with a report clearly explaining the basis of calculation.

The provincial Customs Services shall draw up plans on the collection of import and export duties under their management and other import-export related revenues and send them to the General Department of Customs, the provincial People�s Committees and the provincial Financial and Pricing Services.

2. The local tax offices shall draw up the draft State budgets of the territories under their management and send them to the tax office of higher level, the People�s Committee and the financial agency of the same level.

The State agency at the central and local levels shall draft the budget revenues and expenditures directly under their management, consider the draft budgets of their attached units; synthesize and draft the budgetary revenues and expenditures under their management and send them to the financial agency of the same level, and also to:
- The planning agency of the same level (for the draft expenditures on capital construction);
- The higher-level agency managing the branch or field (for the draft budget expenditures on such branch or field);

The agency managing the branch or field shall synthesize and draft the budgetary revenues and expenditures of the branch or field and send it to the financial agency of the same level and the higher-level agency managing the branch or field.
The draft budget revenues and expenditures must be attached with a report explaining concretely the basis for calculating each revenue or expenditure item.

The commune People�s Committee shall draft the commune�s budget revenues and expenditures, submit it to the commune People’s Council and report it to the district People’s Committee, and concurrently to the district Financial and Pricing Service.
Before June 15 of each year, the commune People’s Council shall decide the draft budget of the commune for the following year.
2. Drafting and deciding the district budget:
The district Financial Service shall consider the draft budgets of the units attached to the district and the revenues drafted by the tax office, draft the district budget and the plan for its distribution; synthesize and draft the State budget revenues on the district’s territory, and the district budget revenues and expenditures (including the draft budgets of the communes and the district draft budget), report them to the district People’s Committee and submit them to the district People’s Council for consideration and decision before reporting them to the provincial People’s Committee and the provincial Financial and Pricing Service, and also to:
- The provincial Planning and Investment Service (for the draft capital construction investment capital);
- The provincial Service managing the branch or field (for the draft expenditures for the branch or field managed by such Service).
Before August 31 of each year, the district People’s Council shall decide the draft district budget for the following year.

The Ministry of Finance shall assume the main responsibility and coordinate with the other Ministries, on the basis of the budget revenues and expenditures drafted by the Ministries, central agencies and provinces, the draft expenditures of the branches and fields and of the national programs which are prepared by the Ministries and the agency managing the national programs, the demand of debt repayment and the possibility of borrowing, in drafting the central budget revenues and expenditures, synthesizing and drafting the State budget revenues and expenditures and submit them to the Government for submission to the National Assembly for decision, shall elaborate a plan on the central budget allocation to each Ministry and branch and the amount of additional allocations from the central budget to each province before submitting them to the Government which will submit them to the Standing Committee of the National Assembly for decision.

a/ To discuss with the lower-level People’s Committees and the concerned agencies and units; to be entitled to request the amendment of revenue and expenditure items which do not comply with the prescribed regime and criteria and which are not rational, economical and suitable to the budget capability and the socio-economic development orientation before the People’s Council decides the budget; to draft annual additional allocations from the higher-level budget to the lower-level budget.
During the process of deliberation to synthesize and draft the budget, if there is a divergence of opinions between the financial agency, other agencies and the lower-level People’s Committee, the local financial agency of any level must submit the matter to the President of the People’s Committee of the same level for decision; the Ministry of Finance shall submit the matter to the Prime Minister for decision;
b/ To assume the main responsibility and coordinate with the concerned agencies and units in drawing up the plan for allocating the draft budget of its own level;
c/ To coordinate with the planning and investment agency of the same level in drafting and allocating the capital construction funds with priority to specific units, projects or constructions;
d/ To coordinate with the agency managing the national programs in drawing up the plan for allocating the draft expenditures for various units;
e/ To propose plans to balance the budget and measures to implement the policy of increasing revenues and saving on budget expenditures.
f/ The Ministry of Finance shall coordinate with the State Bank of Vietnam in elaborating the plan for borrowing loans to cover the State budget overspendings, and in estimating the level and time for making advance payments from the State Bank to make up for temporary deficits of the central budget in the year.
g/ The Ministry of Finance shall consider the resolution of the provincial People’s Council on the draft budget and, when necessary, propose to the Prime Minister to ask the provincial People’s Council to adjust the draft budget.

