Căn cứ Luật Tổ chức Chính phủ
ngày 30 tháng 9 năm 1992;
Căn cứ Nghị định số 299-HĐBT ngày 15-8-1992 của Hội đồng Bộ trưởng ban hành điều
lệ bảo hiểm y tế;
Theo đề nghị của Bộ trưởng Bộ Y tế,
NGHỊ ĐỊNH:
1. Điều 7 của điều lệ bảo hiểm y tế: Mức đóng bảo hiểm y tế của các đối tượng quy định tại khoản 1, điều 2 bằng 3% mức lương cấp bậc, lương chức vụ và phụ cấp chức vụ (nếu có) theo quy định của Nhà nước trong đó cơ quan, đơn vị có trách nhiệm đóng 2%, cá nhân đóng 1%. Thủ trưởng các cơ quan, đơn vị có trách nhiệm thu nộp cho cơ quan bảo hiểm y tế theo định kỳ ít nhất 3 tháng một lần.
2. Điều 8 của điều lệ bảo hiểm y tế: Đối với các doanh nghiệp nói tại khoản 2, 3, 4 điều 2, mức đóng bảo hiểm y tế bằng 3% mức lương cấp bậc hoặc chức vụ ghi trong hợp đồng, trong đó người sử dụng lao động đóng 2%, người lao động 1%, giám đốc các doanh nghiệp có trách nhiệm thu nộp cho cơ quan bảo hiểm y tế theo định kỳ ít nhất 3 tháng một lần.
3. Điều 10 của điều lệ bảo hiểm y tế: "Đối với công chức, viên chức, quân nhân, công an nhân dân nghỉ hưu, mất sức lao động, mức đóng bảo hiểm y tế hàng tháng bằng 3% mức lương hưu hoặc mức trợ cấp mất sức lao động. Cơ quan Lao động - Thương binh và Xã hội hoặc tổ chức bảo hiểm xã hội có trách nhiệm đóng theo định kỳ ít nhất 3 tháng một lần".

DECREE
ON ADJUSTMENT TO A NUMBER OF ARTICLES OF THE REGULATIONS ON HEALTH INSURANCE PROMULGATED BY VIRTUE OF DECREE No. 299-HDBT ON THE 15th OF AUGUST, 1992 OF THE COUNCIL OF MINISTERS
THE GOVERNMENT
Pursuant to the Law on
Organization of the Government on the 30th of September, 1992;
Pursuant to Decree No. 299-HDBT on the 15th of August, 1992 of the
Council of Ministers on the Regulations on Health Insurance;
At the proposal of the Minister of Public Health;
Article 1.- The following amendments are made to a number of articles of the Regulations on Health Insurance promulgated by virtue of Decree No 299-HDBT on the 15th of August, 1992 of the Council of Ministers:
1. Article 7 of the Regulations on Health Insurance: The level of premiums paid to the health insurance fund by those stated in Provision 1, Article 2, shall be equal to three percent (3%) of the salaries according to their ranks, positions and function allowance (if any) as prescribed by the State. To that amount, the employing agencies shall contribute two percent (2%) and the individual shall contribute one percent (1%). The heads of the agencies and units are responsible for collecting and paying to the health insurance agencies at least once every three months on a regular basis.
2. Article 8 of the Regulations on Health Insurance: For the businesses stated in Provisions 2, 3, and 4 of Article 2, the level of premiums paid to the health insurance fund shall be equal to three percent (3%) of the salary of the rank or position stated in the labor contract. To that amount, the employers shall contribute two percent (2%) and the laborers shall contribute one percent (1%). The directors of these businesses are responsible for collecting and paying to the health insurance agencies at least once every three months on a regular basis.

Article 2.- This Decree shall be implemented as of the 1st of January, 1994. Articles 7, 8 and 10 of the Regulations on Health Insurance, promulgated by virtue of Decree No.299-HDBT of the Council of Ministers on the 15th of August, 1992, are hereby annulled.
Article 3.- The Minister of Public Health, the Minister of Finance and the Minister of Labor, War Invalids and Social Affairs are responsible for guiding the implementation of this Decree.
Article 4.- The ministers, the heads of ministerial-level agencies, the heads of organs attached to the Government, the Chairmen of People's Committees of provinces and of cities directly under the Central Government are responsible for implementing this Decree.
