2. The Parties agree that the following pairs of border crossings will be opened when all conditions are met, the specific time and procedure for opening will be agreed upon by the Parties through diplomatic channels. Before the official opening of these pairs of border crossings, the entry and exit in these areas of people, goods, articles and means of transport must comply with regulations on inspection and quarantine of each Party and relevant provisions agreed upon by the Parties.

4. The official opening, new opening, or closure of the pairs of border crossings will be agreed upon through diplomatic channels. Any relevant written agreement will become the supplementary text of this Agreement.

5. In case of force majeure or other special requirements, the Parties may open a temporary crossing. The temporary crossing must be agreed upon by the provincial authorities (autonomous areas) in the border areas of the two countries through consultations in advance with the consent of the Governments of the Parties, then through diplomatic means to determine.

The entry and exit in this temporary crossing of people, goods, articles and means of transport must comply with regulations on inspection and quarantine of each Party and relevant provisions agreed upon by the Parties.

Article 3.

1. Bilateral border crossings are opened to holders of unexpired passports or other alternative papers of both Parties, holders of entry and exit permits in border areas, goods, articles and means of transport; international border crossings are opened to holders of unexpired passports and other alternative papers of the Parties, holders of entry and exit permits in border areas or holders of unexpired passports or other alternative papers of a third country (region), goods, articles, means of transport; regarding visas for people, relevant agreements of the Parties shall apply.

People, goods, articles, means of transport crossing the border must be subject to the inspection and control of the inspection and quarantine authority.

2. The issuance and use of entry and exit permits in border areas shall comply with the “Agreement on administration of Vietnam and China land border checkpoints between the Government of the Socialist Republic of Vietnam and the Government of the People’s Republic of China”.

Article 4.

1. During the working hours of border crossings, the border inspection and quarantine authority of both Parties shall, based on their domestic regulations and law, exercise their functions and powers. When necessary, the border inspection and quarantine authorities of the Parties may enter into specific agreements to simplify inspection and quarantine procedures.

3. The Parties should, based on relevant regulations of their respective border inspection and quarantine authority, keep each other informed about type, value and quantity of articles, type and amount of cash that a person brings upon his/her entry or exit and relevant regulations on inspection and quarantine.

4. Means of transport carrying people, goods, and articles specified in other relevant agreements between the Parties, after entering the territory of the other Party, must follow the authorized routes agreed upon by relevant bodies of the Parties; other people, goods or articles carried by the said means of transport must be unloaded at designated terminals; and further subject to supervision of the border inspection and quarantine authority of the other Party.

5. The management of entry and exit of people, means of transport shall, based on this Agreement, be agreed upon by the concerned bodies of the Parties.

6. For the purpose of performing rights and obligations specified in the “Agreement on administration of Vietnam and China land border checkpoints between the Government of the Socialist Republic of Vietnam and the Government of the People’s Republic of China” and other agreements signed by the Parties, during the closure of a border crossing, the border representative, the deputy border representative, the border representative assistant, and other staff members of the Parties, with the consent of the border inspection and quarantine authorities of the Parties, may bring documents certified by the Parties for entry and exit through the said border crossing.

Article 5.

1. Open border crossings will officially work all days of the week, including public holidays as prescribed by the Parties’ laws, unless otherwise agreed by the Parties.

The working hours of rail border crossings shall conform to the train hours agreed by the Parties.

2. In a special case where a border crossing must be closed or temporarily opened outside working hours, the Parties must notify and reach a consensus through diplomatic channels at least 5 days in advance. The reopening of the border crossing must be notified to the other Party through diplomatic channels and certified by the other Party.

3. In order to protect the social interests, national security or because of serious natural disasters, major epidemics, plant and animal epidemics and other force majeure circumstances, a Party may temporarily close or restrict the passage through border crossings. However, it is necessary to notify the other Party 5 days in advance; in the case of emergency, this time limit must be shorter than 24 hours.

5. Except as provided for in Clause 3 of this Article, neither Party may unilaterally close a border crossing without the consent of the other Party; if one Party’s unilateral closure of a border crossing results in damage to the other Party, the two Parties will go through diplomatic negotiations to resolve the relevant issues.

Article 6.

When exiting through a border crossing to the other Party, a person of this Party must comply with the laws of the other Party, as well as relevant regulations agreed by the two Parties.  The Parties should protect the legitimate interests of persons entering their territories.

Article 7.

The design and construction of a border crossing should take into account the development needs of the border crossing in the future.

Article 8.

The border inspection and quarantine authorities of the Parties may establish a counterpart contact mechanism on relevant border crossing issues.

Issues that cannot be solved by the border inspection and quarantine authorities of the Parties, within their functions and powers, need to be resolved through diplomatic means.

Article 9.

Article 10.

Any disputes which may arise relating to the interpretation or implementation of this Agreement shall be settled by the Parties through diplomatic means.

Article 11.

During the period of this Agreement's entry into force, the Parties may agree to amend this Agreement.

In order to implement the Agreement in an effective manner, the Parties will formulate a mechanism to implement this Agreement.

Article 12.

The Parties shall notify the other through diplomatic channels of the completion of the domestic legal procedures required by its laws for the entry into force of this Agreement. This Agreement shall enter into force 30 days after the date of final notice.

This Agreement shall remain in force for a period of 10 years; thereafter, it shall be extended automatically for further periods of 10 years each provided that neither Party gives the other Party written notice of denunciation of the Agreement 06 months before it expires.