a/ The Ministry of Planning and Investment shall submit to the Government the national socio-economic development plan and the major balances of the national economy, including the financial, monetary and capital construction fund balances, which shall serve as the basis for the formulation of the financial and budgetary plans; submit to the Government for submission to the National Assembly a list of the national programs and projects, key and important construction projects invested with State budget sources
b/ The Ministry of Planning and Investment and the local planning and investment agency shall, in consultation with the financial agency of the same level, assign the concentrated capital construction investment plan to each unit, each project and construction and send it to the financial level of the same level as a basis for synthesizing and drafting the budget to be submitted to the competent level for decision before allocating it to the various units.
4. The central and local State agencies:
a/ The Ministries and branches shall coordinate with the Ministry of Finance in formulating the regime, criteria and norms for the State budget expenditures of their respective branches and fields.
b/ Each central or local State agency shall organize the drafting of budget revenues and expenditures under the scope of its management, draft the expenditures for the branch or field under its charge and send them to the financial agency of the same level and the higher-level agency managing the branch or field; coordinate with the financial agency of the same level and the lower-level People’s Committee in drafting and allocating the budget of each branch or field;
c/ The agency managing the national programs shall coordinate with the financial agency of the same level in drafting the expenditures of the national programs and the plan on their allocation to various units and localities and send them to the financial agency of the same level for including them into the draft budget to be submitted together with its allocation plan to the competent level for decision and allocation to the concerned units.
a/ Submit to the Government the plan for allocation of the central budget to each Ministry or branch and the additional allocation from the central level to each province. The Government shall submit them to the Standing Committee of the National Assembly for decision;

c/ Provide detailed guidance on budget collection and spending tasks for the central agencies, provincial People’s Committees and State enterprises.
2. In cases where a resolution of the People’s Council fails to comply with the budget collection and spending tasks assigned by the higher level, the People’s Committee shall revise the draft budget and the plan for allocating the budget revenues and expenditures and submit them to the People’s Council for decision.
3. Basing itself on the resolution of the People’s Council of the same level, the People’s Committee shall decide to assign the budget collection and spending tasks to each attached agency or unit; the budget collection and spending tasks and the additional allocation to the lower-level budget.
2. When submitted to the People’s Council, the draft budget of the local administration of any level must be attached with the following necessary documents:
a/ A report on the situation of the implementation of the preceding year�s budget, orientations, tasks, objectives and grounds for drafting the budget and measures to implement the budget;
b/ The list of socio-economic infrastructure construction projects;
c/ The plan on additional revenues and their use;

e/ In cases where the provincial budget needs to mobilize domestic investment capital to construct infrastructure projects managed by the provincial level, a project dossier must be submitted to the People’s Council, sent to the Ministry of Planning and Investment and evaluated by the Ministry of Finance before it is submitted to the Prime Minister for decision;
f/ Other materials clearly explaining the draft budget revenues and expenditures.
IMPLEMENTATION OF THE
STATE BUDGET
2. The results of the allocation of the draft budget to the budget using units must be sent to the financial agency of the same level and the treasury where the units have an account; the financial agency shall have to examine the results and ask for readjustment whenever they are inconsistent with the contents of the draft budget assigned by the competent level.
3. The division and allocation of the draft budget to the budget using units must complete before December 31 of the preceding year.

- Spending on wages and wage-related items;
- Spending on professional fees and official duty fees;
- A number of other necessary expenses to ensure the operation of the apparatus, excluding the expenses for purchase of equipment and repairs;
- Spending on half-completed capital construction projects invested by the State budget with an implemented volume qualified to receive payments;
- Spending on on-going projects of the national programs;
- Spending on additional allocations to lower-level budgets.
2. Each monthly advance payment shall not exceed the average monthly payment of the preceding year.

2. When an organization or individual delays the payment of the amounts due to the State budget without a plausible reason, on the basis of the request of the competent agency defined in Clause 3 of this Article, the banks and treasuries must make deductions of the deposited money of such organization or individual to pay to the State budget or take other financial measures to collect revenues for the budget.
3. The agencies competent to request the banks and treasuries to make deductions of the deposited money of organizations and individuals to pay to the State budget include:
- The tax office and the customs office with regard to delayed payment of taxes and fees;
- The financial agency with regard to delayed payment of other revenues.
4. In cases where an organization or individual deliberately evades payments, they shall be handled in accordance with the provisions of law after their deposited money is deducted to pay to the budget.
1. Only the following agencies shall be allowed to organize the collection of State budget revenues:
- The State tax office;

- The financial agency and other agencies permitted by the Government or authorized by the Ministry of Finance.
2. The collecting agencies shall have the tasks and powers defined in Article 59 of the Law on the State Budget.
3. The collecting agencies must use the vouchers issued by the Ministry of Finance for collecting and paying budgetary revenues.
1. Depending on the borrowing purposes, the borrowings shall be used on the following principles:
- With regard to borrowings for investment projects to construct the infrastructure and socio-economic development projects eligible for State budget allocations, the Ministry of Finance shall allocate capital to them in accordance with the prescribed regime.
- With regard to borrowings for projects eligible for State credit, the Ministry of Finance shall carry out the lending.
2. The Ministry of Finance shall stipulate in details the management of receipt and allocation of foreign borrowings on the aforesaid principles and in accordance with each agreement signed with a foreign country.

2. With regard to donations of which the users are not yet identified, the financial agency shall manage and register them as budgetary revenues and at the same time determine the plan on their use in consistence with the commitments and purposes already agreed with the donors, submit them to the competent level for decision before allocating them to the using units and completing the State budge allocation procedure.
Article 48.- State budget expenditures shall be only made when the following conditions are met:
1. They are included in the approved draft State budget, except the following cases:
a/ The draft budget and the plan on its allocation not yet decided by the competent agency or the draft budget allocation must be adjusted as prescribed in Articles 56 and 62 of the Law on the State Budget.
b/ Expenditures from the budget reserve source by decision of a competent level.
2. Consistent with the regime, criteria and norms stipulated by the competent State agency.
3. Approved by the head of the budget using agency or an authorized person.
4. Apart from the conditions defined in Clauses 1,2 and 3 of this Article, in cases where the State budget allocations are to be used for investment in capital construction, for purchase of working equipment and facilities and for other activities which require bidding, the bidding must be organized in accordance with the regulations of the Government.

a/ Supervising the draft budget allocations to the budget using agencies in accordance with Article 41 of this Decree;
b/ Notifying the quarterly expenditure norms in consistence with the contents and implementation tempo of the spending tasks within the total amount of the approved draft annual budget;
c/ Supervising the purpose and characteristics of each spending, ensuring that it meets the prescribed conditions before ordering the disbursement of the budgetary fund in cases where the financial agency is allowed to make direct allocations;
d/ Supervising the budget use in the budget using agencies and units.
2. The State Treasury agency:
Supervising spending approval orders, if the spending approval order is consistent with the spending norm notified by the financial agency and ensures the spending conditions defined in Article 48 of this Decree, the State Treasury agency must effect payments to payees.
3. Central and local State agencies:
a/ On the basis of the quarterly spending norm notified by the financial agency, they must, by authorization of the financial agency, allocate the quarterly expenditures to the attached units; at the same time send a report thereon to the financial agency of the same level and the State treasury where it has an account.
b/ Guiding, monitoring and supervising the use of the budget of the branches and fields under their management and of the attached units.

a/ Approving expenditures in accordance with the regime, criteria and assigned spending norm defined by the competent agency;
b/ Managing and using the budget allocations according to the purpose and in an economical and efficient manner.
1. Allocating regular expenditures of administrative and non-business units:
a/ On the basis of the allocated draft budget, the budget using units shall draft quarterly expenditures and send them to the higher-level managing agency which shall sum up and send them to the financial agency of the same level.
b/ The financial agency shall verify the draft expenditures of each budget using unit and basing itself on the budget capability allocate the spending norm to each budget using unit or to the higher-level managing agency of these units and authorize it to re-allocate the spending norm to each budget using unit, and notify the budget using units and the treasury where these units have transacted for implementation.
c/ The assigned quarterly spending norm is the maximum norm of expenditures the budget using unit can effect in the quarter.
d/ On the basis of the allocated spending norm, the head of the budget using unit shall issue a spending approval order attached with the payment documents and send them to the State treasury where the unit has its account.
e/ The State treasury, where the unit has an account, shall, on the basis of the notice on the spending norm allocated by the financial agency or the higher-level managing agency to the unit, verify the validity of the payment dossier, spending conditions and the spending approval order of the head of the budget using unit, effect the allocation and payment.

g/ With regard to minor spendings and spendings that do not meet the conditions for direct payment, the State treasury shall make advance payments to the budget using units so that they can spend on their own initiative according to the approved draft budget , and then settle them with the State treasury as actual payments.
The Ministry of Finance shall stipulate in details the maximum advance payment amount suited to the respective operational form and scale of the budget using units.
h/ With regard to the spendings of overseas representative missions of Vietnam, basing themselves on the spending norm notified by the financial agency, these missions can withdraw money from the budgetary fund under their management by authorization of the Ministry of Finance for spending according to the approved draft budget and the prescribed regime.
2. Allocating and lending construction investment capital:
a/ Basing himself/herself on the plan on the construction investment capital from the allocated budget source, the investor shall draw up quarterly settlement plans and send them to the investment capital allocating agency (the General Department of Development Investment, the provincial Department of Development Investment or the district Department of Development Investment). The investment capital allocating agency shall consider and synthesize these quarterly plans and submit them to the financial agency;
b/ The financial agency shall verify the expenditure plan of the investment capital allocating agency and, depending on the budget capability, assign the quarterly estimated expenditures to the investment capital allocating agency, including the estimated expenditures on important projects;
c/ On the basis of the expenditures notified by the financial agency, the investment capital allocating agency shall allocate the quarterly spending norm to each investor;
d/ On the basis of the allocated spending norm and the capital construction volume eligible for payments, the investor shall send the payment dossier to the investment capital allocating agency;
e/ The investment capital allocating agency shall evaluate the payment allocating dossier and request the State treasury to make payments to the investor or to the contractor on the investor’s behalf;

3. In cases where the higher-level State management agency authorizes the lower-level State management agency to perform a spending task that comes under the former’s function, the higher-level financial agency must transfer funds from the higher-level budget to the lower-level financial agency for performing such task. The agency receiving the authorized allocation shall have to manage and use it in accordance with the State budget allocating regime and must account for and report them separately to the authorizing State agency. By December 31, the unused amount of the authorized allocation must be returned to the higher-level budget.
4. The Minister of Finance shall stipulate the mode of allocating other expenditures of the State budget.
a/ The National Assembly adjusts the draft State budget;
b/ There is an urgent defense or security requirement;
c/ There is a substantial change in budget revenues and expenditures compared with the allocated amounts.
2. The People’s Committees of various levels shall, within their competence, adjust the draft budgets already assigned to their attached units; adjust the percentages (%) for division of the revenues between the budgets of various levels of the local administration and the additional allocations to the lower-level budget and report to the People’s Council in the following cases:
a/ The People�s Council adjusts the draft local budget;

3. The State agency shall adjust the draft budgets of its attached units, after consulting the financial agency of the same level, in the following cases:
a/ The Government or the People’s Committee decides to adjust the draft budget of that agency;
b/ It is necessary to re-allocate the budgets to the units.
4. With regard to a budget using unit when necessary the expenditure items shall be adjusted to meet the necessary demands, the head of the unit shall draw up an adjustment plan and report it to the higher-level management agency and the financial agency of the same level for resolution.
1. If the revenues increase or the expenditures decrease as compared with the approved draft budget, the revenue increase or expenditure reduction shall be used to cover overspending, pay debts or add to the financial reserve fund, or to increase a number of other necessary spendings but it must not be used to increase the wage fund, except for special cases permitted by a competent level.
2. If revenues decrease as compared with the approved draft budget, readjustments must be done to reduce a number of corresponding expenditures.
3. In case of an unexpected spending need outside the draft budget which can not be delayed while the reserve source fails to meet it, expenditures must be adjusted to meet such need.
4. When increasing or reducing revenues or expenditures, the Prime Minister (for the central budget) or the President of the People’s Committee (for a local budget) must report it to the Standing Committee of the National Assembly, the National Assembly or the People’s Council of the same level respectively at the next meeting.

2. The State treasury is an agency managing the State budget fund (the central budget fund and the budget funds of various levels of the local administration), manage, organize payment and regulate capital and cash in the State budget fund in a uniform manner in order to fully and rapidly collect the revenues; to meet in time payment needs of the State budget.
3. The State treasury shall open accounts at the State Bank and the State-owned commercial banks as prescribed so as to concentrate revenues, allocations and settle expenditures of the State budget. The bank where the State treasury opens its account shall have to ensure full and timely payment and regulation of cash and foreign currencies to the State treasury according to the collection and spending tasks of the State budget. The State treasury’s deposits at the banks shall be entitled to interests like economic organizations and units. The State treasury payments effected through the banks must be subject to payment fees.
2. Competence to deal with such need is defined as follows:
a/ With regard to the central budget reserve, the Minister of Finance shall be entitled to decide expenditures of 1,000 million Dong or less, then sum up and report them to the Prime Minister. For expenditures above this level, the Minister of Finance shall submit them to the Prime Minister for consideration and decision;
b/ With regard to the local budget reserve, the President of the People’s Committee shall decide or empower the financial agency to decide.
3. The use of the budget reserve must comply with the conditions set for the budget spending and the budget allocation procedure defined in Articles 48, 49 and 50 of this Decree.

1. The sources for the formation of the financial reserve fund:
a/ The central financial reserve fund shall be formed from the following sources:
- Part of the revenue excess as compared with the draft central budget.
The concrete level shall be decided by the Prime Minister;
- Fifty percent (50%) of the central budget remainder;
- The amount included in the annual draft expenditures of the central budget.
The concrete level shall be submitted by the Government to the National Assembly for decision.
b/ The provincial financial reserve fund shall be formed from the following sources:
- Part of the revenue excess as compared with the draft provincial budget.

- The amount included in the annual draft expenditure of the provincial budget. The concrete amount shall be submitted by the President of the provincial People’s Committee to the People�s Council for decision.
2. Management and use of the financial reserve fund:
a/ The financial reserve fund shall be managed at the State Treasury.
b/ The central financial reserve fund shall have the Minister of Finance as its register depositor; the provincial financial reserve fund shall have the President of the People’s Committee as its register depositor.
c/ Deductions for the setting up of the financial reserve fund shall be gradually made year by year; the maximum deduction level is 25 per cent of the annual draft budget expenditure of the corresponding level.
d/ The financial reserve fund shall be used to meet the spending needs only when the revenue sources are not yet gathered while repayment must be made within the budget year, except for special cases defined in Point e, Clause 2 of this Article.
e/ The provincial budget may borrow from the central financial reserve fund if all the provincial reserve fund has been used up. The district and commune budgets may borrow from the provincial financial reserve fund.
f/ In cases where the budget revenues collected or borrowed to cover the overspendings fail to meet the approved draft or when a natural calamity or enemy sabotage occurs and even after the budget has been adjusted and the reserve fund has been used up there remain not enough sources to meet the spending tasks:

- The President of the provincial People�s Committee shall decide to use the provincial financial reserve fund to balance the budget and report it to the People�s Council of the same level and the Ministry of Finance.
ACCOUNTING AND MAKING
FINAL STATEMENT OF ACCOUNTS OF THE STATE BUDGET

- The chart of accounts, accounting books and forms for reporting budget accounts;
- The List of the State Budget.
2. The budget year shall commence on January 1 and end on December 31 of the solar year.
1. All revenues of the preceding years’ budgets which are paid in the current year must be accounted for and paid to the following year’s budget.
2. All expenditures of the current year’s draft budget which have not yet been spent must not be carried over to the following year for further allocation. In special cases where they can be further allocated if it is so decided by the Minister of Finance (for the central budget) or the President of the People’s Committee (for the budget of the local administration of various levels), their accounting and settlement shall be implemented as follows:
- If it is decided that they be included in the preceding year’s budget expenditures, they shall be settled by the preceding year’s budget remainder and be accounted for as expenditures of the preceding year’s budget (during the time when the final accounts are adjusted);
- If it is decided that they be included in the following year’s budget expenditures, they shall be included in the draft expenditures of the following year’s budget.
3. The debts, borrowings and advance payments of the budget drafting agencies and of the budgets of the administration of various levels must be settled before the closing of the accounting books at the end of the year; in special cases, if permitted by the competent agency, the debts, borrowings and advance payments of the current year’s budget shall be carried forward to the following year’s budget.

- To return them to the objects having the temporarily collected or withheld amounts or pay them into the State budget depending on each specific case to be decided by the competent level.
- Pending a decision to deal with them, the temporarily collected or withheld amounts shall be transferred into the account for the temporarily withheld amounts under the guidance of the competent levels.
5. With regard to the unsaleable materials and goods and the cash left-over in the funds of the budget drafting units by the end of December 31, they must be inventoried in accordance with current regulations and shall be dealt with as follows:
- The goods and materials to be used in the following year shall be settled in the current year�s budget expenditures and excluded from the following year’s budget expenditures.
- The unused goods and materials shall be accounted for and settled in the current year�s budget expenditures and a liquidation council shall be set up to sell them and the proceeds therefrom shall be paid to the following year’s State budget.
The left-over of the cash fund of a unit by December 31 belonging to the State budget funds, minus the amounts to be paid, shall be remitted to the State budget.
6. For the balance of the authorized fund (of a budget level) by the end of December 31, the State Treasury agency of the same level shall complete the procedure for returning it to the higher-level budget and report it to the financial agency of the same level. The higher-level State Treasury agency shall receive the returned amount of the authorized fund from the lower-level budget, record it as a reduction in the allocation from the higher-level budget and report it to the financial agency of the same level.
Article 63.- The time for adjusting the final accounts shall be defined as follows:
1. The time for adjusting the final accounts is the time for solving the following tasks:

- Compare and deal with the errors during the process of cost-accounting accountancy;
- Deal with the preceding year’s budget expenditures according to the decisions of the competent levels.
2. The time for adjusting the final accounts is defined as follows:
- By the end of January 20 for the commune-level budget;
- By the end of February 15 for the district-level budget;
- By the end of February 31 for the provincial-level budget;
- By the end of March 31 for the central budget.
Article 64.- The annual final statement of accounts must ensure the following principles:
1. The data in the final statement of accounts must be accurate and conform to the data in the accounting books. The contents of the statement of the budget final accounts must conform to the contents written in the approved budget estimate and to the List of the State Budget.

3. The lower-level budget shall not include the authorized allocations in the final statement of accounts of its budget; at the end of the year the lower-level agency shall make a report on the situation of the use of the authorized funds and send it to the higher-level financial agency.
4. The annual statements of final accounts sent to the competent agency must be attached with the report on account analysis, the balance sheet of the accounting accounts certified by the State Treasury agency where the units has an account.
1. Fifty per cent (50%) of the central or provincial budget remainder shall be deducted and transferred to the financial reserve fund and the other fifty per cent (50%) to the revenues of the following year’s budget. In cases where the financial reserve fund has reached the maximum amount defined in Point c, Clause 2, Article 56 of this Decree, the excess amount shall be transferred to the revenues of the following year’s budget.
2. One hundred per cent (100%) of the district or commune budget remainder shall be transferred to the revenues of the following year’s budget.
1. The lower-level budget drafting unit shall have to make statements of budget final accounts according to the prescribed forms and send it to the higher-level budget drafting unit; within 20 days from the date of receipt of the final statement of accounts, the higher-level budget drafting unit shall have to consider and approve it and notify the lower-level budget drafting unit of its decision. If after ten days from the date it receives the decision of the higher-level unit, the lower-level drafting unit has no other different opinion, it shall be assumed to have accepted the decision and shall implement it.
2. The level I budget drafting agency shall have to synthesize and prepare the annual statements of final accounts (including its own final statement of accounts and the statements of final accounts of the attached lower-level budget drafting units) and send them to the financial agency of the same level.
3. The financial agency shall have to consider and approve the annual statements of final accounts of the level I budget drafting units directly attached to the central Government not later than 10 days (for the district level); 20 days (for the provincial level); 30 days (for the central level) from the date of receipt of the statements of final accounts and notify the concerned units of the decision thereon. If , after 10 days from the date of receipt of the financial agency’s decision on the annual statements of accounts, the concerned unit has no other opinion, it shall be assumed to have accepted the decision and shall implement it.

4. In cases where the concerned unit disagrees with the financial agency’s decision on the statements of final accounts, it must submit its opinion to the People’s Committee of the same level (if it is a budget drafting unit attached to the local administration of any level) or submit it to the Government (if it is a budget drafting unit attached to the Central Government) for decision. Pending a decision of the People’s Committee of the same level or of the Government, all the decisions of the financial agency must be complied with.
5. The agency tasked to collect budget revenues must organize the accounting of such revenues; prepare the annual final statements of accounts of State budget revenues and send them to the higher-level management agency and to the financial agency of the same level.
1. The commune financial service shall have to make the commune’s annual statement of final accounts of budgetary revenues and expenditures and submit it to the commune People’s Committee for submission to the commune People’s Council for approval.
After the statement of final accounts is approved by the commune People’ Council, it shall be made in 04 copies and sent to the People’s Council, the People’s Committee of the commune and to the district Financial Service.
2. The district Financial Service shall have to verify the final statement of accounts of the commune budget’s revenues and expenditures; make the final statement of accounts of the district budget revenues and expenditures; synthesize the reports on State budget revenues in the district area; prepare the final accounts of the district budget expenditures (including the district and commune budget expenditures) and submit them to the district People’s Committee for submission to the district People’s Council for approval. After the annual final statement of accounts is approved by the district People’s Council, it shall be made in 04 copies and sent to the People’s Council, the People’s Committee of the district and to the provincial Financial and Pricing Service.
3. The provincial Financial and Pricing Service shall have to verify the final statements of accounts of the district budget revenues and expenditures; make the final statement of accounts of the provincial budget revenues and expenditures; synthesize the reports on the State budget revenues in the province’s territory; prepare the final accounts of the provincial budget expenditures (including the provincial, district and commune budget expenditures) and submit them to the provincial People’s Committee for submission to the provincial People’s Council for approval, and concurrently to the regional State auditing agency. After the annual final statement of accounts is approved by the provincial People’s Council, it shall be made in 04 copies and sent to the People’s Council, the People’s Committee of the province and to the Ministry of Finance.
4. The Ministry of Finance shall have to verify the final statements of accounts of the provincial budget revenues and expenditures; make the final statement of accounts of the central budget revenues and expenditures and synthesize and make the general final statement of accounts of State budget revenues and expenditures and submit them to the Government for submission to the National Assembly for ratification, and concurrently to the State auditing agency.

2. For important capital construction projects, the investors must make a final statement of accounts and submit it to the Government for submission to the National Assembly.
The budget of any level that collects illegal revenues shall have to refund them, such refunded revenues must be accounted for as a reduction in the budget revenues and when illegal expenditures are canceled or recovered, they must be accounted for as a reduction in the budget expenditures.
a/ The time limit for submitting monthly accounting reports and quarterly statements of accounts shall be defined by the Minister of Finance.
b/ The annual final statements of accounts must be sent to the financial agency not later than 30 days from the end of the year (for the level I budget drafting units of district level), 60 days (for level I budget drafting units of provincial level) and 90 days (for the level I budget drafting units of central level).
c/ The annual statements of final accounts of the lower-level budgets shall be sent to the higher level not later than January 31 of the following year (for commune final statements of accounts); not later than February 28 of the following year (for district final statements of accounts) and not later than March 30 of the following year (for provincial final statements of accounts).
2. In cases where the budget drafting units and the lower-level budgets fail to send quarterly and annual final statements of accounts on time, the financial agency shall be entitled to temporarily suspend the allocation until it receives the statements of final accounts, except a number of urgent expenditures to be decided by the competent level.
